HomeMy WebLinkAbout20203867.tiffRESOLUTION RE: ACTION OF THE BOARD CONCERNING APPEAL OF THE DECISION BY THE DIRECTOR OF THE DEPARTMENTOF PLANNING SERVICES TO RESCIND SITE PLAN REVIEW PERMIT, SPR19-0008 - JESUS VEGA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to Sections 2-4-10 of the Weld County Code, the Board of County Commissioners considered the appeal of the decision by the Director of the Department of Planning Services to rescind Site Plan Review Permit, SPR19-0008, submitted by the appellant, Jesus Vega, and WHEREAS, the Board heard testimony and took evidence from the Department of Planning Services staff and Mr. Vega, and WHEREAS, upon consideration of such appeal, including a review of all information submitted by the appellant and the Department of Planning Services, the Board deems it advisable to deny the appeal of Jesus Vega, and affirm the decision by the Director of the Department of Planning Services to rescind Site Plan Review Permit, SPR19-0008, for any Use of a research, repairing, manufacturing, fabricating, processing, assembling or storage nature as may be conducted in the I-1 (Industrial) Zone District, per Section 23-3-310.B.1 of the Weld County Code. In an email dated September 2, 2020, this office posed the question to Weld County Public Works if this 'Road Maintenance Agreement' is needed as these properties do not directly abut any ROW except for access. Both properties currently access Cedar Ave. via a 16' wide private drive located on 1707 Cedar Ave. property. There is a 30' access easement across the north property line of 1731 Cedar Ave. to access Cedar Ave., but is currently not used. We have not received a response nor a Road Maintenance Agreement yet. In June of 2020, this office was hired to help facilitate these conditions per the approval on February 10, 2020. On July 31, 2020, this office made a request to Weld County Public Works that this SPR19-0008 have an exemption per Weld County Code Chapter 8-11-40.1.8. 'Development of sites where the change of use does not increase the imperviousness of the site.' This exemption was approved on November 18, 2020 by Mike McRoberts, P.E. Public Works. Between November 18, 2020 and November 30, 2020, we did not have sufficient time to finalize condition 1.D. — Final Drainage Report. We request the opportunity to respond to Mr. McRoberts comments to obtain final approval of the drainage report and record SPR19-008. We request an extension of time to get approval of SPR19-0008 and record these documents. We believe this is justified as the Planning Departments timeline does not account for the approval process timeline through Public Works. We feel that we are very close to final approval. This decision was based on a review of aerial images dating back to 2012, which demonstrated that the site has had no discernible increase in its imperviousness, and that Public Works is unaware of any adjoining property owner complaints of adverse stormwater runoff from the subject site. Note: Applying this exception at this time will disallow any future changes to the surface materials or the addition of any new structures. Please understand this condition and make sure your client is in agreement therewith. • Please submit a Drainage Narrative as described in Section 8-11-40.1 of the Weld County Code. A separate document titled, "Drainage Narrative" is appreciated. • Because this site falls within an MS4 area you are required to provide water quality. I have several questions and comments. 1. We believe this site qualifies for the CPDS R -Waiver. This would exempt us from the CDPS permit as we are less than 5 acres in size. I believe this would also exempt us from the MS4 requirements as well. Please confirm? 2. As we discussed, I do not believe that storm water leaves this property, thus creating a retention facility. Do you have information on the site to the west of this property? I believe ATD did this drainage. 3. We would prefer to have a detention facility. Can you suggest a path for the discharge from this site? I have attached our survey of the property. 4. We believe that we qualify for an exemption per Weld County Code Chapter 8-11-40.1 '8. Development of sites where the change of use does not increase the imperviousness of the site. The current site imperviousness is 59%. Mr. Vega may wish to build additional buildings in the future. He wishes to remove the existing asphalt and place buildings not to exceed this 59% total imperviousness. I will provide calculations as to the maximum building square footage allowed. YES S PR 19-0008 Page 1 of 6 Narrative: A Site Plan Review for a commercial vehicle and equipment parking, shop building, and any use of a research, repairing, manufacturing, fabricating, processing, assembling or storage nature in the I-1 (Industrial) Zone District per Section 23-3-310.6.1 of the Weld County Code. This Site Plan Review was originally approved under the old Chapter 23 prior to the July 25th, 2019 Weld County Code update. Therefore, this Site Plan Review will reflect the old Chapter 23, Article II, Division 4 of the Weld County Code. This Site Plan Review is located on two (2) parcels and covers 2.7 acres. There is a Non - Conforming Use (NCU-245) for outside storage located on the southern property. This Non -Conforming Use will cease to exist once the Site Plan Review is recorded. According to the application materials the commercial vehicle and equipment parking area is available for lease to outside individuals. The individuals leasing spots only are on site to perform pre -trip inspections and post -trip inspections accumulating to less than two (2) hours on site a day. They arrive at 7:00 am to gather material and tools stored in the shop building and return around 7:00 pm or dusk depending on time of year. This site has an active Zoning Violation (ZCV18-00172) due to the operation of a commercial construction business, the expansion of NCU-245 and commercial vehicle parking without first obtaining the necessary land use permits (Site Plan Review). A court order was signed on May 8, 2019 that details the property owner must complete the Site Plan Review and remove the noncommercial junkyard and the unpermitted structures on site. An amended court order was signed on December 2, 2019 that amended the original court order. Court is scheduled for June 8, 2020 and the applicant must have all conditions of approval items and a SPR Map recorded. This site plan review is approved with the attached conditions: 1. Prior to recording the Site Plan Review Map, the applicant shall address the following to the Department of Planning Services' satisfaction: A. The applicant shall submit an updated Site Plan Review Map, per Section 23-2-160.W of the Weld County Code for review and approval by the Department of Planning Services. The applicant shall submit a recorded copy of any agreement signed by all of the owners of the property crossed by the access. In the event that a portion of the building is proposed to be leased to another party in the future, the applicant shall submit a copy of the lease agreement and information regarding the proposed use of the leased portion to the Department of Planning Services for review. Based upon the proposed use and/or impacts of the leased portion, the Department of Planning Services may require a new Site Plan Review application. 