HomeMy WebLinkAbout20201106.tiff RECEIVED APR 0 2 2020 WELD COUNTY EAST LARIMER COUNTY WATER DISTRICT COMMISSIONERS RESOLUTION NO. 2020-03-01 CONTINUING DECLARATION OF LOCAL DISASTER EMERGENCY At a meeting of the Board of Directors of the East Larimer County Water District (the"Board"),held on March 20,2020,which meeting was duly and properly called and at which a quorum was present, the following preambles and resolutions were made and adopted by affirmative vote of all the Directors present,as follows: WHEREAS, Loren Maxey, President/Chairman, as the principal executive officer of the East Larimer County Water District(the"District"),by Declaration of Local Disaster Emergency dated March 20, 2020, declared a local disaster within the District due to the occurrence or imminent threat of widespread or severe damage, injury or loss of life or property,resulting from the following condition or situation: coronavirus COVID-19 outbreak(the"Declaration"); WHEREAS,the purpose ofthe Declaration is to activate the response and recovery aspects of any and all applicable local and interjurisdictional disaster emergency plans,emergency funding and Board meeting procedures, and to authorize the furnishing of aid and assistance under such plans; WHEREAS, the Declaration provides that during the validity of the Declaration, the District Manager may: 1. Prioritize the District's resources and efforts to continue providing a safe water supply to the residents, businesses, visitors and fire departments of the District, while ensuring employee safety and timely compensation. 2. Discontinue any or all non-essential services. 3. Suspend activities associated with extension of services to new development that is not currently inhabited. 4. Temporarily reassign District personnel to positions and responsibilities outside of their job descriptions and normal duties. 5. Deny,or revoke previously approved, leave requests. 6. Place on leave any employee reasonably believed to have been exposed to or exhibiting symptoms consistent with infection from the COVID-19 virus and require testing prior to their returning to work. Require reasonable documentation for extended sick leave requests, including COVID-19 testing, if appropriate. 7. Implement policies and practices for employee and public contact to minimize person to person contact and decrease the risk of transmission of the COVID-19 virus. 8. Apply for any available local,state or federal assistance,although no multiple fiscal year obligation may be entered into without Board approval. In consultation with the Board Chair or Vice-Chair and District legal counsel, arrange for meetings of the Board to be held via telephone, video conference or other electronic means, in a manner which, as fully as possible given the emergency situation, complies with the Colorado Open Meetings Law. 10. Suspend or modify the provisions of any District Resolution, Rule, Regulation or Policy, if strict compliance with the same would in any way prevent, hinder or delay necessary action to ensure the reliability and safety of the public water supply,the employees of the District and the public. 11. Take such other actions as reasonably necessary to carry out this declaration and ensure the reliability and safety of the public water supply,the employees of the District and the public. WHEREAS,acting pursuant to the provisions of Sections 24-33.5-709,32-1-1001 and 32- 1-1006, Colorado Revised Statutes, and any other applicable legal authority, the Board may consent to, continue and renew the Declaration for a period in excess of seven days, as it deems proper. NOW, THEREFORE, be it resolved by the Board as follows: The Declaration, with the consent of the Board, is continued and renewed until terminated by the Board.
