RE: ACTION OF BOARD CONCERNING USE BY SPECIAL REVIEW PERMIT,
USR19-0057, FOR OPEN MINING AND PROCESSING OF MINERALS (SAND MINING,
PROCESSING OF MINED SAND AND ACCESSORY ACTIVITIES ASSOCIATED WITH
THE SAND MINING AND PROCESSING OPERATION) IN THE A (AGRICULTURAL)
ZONE DISTRICT - BLACK MOUNTAIN LAND COMPANY, LP, C/O BLACK
MOUNTAIN SAND WELD, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 26th day of
February, 2020, at the hour of 10:00 a.m., in the Chambers of the Board, for the purpose of
hearing the application of Black Mountain Land Company, LP, c/o Black Mountain Sand Weld,
LLC, 500 Main St., Suite 1200, Fort Worth, Texas 76102, for a Site Specific Development Plan
and Use by Special Review Permit, USR19-0057, for Open Mining and Processing of Minerals
(sand mining, processing of mined sand and accessory activities associated with the sand mining
and processing operation) in the A (Agricultural) Zone District, on the following described real
estate, to-wit:
SW1/4 of Section 2; E1/2 and W1/2 of Section 3;
SW1/4, W1/2 SE1/4, E1/2 SE1/4, NW1/4 and NE1/4
of Section 10; all of Section 11; and part of the N1/2
of Section 14, all within Township 3 North, Range 61
West of the 6th P.M., Weld County, Colorado
WHEREAS, on February 26, 2020, the Board deemed it advisable for the matter to be
continued to May 27, 2020, at 10:00 a.m., to allow Black Mountain Land Company, LP, c/o Black
Mountain Sand Weld, LLC, adequate time to complete the engineered drawings and submit to
the Department of Planning Services for review, and
WHEREAS, on May 27, 2020, the Board deemed it advisable to continue the matter to
October 7, 2020, at 10:00 a.m., to allow Black Mountain Land Company, LP, c/o Black Mountain
Sand Weld, LLC, additional time to address ongoing items, including a Bijou Irrigation Ditch and
Bridge Crossing Agreement, a Right-of-way agreement for County Road (CR) 91, and updated
engineering drawings, and
WHEREAS, on October 7, 2020, the Board heard all of the testimony and statements of
those present and reviewed the request of the applicant and, having been fully informed, finds
that this request be approved and the matter should be continued to January 27, 2021, at
10:00 a.m., to allow Black Mountain Land Company, LP, c/o Black Mountain Sand Weld, LLC,
adequate time to work through unresolved issues such as possibly moving the entrance access,
permitting through the Colorado Ground Water Commission, and determining which County Road
Rights-of-Way to vacate.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned matter be, and hereby is, continued to January 27,
2021, at 10:00 a.m.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 7th day of October, A.D., 2020.
