HomeMy WebLinkAbout20202297.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, JULY 27, 2020 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, July 27, 2020, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Mike Freeman, Chair Commissioner Steve Moreno, Pro-Tem Commissioner Scott K. James Commissioner Barbara Kirkmeyer — EXCUSED Commissioner Kevin D. Ross Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Bri White Controller, Barbara Connolly • MINUTES: Commissioner Moreno moved to approve the minutes of the Board of County Commissioners meeting of July 22, 2020, as printed. Commissioner James seconded the motion, and it carried unanimously. • READ ORDINANCE BY AUDIO: Commissioner James moved to read Code Ordinance #2020-11 by audio. The motion was seconded by Commissioner Moreno, and it carried unanimously. El CERTIFICATION OF HEARINGS: Commissioner Ross moved to approve the Certification of Hearings conducted on July 22, 2020, 2020, as follows: 1) COZ20-0004 — Gerrard Investments, LLC, do Rock and Rail, LLC. Commissioner James seconded the motion, which carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. El CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Ross seconded the motion, and it carried unanimously. • PUBLIC INPUT: No public input was given. • PRESENTATIONS: 1) RECOGNITION OF SERVICES, BOARD OF ADJUSTMENT — JONATHAN KEY: Chair Freeman read the certificate for the record. 1O/O Minutes, Monday, July 27, 2020 Page 1 2020-2297 BC0016 • 2) RECOGNITION OF SERVICES, BOARD OF RETIREMENT - LEOPOLD KORINS: Chair Freeman read the certificate for the record. 1. 3) RECOGNITION OF SERVICES, PLANNING COMMISSION - DICK BECK, BRUCE JOHNSON, AND MICHAEL WAILES: Chair Freeman read the certificates for the record. The Commissioners, in turn, thanked those working on the various boards and commissions for providing their services. WARRANTS: 1) GENERAL WARRANTS - JULY 24, 2020: Commissioner Ross moved to approve the General Warrants, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. 1=. BIDS: 1) APPROVE BID #B2000142, DEPARTMENT OF PUBLIC WORKS PERIMETER FENCING - DEPARTMENT OF BUILDINGS AND GROUNDS: Rob Turf, Purchasing Department, stated staff recommends selecting the lowest bidder who met specifications, Mod Squad, Inc., for a total amount of $60,400.00. Commissioner Moreno moved to approve said bid, the motion was seconded by Commissioner James, and it carried unanimously. • 2) PRESENT BID #B2000151, SAND OIL TANK AND GREASE TRAP PUMPING SERVICE - DEPARTMENT OF BUILDINGS AND GROUNDS: Mr. Turf stated staff received three (3) bids and will make a recommendation on August 10, 2020. e NEW BUSINESS: 1) CONSIDER INTERGOVERNMENTAL AGREEMENT FOR CONDUCT OF COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM AND AUTHORIZE CHAIR TO SIGN — TOWN OF NEW RAYMER: Don Sandoval, Community Development Block Grant (CDBG) Manager, shared the requirements by the U.S. Department of Housing and Urban Development (HUD) and stated the Intergovernmental Agreements (IGA) allow the listed municipalities to be a participating jurisdiction. Mr. Sandoval explained this finalizes all 25 IGAs of the original project, he thanked the Town of New Raymer for their participation, and shared the next step is for HUD to review them. The motion to approve said intergovernmental agreement and authorize the Chair to sign was made by Commissioner Moreno, seconded by Commissioner James, and it carried unanimously. 2) CONSIDER WORK ORDER CONTRACT FOR WELD COUNTY FAIR SECURITY AND CONTROL SERVICES AND AUTHORIZE CHAIR TO SIGN - OROZCO SECURITY AGENCY, INC.: Bruce Barker, County Attorney, presented the security services contract for the Weld County Fair at Island Grove Regional Park. Commissioner Ross moved to approve said work order contract and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. el 3) CONSIDER AMENDED BYLAWS FOR BOARD OF ADJUSTMENT: Tom Parko, Director of the Department of Planning Services, stated staff's recommendation to update the bylaws to ensure appropriate functions for current business. Commissioner James moved to approve said revised Bylaws. Seconded by Commissioner Moreno, the motion carried unanimously. • 4) CONSIDER RATIFICATION OF AMENDED BYLAWS FOR PLANNING COMMISSION: Mr. Parko shared staff's recommendation to update the bylaws to ensure appropriate functions for current