RESOLUTION RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT, USR-977 - DAVID AND MANDY AND LOGAN WOLFE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated October 7, 1992, the Board did approve the request of previous owners, Wayne and Marianne Wolfe, for a Site Specific Development Plan and Use by Special Review Permit, USR-977, for a Roping Arena and Training Facility in the A (Agricultural) Zone District, on the following described real estate, to-wit: Part of the SW1/4 of Section 31, Township 9 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request from the current property owners, David and Mandy and Logan Wolfe, 6497 County Road 98, Wellington, Colorado 80549, to partially vacate Use by Special Review Permit, USR-977, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said partial vacation, conditional upon the following: 1. Pursuant to Section 23-2-280.B of the Weld County Code, the applicant shall submit a revised USR map, titled "Partial Vacation of Use by Special Review Permit, USR-977, conforming to Section 23-2-260.D of the Weld County Code. The applicant split the property into two 80 acres parcels and wishes to vacate the USR from the northeastern 80-acre portion. If this partial vacation is approved the applicant will need to submit a revised USR map for USR-977 per Section 23-2-280 of the Weld County Code. The Department of Planning Services is recommending approval of this partial vacation. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 4. The facility shall be maintained in compliance with the Colorado Guidelines for Feedlot Runoff Containment. 5. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. No permanent disposal of wastes shall be permitted at this site. 7. Wood shavings, sawdust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 8. Fugitive dust shall be controlled on this site. 9. The approved water supply shall be tested annually for potability. It is the responsibility of the operator of the facility to maintain records demonstrating that these tests have been carried out. 10. The maximum number of animal units on the property shall not exceed the number allowed by right in the A (Agricultural) Zone District by the Weld County Zoning Ordinance. 11. The use of the roping arena by the public shall be limited to 52 days per year. 12. The use of the facility shall be limited to 200 people. 13.
