HomeMy WebLinkAbout20200154.tiff RESOLUTION RE: ACTION OF BOARD AT SHOW CAUSE HEARING, PCSC19-0020, CONCERNING USE BY SPECIAL REVIEW PERMIT, USR-988, FOR A HOME BUSINESS (RECREATIONAL VEHICLE STORAGE AND DAYCARE FACILITY) IN THE A (AGRICULTURAL) ZONE DISTRICT - COUNTY RV STORAGE, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on January 20, 2020, a Show Cause Hearing was conducted to consider revocation of Use by Special Review Permit, USR-988, for a Home Business (recreational vehicle storage and daycare facility) in the A (Agricultural) Zone District, issued to County RV Storage, LLC, 3230 47th Avenue, Greeley, Colorado 80634, and WHEREAS, County RV Storage, LLC, is the current owner of the facility located on property being further described as follows: Part of the SW1/4 of Section 23, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board heard all of the testimony and statements of those present and reviewed the request of the applicant and, having been fully informed, finds that this request be dismissed. M . , Weld County, CO TOTAL ACREAGE : +/- 2 . 28 acres LOCATION : East of and adjacent to 47th Avenue ; Approximately 660 feet south of 31st Street BACKGROUND : Zoning : A (Agricultural) USR- 988 The Site Specific Development Plan and Special Review for a home business (recreational vehicle storage and daycare facility) in the A (Agricultural ) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein . This case was conditionally approved by the Board of County Commissioners on December 16 , 1992 . The timeline will appropriately explain the events since July 8 , 2019 leading up until the Show Cause Hearing for USR- 988 followed by the history of the violation of USR-988 and recommendation by Planning Staff on how to proceed . TIMELINE : July 8, 2019 A Commercial Building Permit Application ( CMA19-0058) was submitted on July 8 , 2019 to the Weld County Building Department for a 6 , 912 square foot Pole Frame addition to an existing commercial building built in 1980 . The applicant had concerns with the building fees related to the Commercial Building Permit. According PCSC19-0020 Memo I County RV Storage LLC Page 1 & OaOo5L1 to the applicant, it was for "dry storage" only and is not associated with a commercial use or the existing USR- 988. Weld County Department of Planning and Building Inspection required a signed letter by the property owners stating the intended use of the proposed structure. July 11, 2019 A signed letter of intent from the home owners, Erik and Shawna Disparti was submitted July 11, 2019 stating: "The 72' x 96' proposed building at 3230 47'" Ave, Greeley CO will be used for dry storage. We do not intend to store RV's, trailers, automobiles, or other recreational vehicles within the walls of the 72'x 96' building." October 9, 2019 An updated schematic map of the property and USR-988 was submitted to the Weld County Planning Department showing the location of the proposed 6,912 square foot structure. October 17, 2019 After review and approval of the signed letter of intent by the property owners and submittal of the updated schematic USR-988 Map, Weld County Department of Building Inspection created a new Accessory Structure Alteration Building Permit (ASA19-0071) which replaced the pending Commercial Building Permit (CMA19- 0058). CMA19-0058 was then voided. October 18, 2019 Weld County Department of Building Inspection further questioned if there would be electric service in the new 6,912 square foot building. Mr. Disparti further stated " No this is just dry storage" in an email dated October 18, 2019. ASA19-0071 was approved and released for the 6,912 square foot personal building without electrical power. October 22, 2019 Building inspections took place and the following inspection types were reviewed based on criteria for a Utility Pole Barn with no electric service: Setbacks, Final Building, Footing/Caisson, Rough Framing, and Final Approval. All inspection types passed and were approved by Building Inspection. November 6, 2019 Weld County Planning Department — Zoning Compliance received an anonymous complaint that detailed a commercial recreational facility in operation on the property which was further substantiated by a November 2, 2019 Greeley Tribune article, an active Facebook page @TheYard2020; and, website www.gotheyard.com; all sources advertising the commercial recreational facility. November 12, 2019 Probable Cause letter dated November 8, 2019 was sent to the property owner via certified mail. November 13, 2019 Weld County Planning Staff performed a field check on November 13, 2019. A freestanding sign is on site advertising The Yard along with the County RV Storage Facility. There were further on-site directional signs detailing The Yard was located in the back of the property. The subject property has two access points onto 47'" Avenue in the shape of a horseshoe and appear both access points are used for the site. November 25, 2019 Probable Cause Hearing Outcome: Schedule a Show Cause Hearing on January 20, 2019 at 9:00 a.m. PCSC19-0020 Memo I County RV Storage LLC Page 2 December 11, 2019 Following the Probable Cause Hearing, the property owners, Erik and Shawna Disparti, met with the City of Evans on December 11, 2019 to discuss annexation. December 23, 2019 Erik and Shawna Disparti met with the City of Evans again to further discuss annexation. The property owners were supplied a framework that explained the City of Evans process, expected timeline, and costs if they choose to proceed with the City of Evans. December 30, 2019 The Disparti's met with Weld County Planning Department on December 30, 2019 to discuss how to proceed with the County. The options given to the Disparti's were either going through the Amended USR process, obtaining the proper building permits, and other related permits or bringing the subject pole barn up to compliance as a personal storage/garage and obtaining the proper building permits. December 31, 2019 An email sent to Weld County Planning Department dated December 31, 2019 from Erik and Shawn Disparti stated they could not come to an agreement with the City of Evans and as of December 31, 2019 everything related to the baseball facility has been removed or taken down from the Internet. This includes the signage outside of the property, the Facebook page @TheYard2020; and the website www.gotheyard.com. They have decided to not pursue the baseball facility. An Accessory Structure Alteration Building Permit, ASA19-0111, was submitted to properly permit the heat and electricity in the subject pole barn. January 6, 2020 The Disparti's met with Weld County Planning Department again after deciding to not proceed with the Amended USR and instead proceed with bringing the subject pole barn up to compliance as a personal storage/garage and obtaining the proper building permits and to discuss the Show Cause Hearing process. Accessory Structure Alteration Building Permit, ASA19-0111, for utilities was issued and paid for. Inspections were scheduled for January 9, 2020. January 9, 2020 Inspections took place by Building Inspection and it was determined by the inspection report that there were outstanding items that need to be completed prior to approval of ASA19-0111. January 20, 2020 Show Cause Hearing VIOLATION: The Facility is in violation of Development Standards No. 1, 18, 20 and 21 which state: 1. The Site Specific Development Plan and Special Review Permit for a home business (recreational vehicle storage and daycare facility) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. The property owner or operator shall be responsible for complying with the operational Standards of Section 24.6 of the Weld County Zoning Ordinance. 20. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 21. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. The Board of County Commissioners will take specific action regarding the status of the USR, such as the following: 1. Dismissal of the Show Cause 2. Continuation of the hearing to a later hearing date 3. Suspension of the USR 4. Fine(s) 5. Revocation of the USR 6. Injunctive Action Based upon the information provided to the Planning Staff following the Probable Cause Hearing, Planning Staff recommends that the Board of County Commissioners dismiss the Show Cause. Weld County Planning Department — Zoning Compliance received an anonymous complaint 01/09/2020: Inspections took place and it was determined by the inspection report that there were outstanding items that need to be completed prior to approval of ASA19-0111 . 01/20/2020 : Show Cause Hearing Development Standard # 1 The Site Specific Development Plan and Special Review Permit for a home business ( recreational vehicle storage and daycare facility ) in the A (Agricultural ) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein . Development Standard # 18 The property owner or operator shall be responsible for complying with the operational Standards of Section 24 . 6 of the Weld County Zoning Ordinance . Based on that meeting and the meetings we have had with the City of Evans, we have made the decision to stay in Weld County and continue operating our RV storage business under our current USR-988. The new building we had built permit number ASA19- 0071 was built as dry storage and we would like to continue to use that building as our personal garage . We were in violation of our USR-988 for trying to use the new building as an indoor baseball/softball facility called The Yard. We have removed all signs in front of the property for The Yard, the website gotheyard .com will be taken down on December 31st permanently (previously taken down on November 25th, following notification of the violation, then put back up to let people know we were going through a re-permitting process), the Facebook Page has been removed on December 31st, the sign on the building has been removed on December 31st as well. The building has heat and electricity that was not originally permitted. Following our meeting with Michael on December 30th, we obtained the proper applications to permit the heating and electric and we plan to submit the completed applications by Thursday January 2nd . On October 18th 2019 we paid the following fees: Building permit fee $ 1932.25 Major building plan review fee $1255.96 Stormwater Drainage fee non-dwelling structure $1046.20 Total $4234.41 We will pay the fees to have the heat and electric permitted properly. We would like to ensure that the building will be properly permitted, upon completion of the heat and electrical permit, for our new intended use of the building as our personal garage/personal storage space. The following list identifies discussion points that were discussed during our meeting this morning. Please review and let me know if I've missed an important topic. • Disparti family lives on site and there is a secondary/accessory dwelling on site • Up to 50 RVs are allowed to be parked on site through an existing Weld County USR. Business name is County RV Storage. o No living in units stored o No dumping o Open dawn to dusk • Building permit process and ability to avoid the need for a restroom will be investigated by the City of Evans. • A building permit has been applied for through Weld County (pole barn). It is not clear if a Certificate of Occupancy has been issued. • Future work on 47th was discussed O 0. 129 acres will be needed o Eric indicated there may be a buried irrigation pipe about 10" under the surface that Evans should be aware of o The City would like the property to have one access. The southern access is a shared access with the folks to the south. This is the access to remain. • Water service is from Greeley. The City of Greeley has approached the City of Evans to take over this line. • Sanitary Sewer service is by septic system. Good Morning, Erik and I had a chance to meet with the planner Michael Hall yesterday to ask a few questions . Based on that meeting and the meetings we have had with the City of Evans , we have made the decision to stay in Weld County and continue o perating our RV storage business under our current USR - 988 . The new building we had built permit number ASA19 - 0071 was built as dry storage and we would like to continue to use that building as our personal garage . We were in violation of our USR - 988 for trying to use the new building as an indoor baseball/softball facility called The Yard . We have removed all signs in front of the property for The Yard , the website gotheyard . com will be taken down o n December 31st permanently ( previously taken down on November 25th , following notification of the violation , then put back up to let people know we were going through a re - permitting process ) , the Facebook Page has been removed o n December 31st, the sign on the building has been removed on December 31st as well . The building has heat and e lectricity that was not originally permitted . Following our meeting with Michael on December 30th , we obtained the roper applications to permit the heating and electric and we plan to submit the completed applications by Thursday inuary 2nd . On October 18th 2019 we paid the following fees : 1 Building permit fee $1932.25 Major building plan review fee $1255.96 ctormwater Drainage fee non-dwelling structure $1046.20 i otal $4234.41 We will pay the fees to have the heat and electric permitted properly. We would like to ensure that the building will be properly permitted, upon completion of the heat and electrical permit, for our new intended use of the building as our personal garage/personal storage space. Please let us know if there are other permits we need to obtain or further steps we need to take to ensure this building is in compliance and that we are no longer in violation of our current USR.