business. Commissioner Ross moved to approve said revised Bylaws. The motion, which was seconded by Commissioner James, carried unanimously. MICHAEL BURSON AS WELD COUNTY CORONER/MEDICAL EXAMINER: Chair Freeman shared his enthusiasm for Dr. Michael Burson's new role and Dr. Burson expressed his eagerness to expand his knowledge, sharing his employment history as a teacher and a forensic pathologist. In response to Commissioner James, Dr. Burson stated, as an aerospace physiologist, he mainly taught people how to breathe and maintain blood flow in high altitudes. Commissioners Ross and Moreno expressed staff's eagerness to work with Dr. Burson, as they have every confidence in his ability to improve the County. Commissioner James moved to approve said appointment. Commissioner Ross seconded the motion and it carried unanimously. • 6) CONSIDER APPOINTMENT TO BOARD OF RETIREMENT: The motion to approve said appointment was made by Commissioner James, seconded by Commissioner Moreno, and it carried unanimously. 7) CONSIDER REAPPOINTMENT TO COMMUNITY CORRECTIONS BOARD: Commissioner Moreno moved to approve said reappointment. The motion was seconded by Commissioner James and it carried unanimously. El 8) CONSIDER REAPPOINTMENT TO NOXIOUS WEED MANAGEMENT ADVISORY BOARD: Commissioner Moreno moved to approve said reappointment. Seconded by Commissioner James, the motion carried unanimously. • 9) CONSIDER APPOINTMENT AND REAPPOINTMENTS TO BOARD OF ADJUSTMENT: Commissioner James moved to approve said appointment and reappointments. Commissioner Moreno seconded the motion and it carried unanimously. Ei 10) CONSIDER REASSIGNMENT AND APPOINTMENTS TO PLANNING COMMISSION: Commissioner Ross moved to approve said reassignment and appointments. The motion was seconded by Commissioner James and it carried unanimously. Fri 11) CONSIDER TEMPORARY CLOSURE OF CR 47 BETWEEN CRS 40 AND 42: Amy Mutchie, Department of Public Works, detailed the closure will occur from August 3, 2020, to August 28, 2020, to re -deck Bridge 47/40A and noted water will be used for dust control along the detour route. Commissioner Moreno moved to approve said closure. The motion was seconded by Commissioner James and it carried unanimously. • 12) FIRST READING OF CODE ORDINANCE #2020-11, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING, OF THE WELD COUNTY CODE (ZPAG CHANGES): Jim Flesher, Department of Planning Services, presented the updated `farming' definition as a Use by Right in the A (Agricultural) Zone District and an Accessory Use in the E (Estate) Zone District. Mr. Flesher detailed the 'Agricultural Production' definition was also modified as an administratively approved Zoning Permit in the A (Agricultural) Zone District (ZPAG) or a Use By Special Review (USR) Permit, depending on the location of the property, all of which is allowed in the C-3 and Industrial Zone Districts. He further shared updates to the ZPAG process altered the mapping requirements for second single-family dwellings and clarified provisions for Zone Districts with more than nine (9) commercial vehicles. Mr. Flesher reviewed the Planning Commission's recommendation to modify specific agricultural language. No public input was provided. Commissioner James moved to approve Code Ordinance #2020-11 on First Reading, with the revisions as presented by staff. The motion, which was seconded by Commissioner Moreno, carried unanimously. Minutes, Monday, July 27, 2020 Page 3 2020-2297 BC0016 IR 13) FINAL READING OF CODE ORDINANCE #2020-04, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION, CHAPTER 5 REVENUE AND FINANCE, CHAPTER 7 EMERGENCY MEDICAL SERVICES, AND CHAPTER 26 REGIONAL URBANIZATION AREAS, OF THE WELD COUNTY CODE (MISCELLANEOUS CHANGES): Commissioner James moved to read Code Ordinance #2020-04 by title only. The motion was seconded by Commissioner Moreno, and it carried unanimously. Mr. Barker read the title for the record and Esther Gesick, Clerk to the Board, stated no changes were made after Second Reading. No public input was provided. The motion to approve Code Ordinance #2020-04 on Final Reading was made by Commissioner Ross, seconded by Commissioner Moreno, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2020-11 was approved on First Reading and Code Ordinance #2020-04 was approved on Final Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
