James Commissioner Barbara Kirkmeyer Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jess Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Kim Ogle Public Works Department representative, Melissa King Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated February 10, 2020, and duly published February 14, 2020, in the Greeley Tribune, a public hearing was conducted on March 18, 2020, to consider the request of Richard and Debra Shubert, do Go Wireline, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR20-0002, for Oil and Gas Support and Service (magazine bunker storage of explosives utilized in fracking of oil and gas wells) in the A (Agricultural) Zone District. On March 18, 2020, the matter was continued to April 29, 2020, due to the COVID-19 event and to protect the health, safety, and welfare of the general public. On April 29, 2020, the matter was continued to May 13, 2020, due to the ongoing COVID-19 event and to protect the health, safety, and welfare of the general public. IR Kim Ogle, Department of Planning Services, presented a brief summary of the proposal, provided the general location of the site, and stated the site is within the three (3) mile referral area and the Coordinated Planning Agreement (CPA) boundary of the Town of Kersey. He mentioned the Town of Kersey returned a referral response requesting the Chief of Police be notified prior to operation of the site and described adjacent lands and surrounding uses. He indicated Planning Services staff sent notice to 16 surrounding property owners (SPOs) and received seven (7) letters of support and one (1) call for information about the hearing date and location. Mr. Ogle provided details about the proposed magazine bunker, including size and location, stated 12 referrals were sent out and two (2) agencies responded. He entered the favorable recommendation of the Planning Commission into the record as written and displayed images of the site and surrounding views. eo:0L(C o ITP' , LIA-cLLL eviCww-fbPc') -(11 1262_0 2020-0855 PL2735 HEARING CERTIFICATION - RICHARD AND DEBRA SHUBERT, C/O GO WIRELINE, LLC (USR20-0002) PAGE 2 • Melissa King, Department of Public Works, provided a brief overview of the transportation plans and requirements, stated the site access is on County Road (CR) 53, and noted the applicant will utilize an easement to the existing access. She provided the traffic counts, daily roundtrips with average speeds, described the traffic generated by the site, and presented the drainage requirements. ID Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions and stated portable toilets are acceptable. She mentioned the Department of Public Health and Environment included Development Standard (DS) #22 (compliance with the Colorado Department of Labor and Employment, Colorado State Division of Oil and Public Safety Regulations, as well as the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) regulations). She indicated DS #17-23 address Environmental Health items, and in response to Commissioner Kirkmeyer, Mr. Ogle clarified there are no on -site employees, but two (2) employees will visit the site daily. e Brent Kalkwarf, Go Wireline, LLC, represented the applicant, expressed concern with the access width and turning radii in Condition of Approval (COA) #1.C.7, and stated there will be no commercial trucks, only pickups, accessing the site. In response to Ms. King, Mr. Kalkwarf explained the pre -built building they will bring to the site measures 8x8 feet and will fit on a flatbed pickup. In response to Commissioner Kirkmeyer, he confirmed there will not be landscaping and screening at the site and Mr. Ogle clarified there is a wall that will go around the ATF structure, to provide security and screening. Mr. Kalkwarf indicated the employees visiting the site will only be there for approximately one (1) hour a day, Mr. Ogle stated the parking lot consists of one space, and Mr. Kalkwarf clarified the times the employees may visit. ra No public testimony was offered concerning this matter. e Chair Freeman suggested deleting the language about access width and turning radii in COA#1.C.7, and Commissioner Kirkmeyer suggested making the second sentence of COA#1.C.7 a new COA #4.B (obtain an Access Permit in the approved location prior to construction). Commissioner James suggested deleting DS #6 (hours of operation), in response to Commissioner Kirkmeyer, Mr. Ogle confirmed there is existing landscaping and she suggested deleting part of #9 (Landscape and Screening Plan), and adding a new COA #1.C (Decommissioning Plan). The Board agreed to all of the aforementioned changes. (Clerks Note: COA #1.C.21 was modified to eliminate the reference to an approved Landscaping and Screening Plan, consistent with DS #9, as modified.) EI No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. e In response to Chair Freeman, Mr. Kalkwarf indicated he had, on behalf of the applicant, reviewed and agreed to abide by, the Conditions of Approval and Development Standards, as amended. 2020-0855 PL2735 HEARING CERTIFICATION - RICHARD AND DEBRA SHUBERT, C/O GO WIRELINE, LLC (USR20-0002) PAGE 3 EI Commissioner James moved to approve the request of Richard and Debra Shubert, do Go Wireline, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR20-0002, for Oil and Gas Support and Service (magazine bunker storage of explosives utilized in fracking of oil and gas wells) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Ross, and it carried unanimously. There being no further discussion, the hearing was completed at 11:10 a.m. This Certification was approved on the 18th day of May, 2020.
