HomeMy WebLinkAbout20203114.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, OCTOBER 19, 2020 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, October 19, 2020, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Mike Freeman, Chair Commissioner Steve Moreno, Pro -Tern Commissioner Scott K. James Commissioner Barbara Kirkmeyer — EXCUSED Commissioner Kevin D. Ross Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Bri White Controller, Barbara Connolly IR MINUTES: Commissioner James moved to approve the minutes of the Board Commissioners meeting of October 14, 2020, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. itm IN READ ORDINANCE BY AUDIO: Commissioner Ross moved to read Code Ordinance #2020-18 by audio. The motion was seconded by Commissioner James, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Moreno moved to approve the Certification of Hearings conducted on October 14, 2020, as follows: 1) USR20-0016 — Bryan Edwards. Commissioner James seconded the motion, which carried unanimously. tri AMENDMENTS TO AGENDA: There were no amendments to the agenda. CONSENT AGENDA: Commissioner Ross moved to approve the Consent Agenda, as printed. Commissioner James seconded the motion, and it carried unanimously. PUBLIC INPUT: No public input was given. WARRANTS: 1) GENERAL WARRANTS - OCTOBER 16, 2020: Commissioner James moved to approve the General Warrants, as printed. Commissioner Ross seconded the motion, and it carried unanimously. of County oI/15 Minutes, Monday, October 19, 2020 Page 1 2020-3114 BC0016 • BIDS: 1) APPROVE BID #B2000183, CLERK AND RECORDER BUILDING SITE WORK - DEPARTMENT OF BUILDINGS AND GROUNDS: Rob Turf, Purchasing Department, stated staff recommends selecting the lowest bidder who met specifications, Swift Builders, LLC, for a total amount of $238,057.00. Commissioner Ross moved to approve said bid, the motion was seconded by Commissioner Moreno, and it carried unanimously. NEW BUSINESS: 1) CONSIDER GRANTING PERMANENT RIGHT-OF-WAY UTILITY EASEMENT FOR PARCEL #030312300011 AND AUTHORIZE CHAIR TO SIGN - POUDRE VALLEY RURAL ELECTRIC ASSOCIATION, INC.: Toby Taylor, Director of the Department of Buildings and Grounds, detailed the request to install the three-phase power electric poles for the future Law Enforcement Training site and shooting range. Commissioner James moved to approve granting said easement and authorize the Chair to sign. The motion was seconded by Commissioner Ross and it carried unanimously. • 2) CONSIDER GRANTING PERMANENT RIGHT-OF-WAY UTILITY EASEMENT FOR PARCEL #030312200023 AND AUTHORIZE CHAIR TO SIGN - POUDRE VALLEY RURAL ELECTRIC ASSOCIATION, INC.: Mr. Taylor shared the right-of-way agreement, approved as item #1 above, will utilize the three-phase power electric poles to support a future Rail Facility and Gravel Mining operation. Commissioner Ross moved to approve granting said easement and authorize the Chair to sign. Seconded by Commissioner James, the motion carried unanimously. e__= 3) CONSIDER MASTER AGREEMENT FOR TREASURY MANAGEMENT SERVICES AND AUTHORIZE CHAIR TO SIGN -WELLS FARGO BANK, N.A.: Barbara Connolly, Controller, summarized Douglas County's Request for Proposal (RFP) for a new bank and switched services to Wells Fargo Bank, as their services held the best quality and value. Commissioner Ross commended staff and their efforts in their negotiations with the bank. The motion to approve said master agreement and authorize the Chair to sign was made by Commissioner Moreno, seconded by Commissioner James, and it carried unanimously. • 4) CONSIDER TEMPORARY CLOSURE OF CR 8 BETWEEN CRS 17 AND 19: Amy Mutchie, Department of Public Works, stated the closure will occur between October 26, 2020, and October 30, 2020, to replace a drainage culvert and noted water will be used for dust control along the detour route. Commissioner James moved to approve said temporary closure. The motion, which was seconded by Commissioner Ross, carried unanimously. • 5) CONSIDER TEMPORARY CLOSURE OF CR 70 BETWEEN CRS 59 AND 61: Ms. Mutchie shared the closure will occur from October 26, 2020, to October 30, 2020, to replace an irrigation culvert, at the request of Larson Farms and Feeding, LLC, to connect into the culvert with concrete structures, and she noted water will be used for dust control along the detour route. Commissioner Moreno moved to approve said temporary closure. Commissioner James seconded the motion and it carried unanimously. 