HomeMy WebLinkAbout20201964.tiff• J 02--0 WELD COUNTY CODE ORDINANCE 2020-04 IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION, CHAPTER 5 REVENUE AND FINANCE, CHAPTER 7 EMERGENCY MEDICAL SERVICES, AND CHAPTER 26 REGIONAL URBANIZATION AREAS, OF THE WELD COUNTY CODE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld, including the codification of all previously adopted ordinances of a general and permanent nature enacted on or before said date of adoption, and WHEREAS, the Weld County Code is in need of revision and clarification with regard to procedures, terms, and requirements therein. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County of Weld, State of Colorado, that certain existing Chapters of the Weld County Code be, and hereby are, repealed and re-enacted, with amendments, and the various Chapters are revised to read, as follows: CHAPTER 2 ADMINISTRATION ARTICLE I - Board Procedures Amend Sec. 2-1-20. - Agenda items. A. Due to the requirements of the Colorado Open Meetings Act, the deadlines for listing items of business on an agenda are as follows: 12:00 p.m. on the previous Thursday for Monday's agenda, and 10:30 a.m. on Monday for Wednesday's agenda. In the event of a Monday holiday, the deadline for that week's Wednesday agenda is 12:00 p.m. on the previous Thursday. Amend Sec. 2-1-80. - Work sessions. A. and B. — No change. C. Work session/review process: Background documents must be submitted prior to the scheduled work session for inclusion into electronic work session packets to be viewed on PAGE 1 2020-1964 ORD2020-04 the Board's laptops. The following procedures shall be followed by department heads seeking work sessions: 1. Confirm Commissioner Coordinator or Chair Assistant Coordinator approval to schedule work session. 2. Complete work session form, which is available on the county intranet or through the SC C Office Manager for the Board of County Commissioners. 3. Scan work session form and all supporting documents, preferably as a PDF file. 4. Email scanned cover letter and documents to gOCC the Office Manager for the Board of County Commissioners. 5. Work session is scheduled. D. An elected officials' meeting will be held four (4) times, yearly. E. The Board of County Commissioners may hold a work session as the Weld County Housing Authority, as needed, in the same manner as regular work sessions of the Board. CHAPTER 5 REVENUE AND FINANCE ARTICLE VII — Permits and Fees Amend Sec. 5-7-10. - Permits, regulations and fees established. The following permits, fees and regulations are determined by the Board of County Commissioners: A. thru C. — No change. D. Appendix 5-B: RESERVED. Remainder of Section — No change. A. Emergency Medical Services contracting with, or employed by, groups or organizations for public events to provide emergency medical care in the County must have sufficient personnel, supplies and equipment to effect care on the First Responder or higher level PAGE 2 2020-1964 ORD2020-04 basis, and provide proof of compliance with the insurance requirements set forth in Section 7-3-60 of this Chapter. CHAPTER 26 REGIONAL URBANIZATION AREAS Amend Appendix 26-B - EXISTING AND PROPOSED SERVICE PROVIDERS - Proposed Service Providers in the Southeast Weld RUA - ATTACHED BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is, directed to arrange for Municode to supplement the Weld County Code with the amendments contained herein, to coincide with chapters, articles,.. divisions, sections, and subsections as they currently exist within said Code; and to resolve any inconsistencies regarding capitalization, grammar, and numbering or placement of chapters, articles, divisions, sections, and subsections in said Code. BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. The above and foregoing Ordinance Number 2020-04 was, on motion duly made and seconded, adopted by the following vote on the 27th day of July, A.D., 2020. PAGE 8 2020-1964 ORD2020-04 Mileage zones were created to introduce a flat rate and establish consistency in mileage rates from year to year. The mileage zone is based on the distance from the Weld County Sheriff's Office Law Administration Building to the Post Office based on Zip Code. The mileage fee will be charged based on the Zip Code of the mailing address of the Civil paperwork, and will only be charged once regardless of how many attempts are made or the miles actually driven. 27. Copies shall be at a rate not to exceed $30.00 per hour after the first hour, to recover the cost of the staff time required and CD costs incurred to copy the CD as determined by the department head. Staff time for applicants or constituents that propose novel uses or development that does not fit into established fee categories where staff will spend 4 or more hours of review, oversight or assistance. The hourly rate shall be calculated on a full cost recovery basis of the County's costs for the staff positions involved in the assistance. The full cost recovery rate shall be determined by the Director of Finance and Administration and shall include salary, fringe benefits, support costs (services and supplies) and indirect costs calculated in accordance with the County -wide cost allocation plan per Federal OMB -87 methodologies. Constituents shall deposit the estimated amount of the costs prior to assistance. The County will draw upon it based on the standard hourly rate for each staff providing the review, oversight or assistance. 33.
