A public hearing was conducted on January 8, 2020, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated November 15, 2020, and duly published
November 20, 2020, in the Greeley Tribune, a public hearing was conducted to consider the
request of Salt Ranch, LLC, c/o Outrigger DJ Operating, LLC, for a Site Specific Development
Plan and Use by Special Review Permit, USR19-0062, for an Oil and Gas Support and Service
Facility (four (4) gas compressors and related equipment), one (1) up to seventy (70) feet in height
secure communications tower, and up to four (4) construction office trailers and four (4) conex
located within a fenced laydown yard for use during the construction of the facility in the
A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of
record.
El' Chair Freeman reviewed for the applicant and the public, the procedures to follow should this
case result in a tie vote due to four (4) Commissioners being present and Commissioner Conway
excused.
E Kim Ogle, Department of Planning Services, presented a brief summary of the proposal,
described the surrounding businesses and nearby residences, and stated no correspondence
had been received regarding the application. He mentioned the surrounding uses, and stated the
project compliments previously approved Outrigger DJ Operating, LLC, projects. He indicated the
site will be fully fenced, the interior will be graveled and graded, and the disturbed areas on the

exterior will be revegetated with native grasses. He stated 11 referrals were sent out and two (2)
responded, entered the favorable recommendation of the Planning Commission into the record
as written, and displayed images of the site and surrounding views.
Mike McRoberts, Department of Public Works (PW), provided a brief overview of the
transportation plans and requirements, stated access is on County Road (CR) 57, indicated there
were no traffic counts available for the area, and provided the daily roundtrips. He explained PW
is requiring tracking control and a Road Maintenance Agreement during construction and
presented the drainage and grading requirements. In response to Commissioner Kirkmeyer,
Mr. McRoberts confirmed the applicant will not cross other properties to access the site and they
will own their access.
Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer
provisions and stated the site will be unmanned after construction is complete. He indicated
bottled water and portable toilets are acceptable during construction, small amounts of fuel will
be stored onsite, and Development Standards (DS) #18-33 address Environmental Health (EH)
items.
Andrew Perdue, applicant representative, explained the operation of the proposed facility,
stated it can be shut down remotely, and indicated they had completed a Noise Impact Study.
No public testimony was offered concerning this matter.
ka; In response to Mr. Perdue, the Board agreed to change the height of the proposed tower, in
the application request, from 60 feet to 70 feet. In response to Commissioner James, Mr. Ogle
stated the aforementioned change would not pose a problem for the Federal Aviation
Administration (FAA), and in response to Commissioner Kirkmeyer, Mr. Perdue confirmed they
lease the parcel of land. Commissioner Kirkmeyer suggested adding a new
Condition of Approval (COA) #1.E (Lighting Plan), changing the tower height in DS #1 (application
request) and #7 (height of communications tower) from 60 to 70 feet, adding a new DS #9
(Lighting Plan with the Dark Sky Policy), deleting "from existing adjacent residential properties"
from DS #23 (screening of portable toilets), and deleting DS #28 (permissible noise level). The
Board agreed to all of the aforementioned changes.
In response to Chair Freeman, Mr. Perdue indicated he had reviewed, and agreed to abide
by, the Conditions of Approval and Development Standards, as amended.
No public testimony was offered with regard to the changes made to the Conditions of
Approval and Development Standards.
Commissioner Kirkmeyer moved to approve the request of Salt Ranch, LLC, c/o Outrigger
DJ Operating, LLC, for a Site Specific Development Plan and Use by Special Review Permit,
USR19-0062, for an Oil and Gas Support and Service Facility (four (4) gas compressors and
related equipment), one (1) up to seventy (70) feet in height secure communications tower, and
up to four (4) construction office trailers and four (4) conex located within a fenced laydown yard

for use during the construction of the facility in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of Approval
and Development Standards, as amended. The motion was seconded by Commissioner Moreno,
and it carried unanimously. There being no further discussion, the hearing was completed at
10:17 a.m.
This Certification was approved on the 13th day of January, 2020.
