HomeMy WebLinkAbout20201989RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WEDNESDAY, JULY 8, 2020 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, July 8, 2020, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Mike Freeman, Chair Commissioner Steve Moreno, Pro -Tern Commissioner Scott K. James — EXCUSED Commissioner Barbara Kirkmeyer Commissioner Kevin D. Ross — EXCUSED Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Bri White Controller, Barbara Connolly MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County Commissioners meeting of July 6, 2020, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. PUBLIC INPUT: Steve Teets, Greeley resident, expressed interest in the Board's stance on the oil and gas energy production site located near Bella Romero Elementary School and Chair Freeman shared the Board sent a letter to Governor Polis explaining the Colorado Department of Public Health and Environment's (CDPHE) study. Commissioner Kirkmeyer further stated the study affirmed the oil and gas energy sites are required to be at least 500 feet from any structure to adhere to health concerns. Steve McClay, Fort Lupton resident, referenced the City of Thornton's Use by Special Review Permit, USR18- 0130, application to be considered by the Board on July 15, 2020, and expressed his discontentment with the Board's direction not to place the water pipeline in the right-of-way of County Road (CR) 17. Chair Freeman acknowledged the impact it poses to landowners to place the pipeline on an agricultural land easement, but stated conducting road maintenance, or expanding county roads, would prove difficult and costly if a pipeline is placed in the right-of-way. In response to Mr. McClay, Chair Freeman explained landowners affected by pipeline easements will be compensated, which Mr. McClay expressed compensation is not an adequate solution compared to the property value loss resulting from a pipeline easement. Commissioner Kirkmeyer stated the County does not currently have a policy or plan in place with the City of Thornton for the installation of a water pipeline in road right-of-way; thus, the 09[30 Minutes, Wednesday, July 8, 2020 Page 1 2020-1989 BC0016 Commissioners cannot discuss the specifics of USR18-0130 until the public hearing, which Commissioner Kirkmeyer invited Mr. McClay to attend, and suggested he communicate his concerns to the City of Thornton in the meantime. WARRANTS: 1) GENERAL WARRANTS - JULY 7, 2020: Commissioner Kirkmeyer moved to approve the General Warrants, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. BIDS: 1) APPROVE BID #B2000118, NORTH JAIL 2 WEST EXPANSION CABLING — DEPARTMENT OF INFORMATION TECHNOLOGY: Ryan Rose, Director of the Department of Information Technology, stated four (4) bids were received and staff recommends selecting the lowest bidder who met specifications, GigaSpan Solutions, for a total amount of $181,759.10. Commissioner Moreno moved to approve said bid, the motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. 2) APPROVE BID #B2000122, F5 REFRESH — DEPARTMENT OF INFORMATION TECHNOLOGY: Mr. Rose reviewed staff's recommendation to select One Technology Corporation, A Colorado Corporation, the low bidder meeting specifications out of three (3) bids received, for a total of $96,500.00. Commissioner Moreno moved to approve said bid, the motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. 3) PRESENT BID #B2000062, MANAGED FILE TRANSFER RFP — DEPARTMENT OF INFORMATION TECHNOLOGY: Mr. Rose stated two (2) bids were received and staff will make a recommendation on July 22, 2020. 4) PRESENT BID #B2000141, HEALTH DEPARTMENT BOILER REPLACEMENT - DEPARTMENT OF BUILDINGS AND GROUNDS: Rob Turf, Purchasing Department, presented the three (3) bids received and stated staff will make a recommendation on July 22, 2020. 5) PRESENT BID #B2000146, GRADER BLADES - DEPARTMENT OF PUBLIC WORKS: Mr. Turf stated staff received six (6) bids and will make a recommendation on July 22, 2020. NEW BUSINESS: 1) CONSIDER CONTRACT ID #3729 MEMORANDUM OF UNDERSTANDING FOR FAMILY MEDICAID ENROLLMENT SERVICES AND AUTHORIZE CHAIR TO SIGN - WELD COUNTY SCHOOL DISTRICT 6: Jamie Ulrich, Director of the Department of Human Services, shared the memorandum of understanding (MOU) will provide eligibility determination functions for public assistance programs at the Weld County School District 6 Family Center by employing a Medicaid Intake Specialist. Commissioner Moreno moved to approve said memorandum of understanding and authorize the Chair to sign. The motion was seconded by Commissioner Kirkmeyer and it carried unanimously. 2) CONSIDER CONTRACT ID #3749 MEMORANDUM OF UNDERSTANDING FOR WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA) SERVICE DELIVERY AGREEMENTS AND AUTHORIZE CHAIR TO SIGN — IMMIGRANT AND REFUGEE CENTER OF NORTHERN COLORADO: Ms. Ulrich stated the MOU reestablished roles and responsibilities for implementation of the provisions of the WIOA from July 1, 2020, through June 30, 2023. Commissioner Kirkmeyer moved to approve said memorandum of understanding and authorize the Chair to sign. Seconded by Commissioner Moreno, the motion carried unanimously. Commissioner Kirkmeyer moved to approve said contract and authorize the Chair to sign. The motion, which was seconded by Commissioner Moreno, carried unanimously. 