A public hearing was conducted on January 15, 2020, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated November 22, 2019, and duly published
November 27, 2019, in the Greeley Tribune, a public hearing was conducted to consider the
request of Cervi Enterprises, Inc., c/o Kerr-McGee Gathering, LLC, for a Site Specific
Development Plan and Use by Special Review Permit, USR19-0064, for an Oil and Gas Support
and Service Facility (five (5) gas compressors and two (2) electric compressors associated with
gas processing or which compress gas to enter a pipeline for transport to market) and one (1)
thirty-four (34) foot in height communications tower and up to six (6) temporary office trailers and
up to six (6) conex containers for temporary storage during construction and a permanent
Laydown and Storage Yard in the A (Agricultural) Zone District. Bob Choate, Assistant County
Attorney, made this a matter of record.
I Chair Freeman reviewed for the applicant and the public, the procedures to follow should
this case result in a tie vote due to four (4) Commissioners being present and
Commissioner Conway being excused.

Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and
indicated no correspondence was received regarding the application. He stated the proposed
facility compliments existing facilities, noted the applicant is proposing a laydown yard, and
explained there will be one (1) to two (2) dishes on the proposed communications tower. He
explained compressors will run 24/7, the facility will be fenced, the interior of the fence will be
graveled and graded, and the exterior will be revegetated with native grasses. He stated ten (10)
referrals were sent out and two (2) agencies responded, and entered the favorable
recommendation of the Planning Commission into the record as written. He displayed images of
the site and surrounding views and in response to Commissioner Kirkmeyer, Mr. Ogle clarified
the location of the proposed facility and Mr. Choate stated he would review the legal description
to ensure it was correct.

Zachery Roberson, Department of Public Works, provided a brief overview of the
transportation plans and requirements and stated access to the site is off a gated, private road,
which is accessed from U.S. Highway 34. He indicated there are no traffic counts on private roads,
and presented the drainage and grading requirements.
Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer
provisions and stated there will be no permanent employees onsite after construction is complete.
He indicated bottled water and portable toilets are required during and after construction and
Development Standards (DS) #18-33 address Environmental Health items.
Aileen Yeung, Occidental Petroleum Corporation, represented the applicant, and stated the
proposed facility will transport gas from wells in the area to an existing processing plant. She
explained the site selection process, indicated the station design is similar to previously built
facilities and will have comparable mitigation measures. She described mitigation for noise and
lights, and explained the communications tower enables the applicant to monitor and shut down
the facility remotely, if necessary. She provided a PowerPoint presentation (Exhibit D), displayed
images of the site and surrounding views, and in response to Commissioner James, Ms. Yeung
stated she was unsure if a noise study was submitted.
No public testimony was offered concerning this matter.

There was discussion about the appropriate noise standard and Commissioner Kirkmeyer
suggested the Board delete the noise standard requirement, as the facility is in the A (Agricultural)
Zone District.
In response to Commissioner Kirkmeyer, Ms. Yeung indicated fencing will be the same as
what they have used at previous facilities. Robert Last, Occidental Petroleum Corporation, further
described the proposed fencing, which will be around the perimeter of the facility and explained
there will be 25-35 trucks accessing the site during construction. In response to Chair Freeman
and Commissioner Kirkmeyer, Mr. Last confirmed there is only one (1) access into the site, there
will not be flaring, there is an agreement with the Colorado Department of Transportation (CDOT)

to access the site off of U.S. Highway 34, and explained the details of the Decommissioning Plan.
Commissioner Kirkmeyer suggested adding a new Condition of Approval (COA) #1.D (Lighting
Plan with the Dark Sky Policy) and Commissioner Moreno suggested correcting "County Road
34" to "County Road 38" in COA#1.E.5 (unmaintained section line right-of-way).
Commissioner Kirkmeyer suggested a new DS #7 (Lighting Plan) and deleting DS #28 (maximum
permissible noise level). The Board agreed to all of the aforementioned changes.
In response to Chair Freeman, Ms. Yeung, on behalf of the applicant, indicated she had
reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as
amended.
Steve Teets, Greeley resident, questioned the noise standard being deleted and
Chair Freeman explained the commercial noise standard.
In response to Commissioner Kirkmeyer, Mr. Choate confirmed the legal description for the
application is correct.
Commissioner Kirkmeyer moved to approve the request of Cervi Enterprises, Inc., c/o
Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special Review
Permit, USR19-0064, for an Oil and Gas Support and Service Facility (five (5) gas compressors
and two (2) electric compressors associated with gas processing or which compress gas to enter
a pipeline for transport to market) and one (1) thirty-four (34) foot in height communications tower
and up to six (6) temporary office trailers and up to six (6) conex containers for temporary storage
during construction and a permanent Laydown and Storage Yard in the A (Agricultural) Zone
District, based on the recommendations of Planning staff and the Planning Commission, with the
Conditions of Approval and Development Standards, as amended. The motion was seconded by
Commissioner Moreno, and it carried unanimously. There being no further discussion, the hearing
was completed at 10:31 a.m.
