Home My WebLink About730541.tiff "x/, effo • RESOLUTION WHEREAS, a public hearing was held on June 25, 1973, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of David Bailey, 1423 Bowman Place, Northglenn, Colorado, requesting approval of site for a dog kennel operation on the following described property, to-wit: The Southeast Quarter of the Southeast Quarter (SE4SE4) of Section Fifteen (15), Township Three (3) North, Range Sixty-six (66) West of the 6th P. M. , Weld County, Colorado, and, WHEREAS, the petitioner was present and_ represented- _ _ , by counsel, Mr. Walker Miller, of Greeley, Colorado, and WHEREAS, there was no opposition to the request of petitioner for the location of a dog kennel operation, and WHEREAS, the said requested location for a dog kennel operation is located in an agricultural zone as set forth by the \Weld County Zoning � Resolution, and WHEREAS, according to Section 3. 3(3) of the Zoning Resolution of Weld County, said dog kennel operation may be authorized on the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of David Bailey, 1423 Bowman Place, Northglenn, Colorado, to locate a dog kennel operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That said dog kennel operation shall not contain more than 30 dogs at any one time. 3. That petitioner shall construct and occupy a residence dwelling on subject property and that same shall be occupied by petitioner prior to construction of said dog kennel facilities. 4. That all applicable subdivision and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Patterson stated that all he wanted to do was to move his present operation up on the hill . Wants to build 2 buildings , but only put up one of them now. Wants to move it 200 or 300 feet from its present location . Has about 50 hogs at the most . At the time of the field check, there were some pens up immediately adjacent to the road . No previous special use permit on this operation . There will be quite a bit of change in elevation at the new proposed location . Mr. Lorenson stated that the special use permit isn' t where Mr . Patterson described it on the map , therefore , the legal ' apparently is wrong . No plans for a holding pond . Mr. �� Lorenson stated that the recommendations were based on the location that is on the map and both on the basis of the Soil Conservation Service information and the Health Department . Need to recheck area and resubmit the legal to the County Attorney . Need a generalized lagoon location . MOTION : By Mr . Weigand to table this in view of the circumstances of the legal description and the recommendations to be verified and brought up at the next meeting . Second by Mr . Watson . A vote of "Aye" by Mr . Will be building on the west side of the ditch . Mr . Lorenson stated that the staff recommended approval because it agrees with the land use policy; it is compatible with surrounding land use and zoning ; the Health Department recommends approval ; and the design is judged adequate by the Extension Office . The approval should be subject to : 1 ) Pen location in Southeast corner to be located no nearer than 660 ' from the residence located on County Road #78 ; (2 ) Minimum set back of 50 ' from right of way on County Road #45 ; and (3 ) Construction to begin within one years time from date of approval . Operation limited to revised plans to be submitted . Walker Miller , Attorney DISCUSSION : Mr . Bailey had previously been granted a Special Use Permit for the same purpose on ground near this ground . How- ever , due to some difficulty with the seller , Mr . Bailey purchased different ground . Limited to 30 dogs . Mr . Lorenson stated that the Planning staff recommended approval because it agrees with land use policy; it complies with surrounding land use and zoning ; the Health Department recommends approval ; the soil report anticipates no pollution; and water is available . If approved , it should be subject to : 1 ) Con- struction beginning within one years time from date of approval ; 2 ) A maximum of 30 dogs ; 3 ) SUP #160 granting a dog kennel on the NZ NE4 SE4 Sec 15 T3 R66 being revoked ; and 4) The petitioner shall construct a residence dwelling on the subject property , and the same shall be occupied by the petitioner before the construction of said dog kennel . Lorenson stated that the Planning staff would recommend it for approval because it agrees with the land use policy; it complies with surrounding land use and zoning ; and the Health Department recommends approval . If it is approved , it should be subject to : 1 ) Pollution ponds being five feet deep ; and 2 ) Con- struction beginning within one years ' time from date of ap- proval and limited to the pen size and other items shown on the submitted plans . Schneider stated that basically all they wanted was to move and enlarge the existing area . There would be approximately 260 cows . Need to put in settling pond with pollution pond . Planning staff recommends approval because it agrees with the land use policy; it is compatible with surrounding land use and zoning ; is shown as Agriculture on the Greeley land use plan ; and the Extension Office indicates design is satisfactory. If approved , it should be subject to j 1 ) Having only 350 head at any one time as stated in the water contract; 2 ) Health Department requirements ; and 3 ) Construction beginning within one years ' time from date of approval and limited to the plans submitted . Callison is submitting the final plat at this time on his subdivision . It consists of three (3 ) single family dwelling sites of 12 . 6 acres each . Access to each lot will be from the county road . Preliminary plat submitted in December 1972 . There well permits for each of the three lots . 