Home My WebLink About730530.tiff t 9A, 9 RESOLUTION WHEREAS, a public hearing was held on April 30, 1973, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Double 8 Land Co. , c/o Preston Williams, Ault, Colorado, requesting permission to locate a cattle feed lot operation on the following described property, to-wit: The SW4 and that part of the NW+ lying south of the Larimer-Weld Canal and west of the Smiley Ditch Lateral, all in Section 17, Township 7 North, Range 65 West of the 6th P. M. , Weld County, Colorado, and WHEREAS, the petitioner was absent, however, was represented by Mr. Harold Printz of Ault, Colorado, and WHEREAS, there was no opposition to the request of petitioner for the location of said cattle feed lot operation, and WHEREAS, the said requested cattle feed lot operation is located in an agricultural zone as set forth by the Weld County Zoning • Resolution, and { WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said cattle feed lot operation may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the recommend- ations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Double 8 Land Co. , c/o Preston Williams, Ault, Colorado, for location of a cattle feed lot operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect said cattle feed lot operation and shall have up•to one year from date hereof to begin construction of same, 3. That petitioner shall construct a sealed lagoon as proposed of not less than 8. 1 acres in size and having a capacity of not less than 1. 75 acre feet. 4. Lorenson read the staff' s recommendations for denial : not compatible with surrounding land use and zoning , it would hinder the Town of Gilcrest ' s future expansion , it has been recommended for denial ,by the Health Department , the soil report indicates that drainage pockets around Gilcrest are in evidence and all lagoons built to hold runoff would have to be sealed to prevent contamination of underground water . Intensive agricultural use should be further separated from the urban growth areas . Mr. Dinner reviewed the proposed ex- pansion of the feeding operation and the previous history. The size and capacity of the proposed pens have been reduced to 18 pens and 4860 head. They have moved to be in compliance with the 660 ' set-back from the highway regulation, . There will be landscaping and there is an adequate water supply . They have maintained good housekeeping, techniques on the ex- isting lots . There will be dust control devices used through- „ out the entire area. There will be dikes to take care of any runoff water. Mr . Edw. Dill spoke in favor of the operation . It provides a market for their corn and in turn the feedlot provides fertilizer for the farmers in the area . Mr. Dinner stated the lagoons will be sealed . A petition was presented signed by the surrounding property owners approving the oper- u :.ion . Mr . Glen Paul stated he has had no complaint on the existing operations , however the State Air Pollution Commission has recommended denial '. Mr. Henry Keiser spoke in favor of the operation . Mr. Sidney Strear reviewed their operations in Weld County and Boulder County. Mr. Dean Crosier stated he is from Gilcrest and wanted to reaffirm the , opposition of the Town of Gilcrest . A letter was received from the Town of Gilcrest , stating they are opposed to the operation . MOTION : By Mr . Heitman to take the matter under advisement . Second by Mr. Clark . Mr.. Sears reviewed the history of Colony Park. and stated at this time it has been approved by the Planning Commission and the Board of County Commissioners - subject to a contract for water and sewer. •They have been trying to work out an agreement with either .Hill ' N Park San- itation District or Evans Sanitation District and were turned down by both . Consequently they are asking approval to in- stall , their own facilities . They, have a water contract with Central Weld -Water District . Mr. Sears stated this facility has been sized to _ fit this project only,. and has visited like • 871 • V. • facilities and there was no odor." Mr. Olhausen stated Ron Schuyler and Glen Paul have reviewed the proposed facility and have at least given tentative approval . It is designed to• meet E . P .A. standards and State Health Department . The polishing pond would be essentially a lake .
