HomeMy WebLinkAbout730826.tiff 13 � ,u . - .ti Fazed- _e /VG A 774/ 2/5 iC9 �‘- i, RESOLUTION WHEREAS, it has been determined by the Board of County Commissioners, Weld County, Colorado, that a proposed easement on a tract of land more particularly described as follows, to-wit: A tract of land 200 feet by 200 feetin the SEa of Section 15-IN-66W, thence in a westerly direction with and along the South property line of said SEa of Section 15, 491 feet to a point on said South property line; thence North 0° 14' West, 30 feet to the Place of Beginning; thence North 0°14' West, 200 feet to a point; thence South 89°43' West, 200 feet to a point; thence South 0°14' East, 200 feet to a point; thence North 89 43 ' East, 200 feet to the place of beginning, containing .918 acres, more or less. to the Colorado Interstate Corporation a Deleware corporation, for the purpose of erecting Wattenberg Field Compressor No. 2, does not come within the purview of the definitions of the terms "Subdivision" and "subdivided land" as set forth in CRS 106-2-33, (3) (a) and (b) 1963, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, desires to exempt this particular division of land for the aforesaid reasons pursuant to its authority under CRS 106-2-33-(d) , 1963 as amended. NOW, THEREFORE, BE IT RESOLVED, that the proposed easement and development of the hereinabove described tract of land to the Colorado Interstate Corporation for the sole purpose of erecting a Field Compressor be exempted form the definition of "Subdivision" and "subdivided land" as provided for in the new Weld County Subdivison Regulations at Section 2-1, A. , (3) , adopted August 30, 1972. The above and foregoing resolution was, om motion duly made and seconded, adopted by the following vote on the 13th day of June, 1973. We also submit an unexecuted copy of easement showing a tract of land 200' x 200' situated in the SE'k Section 15, Twp. 1 North, Rge. 66 West, Weld County, and more specifically shown on the land plat. We believe this parcel of land is not within the purview of Chapter 106-2-33 CRS (1963) as amended and therefore should be exempt from the definition of the terms "subdivision" and "sub- divided land". BLAES Assistant Manager, Land RLB:ah Encs • pas pipeline swollen Colorado Imamate Carynntion I EASEMENT KNOW ALL MEN BY THESE PRESENTS: THAT the undersigned, hereinafter called First Party (whether one of more), in consideration of the sum of Ten Dollars ($10.00) and other good and valuable considerations in hand paid by COLORADO INTERSTATE CORPORATION, a Delaware corporation, hereinafter called Second Party, the receipt of which is hereby acknowledged, does grant, sell and convey unto said Colorado Interstate Corporation, its successors and assigns, the right, privilege and authority to construct, operate and maintain natural gas compressor facilities, natural gas meter and regulator facilities, pipelines, odorization facilities, and all other necessary and related facilities for use in connection with Second Party's natural gas pipelines on the following described property situate in the County of Weld, State of Colorado: A tract of land 200 feet by 200 feet in the SE'y of Section 15, Township 1 North, Range 66 West, more particularly described as follows: COMMENCING at the Southeast corner of the SEk of Section 15- 1N-66W, thence in a westerly direction with and along the South property line of said SE's of Section 15, 491 feet to a point on said South property line; thence North 0° 14' West, 30 feet to the PLACE OF BEGINNING; thence North 0° 14' West, 200 feet to a point; thence South 89° 43' West, 200 feet to a point; thence South 0° 14' East, 200 feet to a point; thence North 89° 43' East, 200 feet to the place of beginning, con- taining .918 acres, more or less. First Party further grants unto said Colorado Interstate Corporation the exclusive use of the surface of the above described property for the pur- poses stated above, together with the right of ingress and egress to and from said facilities and lines for the purposes of maintenance, replacement, repair and operation of said facilities, and the right to fence the above tract of land.