4) CONSIDER CONTRACT ID #3724 INDIVIDUAL PROVIDER CONTRACT FOR PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME AND AUTHORIZE CHAIR TO SIGN - JON AND TERI LOZEN: Ms. Ulrich introduced the new foster care providers. Commissioner Moreno moved to approve said contract and authorize the Chair to sign. Commissioner Kirkmeyer seconded the motion and it carried unanimously. 5) CONSIDER CONTRACT ID #3725 INDIVIDUAL PROVIDER CONTRACT FOR PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME AND AUTHORIZE CHAIR TO SIGN — AILEEN MAZAK AND COURTNEY LOWER: Ms. Ulrich presented the new foster care providers. The motion to approve said contract and authorize the Chair to sign was made by Commissioner Kirkmeyer, seconded by Commissioner Moreno, and it carried unanimously. 6) CONSIDER CONTRACT ID #3726 INDIVIDUAL PROVIDER CONTRACT FOR PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME AND AUTHORIZE CHAIR TO SIGN - FELICIANO PORRAS-VALENCIA AND LA TASHA PULIDO: Ms. Ulrich introduced the kinship provider home. Commissioner Moreno moved to approve said contract and authorize the Chair to sign. The motion was seconded by Commissioner Kirkmeyer and it carried unanimously., 7) CONSIDER CONTRACT ID #3742 CHILD PROTECTION AGREEMENT FOR SERVICES (BID #B2000037) AND AUTHORIZE CHAIR TO SIGN - BEHAVIOR SERVICES OF THE ROCKIES: Ms. Ulrich shared the new core services agreement will provide Applied Behavioral Analysis Services. Commissioner Kirkmeyer moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Moreno and it carried unanimously. 8) CONSIDER CONTRACT ID #3744 2019-2020 AGREEMENT TO PURCHASE OUT -OF -HOME PLACEMENT SERVICES AND AUTHORIZE CHAIR TO SIGN — GREAT CIRCLE: Ms. Ulrich detailed the request for out-of-state residential childcare services for the 2019-2020 State Fiscal Year (SFY), specializing in the treatment of youth with aggressive behaviors. Commissioner Moreno moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously. 9) CONSIDER CONTRACT ID #3747 2020-2021 AGREEMENT TO PURCHASE OUT -OF -HOME PLACEMENT SERVICES AND AUTHORIZE CHAIR TO SIGN — GREAT CIRCLE: Ms. Ulrich stated the request for the 2020-2021 SFY follows the same standards discussed for the previous item. The motion to approve said agreement and authorize the Chair to sign was made by Commissioner Kirkmeyer, seconded by Commissioner Moreno, and it carried unanimously. 10) CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES FOR ACCOUNT NUMBER R0167987 - KAZEM AND HOORIEH REYHANI: Brenda Dones, Weld County Assessor, discussed the parcel location and property tax specifics and stated the owner is in agreement that the value of the 2018 assessment is fair and does not need correction, thus staff recommends denial of the petition for the 2018 tax year. Furthermore, Ms. Dones shared staff's recommendation to approve a partial abatement of the 2019 tax year, with a corrected assessed valuation amount of $250,560.00 and a total tax refund amount of $10,934.76. The taxpayer was not present for discussion. Commissioner Kirkmeyer moved to Minutes, Wednesday, July 8, 2020 Page 3 2020-1989 BC0016 deny the petition for 2018 and approve, in -part, the 2019 petition for abatement. Seconded by Commissioner Moreno, the motion carried unanimously. 11) CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES FOR ACCOUNT NUMBER R3914405 - NAPOCTR, LLC: Ms. Dones summarized the car wash location and property tax specifics, sharing one (1) car wash bay is not functional, so staff recommends approval of the 2019 petition, correcting the assessed valuation to a total amount of $194,300.00 and refunding a total amount of $19,645.93. The taxpayer was not present for discussion. Commissioner Kirkmeyer moved to approve said petition. Commissioner Moreno seconded the motion and it carried unanimously. 12) CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES FOR ACCOUNT NUMBER R4464106 - PINE MEADOWS APARTMENTS, LLC: Ms. Dones detailed the 14 -building apartment complex location, property tax details, and staff's recommendation to approve a partial abatement for the 2019 tax year, with a corrected assessed valuation of $528,140.00 and a total tax refund amount of $15,320.34. The taxpayer was not present for discussion. Commissioner Moreno moved approve said petition, in -part. The motion was seconded by Commissioner Kirkmeyer and it carried unanimously. 13) CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES FOR ACCOUNT NUMBER R6289486 - PRESTIGE EQUIPMENT, LLC: Ms. Dones shared the property location and warehouse sizes, while explaining the cost, market, and income approach to value the property is the method typically utilized to analyze new buildings; thus, staff recommends denial of the petition for the 2019 tax year. The taxpayer was not present for discussion. The motion to deny said petition was made by Commissioner Kirkmeyer, seconded by Commissioner Moreno, and it carried unanimously. 14) CONSIDER TEMPORARY CLOSURE OF CR 27 BETWEEN CRS 64.5 AND 66: Amy Mutchie, Department of Public Works, stated the closure will occur between July 13, 2020, and July 17, 2020, to replace a damaged 24 -inch irrigation pipeline for the Storm Lake Drainage District. Commissioner Moreno moved to approve said temporary closure. Commissioner Kirkmeyer seconded the motion and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved.