888 r- Planning sta', : recommends approval becau-2 the final plat is in compliance with approved preliminary plat and meets all final plat requirements . Mr . Lorenson also stated that there was no Improvement Agreement needed because no public roads were being constructed and monuments (survey) have already been installed . Showing 30 ' of right of way on the existing county road and not expanding it to 50 ' . This is going along. with the proposed thoroughfare plan that if there is no reason to expand a county road adjacent to one of these sub- divisions , then we should no longer require the additional 20 ' . It ' s the staff ' s recommendation that we stick to the o proposed thoroughfare plan which would not call this county road an arterial . VonFeldt DISCUSSION : Want to expand existing dairy operation to approximately double the herd presently run . Mr . VonFeldt stated that he had not been notified about clarification of drainage for the calf pens . The Planning staff recommends this for approval because 'it agrees with the Land Use Policy ;. it complies with surrounding land use and zoning ; and the Health Department recommends approval . If approved , it should be subject to : 1 ) Clarification of drainage from calf pens (The direction of drainage is good except from the calf pens . The Extension was concerned about the drainage running towards the house . ) Mr . VonFeldt added that they could fill the calf, pens to go to the back . The last subject to would be construction be- ginning within one years ' time from date of approval and limited to the plans submitted . George Evans , with America ' s Best Campgrounds out of Denver 889 i DISCUSSION : Mark studies indicate that thi Jeed factor for a campground a -chis location is quite hiyn . A study shows that some 1705 recreational vehicles a day pass this location a day during the tourist season . They have a curb cut off the service road instead of Highway 7 to eliminate any possibility of congestion as a result of the expansion of Highway 7 . There will be no permanent facilities for mobile homes . Have the well permit for the campground . The roads will not be black topped . They are planning to use peneprine surfaced streets . (This was not mentioned in the application . ) The State had no objections to this . Mr . Paul (Weld Co . Health Dept . ) asked if they had a chemical analysis of the water . The Planning staff recommends this for approval because it agrees with the Land Use Policy in providing services to the traveling public ; and it is compatible with uses and zoning on south ( KOA Campground ) and west . If approved , should be subject to : The Health Department ' s request for a chemical analysis of the well . 1 ) Putting the P . U . D . in final form considering the following changes : a ) Access on west service road with no access shown on State Highway 7 ; b) Lable drainage retention pond and show on P . U . D . ; c ) Change store location to west entrance as shown on drainage plans ; d ) Change water and sewer plan to show service to new store location ; e ) Change electrical system plan to reflect the above entrance change , etc . ; and 2 ) Changing the utility plan as requested by the Utility Board as follows : "Showing • of easements for utilities , natural gas plus power of 20 ' , and label as such and show lines of 6" with hydrant facilities with a licensed operator in accordance with the size of the facility . " (Health Department stated that they would not approve it unless they had a licensed operator and also a contractor to maintain them . ) (Mr . Evans submitted a con- tract with Charles Tregay , City of Boulder Sewage Plant for this . ) "Also subject to the drainage retention pond, which has now been added to the drainage plans . The Brighton Fire Department indicated that they prefer 6" lines and hydrants . They also indicated the exact type of hydrants that they would request for fire protection . " RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the recommendations of the Planning staff, verification of the supply of water and the submittal of a chemical analysis,of the water to the Health Department . DISCUSSION : The Assistant County Attorney said this permit could be issued on the contingency of the necessary well information . SUBJECT : Field Checks by Specific Board Members DISCUSSION : It was felt that a better understanding of the cases could be had if the Board members could field check those concerned in their areas . If a regular Board member could not make the field check for various reasons , the alternate could make it from the floor . 890 SUBJECT : Fees fi, Special Use Permits DISCUSSION : It ld'as proposed to place a $50 . r,- ) fee on all Special Use Permits in order to cover the cost of advertising the legal description . If the Planning Office goes ahead and pays for the advertising out of a set fee , then the Office would be able to iniate the advertisement and the Planning Commission could hear it one week and the County Commissioners could hear it the next week , thus speeding up the process procedure quite a bit . SUBJECT : Tom Clark - Zone Change (Washington Mines ) DISCUSSION : Mr . Clark had. a zone change from A to C that was on a conditional basis for 12 months . The 12 months have gone by and the fences are still not available . Therefore , does the Commission want to take any action against the installation or recommend to the Board of County Commissioners any action concerning the installation of the fence around the site . There are transformers on a couple of acres , but no fence . This is located in the SWa Section 23 , Township 1 North , Range 68 West . MOTION : By Mr . Weigand to iniate a Resolution to the Board of County Commissioners to issue a "Show Cause" order to Mr . Clark . Second by Mr . Rothe . A vote of "Aye" by Mr . Anderson . Watson , Weigand , Rothe and Elliott. Motion carried . SUBJECT: Mr . Booth & Mr . Asmus - Feedlot . DISCUSSION : Bob Adams , Zoning Inspector , has been out to the site and two application forms have been delivered to them. The last application was given to their attorney , Stow Witwer , but still have had no compliance from them. Also , Mr. Asmus ' feedlot is expanding without a permit . We have hand delivered Special Use Permit application form to them , but have heard nothing further . MOTION : By Mr . Watson to initiate a Resolution to the Board of County Commissioners for an injunction against Booth Feedlot and Asmus Feedlot . Second by Mr . Rothe .
