HomeMy WebLinkAbout20200342.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING USE BY SPECIAL REVIEW PERMIT, USR18-0086, FOR A HOME BUSINESS (PARKING OF VEHICLES ASSOCIATED WITH A LANDSCAPING/SNOW REMOVAL BUSINESS ALONG WITH AN OFFICE FOR PAPERWORK) ALONG WITH ACCESSORY BUILDINGS WITH GROSS FLOOR AREA LARGER THAN FOUR PERCENT (4%) OF THE TOTAL LOT AREA PER BUILDING ON LOTS IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT - JOSE CARBAJAL CASTILLO AND CAROLINA SALINAS CORONA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 26th day of December, 2018, at the hour of 10:00 a.m., in the Chambers of the Board for the purpose of hearing the application of Jose Carbajal Castillo and Carolina Salinas Corona, 15600 Casler Avenue, Fort Lupton, Colorado 80601, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0086, for a Home Business (parking of vehicles associated with a landscaping/snow removal business along with an office for paperwork) in the A (Agricultural) Zone District on the following described real estate, to-wit: Lot 4, Block 46 of Aristocrat Ranchettes 2nd Filing; being part of the SE4 Section 26, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing, the Board heard all of the testimony and statements of those present and reviewed the request of the applicant and, having been fully informed, found that this request be referred back to the Department of Planning Services to further address violation, ZCV18-00141, with stipulations regarding the home business operations, and WHEREAS, a hearing before the Board was held on the 31st day of July, 2019, at which time the Board heard all of the testimony and statements of those present and reviewed the request of the applicant and, having been fully informed, deemed it advisable to continue said matter until January 29, 2020, to allow Jose Carbajal Castillo and Carolina Salinas Corona, adequate time to complete construction of their home that will be used for a home business, and WHEREAS, on January 29, 2020, the Board heard all the testimony and statements of those present and reviewed the request of the applicant and, having been fully informed, finds that this request be referred back to the Department of Planning Services with instruction to forward the active Zoning Violation, ZCV18-00141, to the County Attorney's Office for immediate legal action. cc.'pLCCcc/TP), PWCE,P), CBF), cacec), GtPPL 2020-0342 o3 /OCa /o10 PL2619 RE: REFER TO PLANNING (USR18-0086) -JOSE CARBAJAL CASTILLO AND CAROLINA SALINAS CORONA PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the abovementioned matter be, and hereby is, referred back to the Department of Planning Services, with instruction to forward the matter to the County Attorney's Office for immediate legal action. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 29th day of January, A.D., 2020.