6) CONSIDER APPOINTMENT OF DEPUTY DISTRICT ATTORNEY AND AUTHORIZE CHAIR TO SIGN — ANDREW DAILEY: The motion to approve said appointment and authorize the Chair to sign was made by Commissioner James, seconded by Commissioner Ross, and it carried unanimously. Minutes, Monday, October 19, 2020 Page 2 2020-3114 BC0016 7) FIRST READING OF CODE ORDINANCE #2020-18, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 6 LAW ENFORCEMENT, OF THE WELD COUNTY CODE (MODEL TRAFFIC CODE): Bob Choate, Assistant County Attorney, summarized the adoption of the Model Traffic Code to update the fine schedule, including the surcharges and fees, effective January 1, 2021. No public input was provided. Commissioner Ross moved to approve Code Ordinance #2020-18 on First Reading. The motion was seconded by Commissioner James and it carried unanimously. 8) SECOND READING OF CODE ORDINANCE #2020-17, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 8 PUBLIC WORKS, OF THE WELD COUNTY CODE (TRANSPORTATION PLAN): Commissioner James moved to read Code Ordinance #2020-17 by title only. The motion was seconded by Commissioner Ross, and it carried unanimously. Bruce Barker, County Attorney, read the title for the record. Evan Pinkham, Department of Public Works, discussed the alteration to the Transportation Plan Functional Classification Map after First Reading includes an opportunity between the Town of Windsor and the City of Greeley for future alignment at O Street. Commissioner James reviewed the future alignment, displayed as a purple hatch mark on the map, indicates the collaboration and involvement between the municipalities. Responding to Chair Freeman, Elizabeth Relford, Deputy Director of the Department of Public Works, stated, during a work session, the Commissioners and staff agreed to remove County Road (CR) 54 as a designated area for future alignment until the Town of Kersey develops further transportation planning. No public input was provided. Commissioner Moreno moved to approve Code Ordinance #2020-17 on Second Reading. The motion was seconded by Commissioner James and it carried unanimously. Commissioners Moreno and Ross thanked all who collaborated on the plan and map to ensure best practices as the County grows. PLANNING: 1) SECOND READING OF CODE ORDINANCE #2020-13, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 22 COMPREHENSIVE PLAN, OF THE WELD COUNTY CODE: Commissioner James moved to read Code Ordinance #2020-13 by title only. The motion was seconded by Commissioner Moreno, and it carried unanimously. Mr. Barker read the title for the record. Tom Parko, Director of Planning Services, presented the County's outreach efforts with stakeholders and other community members. Jim Flesher, Department of Planning Services, detailed the alteration to the Functional Classification Map ties into the Comprehensive Plan Map by affecting the opportunity zones. In response to Commissioner Moreno, Angela Snyder, Department of Planning Services, shared the community outreach methods are primarily online and staff has received constructive feedback. Responding to Commissioner Ross, Ms. Snyder expressed staff's willingness to alter language, as advised by the public, due to the similarities between the opportunity zone and tax language, which has no correlation. No public input was provided. Commissioner James moved to approve Code Ordinance #2020-13 on Second Reading. Seconded by Commissioner Ross, the motion carried unanimously. Commissioner Ross and Chair Freeman expressed their gratitude to staff for maintaining open communication with the public and encouraging community involvement. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2020-18 was approved on First Reading and Code Ordinances #2020-17 and #2020-13 were approved on Second Reading.