4. All signs shall adhere to Chapter 23, Article IV, Division 2 and Appendices 23-C, 23-D and 23-E of the Weld County Code. 5. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. 7. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with Chapter 14, Article 1 of the Weld County Code. 8. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. 9. The facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S. 10. Adequate drinking, hand washing, and toilet facilities shall be provided for employees and patrons of the facility, at all times. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. SPR19-0008 Page 4 of 6 11. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On -site Wastewater Treatment Systems. 12. For employees or contractors on site for less than 2 consecutive hours a day, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County, contain hand sanitizers and be screened from existing adjacent residential properties and public rights -of -way. 13. All chemicals must be handled in a safe manner in accordance with product labeling. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 14. Process wastewater (such as floor drain wastes) shall be captured in a watertight vault and hauled off for proper disposal. Records of installation, maintenance, and proper disposal shall be retained. 15. The facility shall comply with all provisions of the State Underground and Above Ground Storage Tank Regulations, as applicable. 16. The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. 17. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. 18. The access to the site shall be maintained to mitigate any impacts to the public road, including damages and/or off -site tracking. 19. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized. 20. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire an approved Right -of -Way Use Permit prior to commencement. 21. The Property Owner shall comply with all requirements provided in the executed Road Maintenance Agreement. The Road Maintenance Agreement for this site may be reviewed on an annual basis, including a site visit and possible updates. 22. The historical flow patterns and runoff amounts on the site will be maintained. 23. Weld County is not responsible for the maintenance of onsite drainage related features. 24. This site is located in the MS4 area and is subject to the regulations of the state -issued MS4 Permit. 25. Once the permanent control measure has passed final inspection by Public Works, the site shall be routinely inspected at a frequency determined by Public Works, usually on an annual basis unless otherwise noted, for the life of the control measure. Inspections occur to ensure the permanent control measure remains fully operational and is being adequately maintained according to the site's Operation and Maintenance Plan. Upon sale of the property, the responsibility of maintaining permanent control measures shall be transferred to the new owner. 26. Landscaping materials as indicated in the approved landscape plan shall be maintained at all times. Dead or diseased plant materials shall be replaced with materials of similar quantity and quality at the earliest possible time. 27. Sources of light shall be shielded so that light rays will not shine directly onto adjacent properties where such would cause a nuisance or interfere with the use on the adjacent properties in accordance with the plan. No colored lights may be used which may be confused with, or construed as, traffic control devices. 29. Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Weld County Road Impact Program. 4. The applicant shall submit one (1) electronic (.pdf) copy or one (1) paper copy of the site plan review map for preliminary approval to the Department of Planning Services. Upon approval of the map, the applicant shall submit a Mylar, along with all other documentation required as conditions of approval. Its not the intensity at the 24 hour 100-yr storm multiplied by time. As that would not accurately sum the area under the precipitation curve. Calculus has come back to haunt me! I did a quick very rough estimate below. Obviously this is not an approved method and you will need to use the modified FAA method during the report or another approved method like MHFD. I used Noaa Atlas 14 data. We can use the Greely 100-yr 24 hour if you can find it. A = Area = 2.77 ac Inches to feet 1 ft /12in and acres to ft 43560 ft / 1 acre= 43560/12= 3630 (Unit conversion to cuft) O= 0.67 * 4.69 Inches * 2.77 Acres * 3630 ( Conversion factor) = 30,181 cuft 1.5 * Q = 45,2727 cuft This is a very rough spot check. However I would say both of us got numbers considerably larger than 3,000 cuft. So you're on the on the right path. I hope this helps. We as the planning department do not wish to see cases not get completed but this case in particular, SPR19-0008, has been going on for close to two (2) years which is a significant amount of time to get a case completed and is way passed the 180 day deadline of staff conditional approval. Planning department feels they have given ample amount of time to complete this case as a whole. Now if it turns out SPR19-0008 gets revoked, not withdrawn, then the improvements wouldn't have to happen simply because everything would have to be removed from the site. If all of the RV's are truly owned by Mr. Vega then there shouldn't be an issue. If Mr. Vega wants to store RV's, boats and other toys that are not owned by him he will need to rezone the property to accommodate commercial storage. The issue with the house (which is located on a separate lot and not associated with the SPR) was first brought to my attention when we met the other day. As you pointed out we did discuss the status of the home and we were able to locate the non -conforming use (NCU) file. After reading the NCU sections of the code pertaining to non -conforming structures we determined that the structure can be repaired but not enlarged. If you want to challenge our interpretation of the code, Mr. Vega is welcome to appeal our administrative interpretation to the Board of Adjustment (BOA). We could also consider a change of zone to R-1. I would recommend that you meet with Max to discuss both of those options. That said, because the home is not associated with the SPR, I would encourage you and Mr. Vega to wrap up the Site Plan Review as we are past the deadline in the code to finalize conditions and record the map. I spoke to Commissioner Kirkmeyer and the Board will not be involved in any future meetings.
