RESOLUTION
WHEREAS, a public hearing was held on Wednesday, January 6,
1971, at 2:00 P. M. , in the District Court Hearing Room, 4th Floor of
the Weld County Courthouse, Greeley, Colorado, for the purpose of

hearing the petition of Roger Gump, 3960 South Bellaire, Englewood,
Colorado, requesting a change of zone from "A" Agricultural District
to Mobile Home District, "MH-UD" - Unit Development of a tract of
land as hereinafter recited, all as appears on plat as submitted and
made a part hereof by reference, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no one present in opposition to the change
of zone, and
(;, WHEREAS, the Board of County Commissioners heard all the
testimony and statements from those present, and
WHEREAS, the Board of County Commissioners has studied the
recommendations of the Windsor Planning Commission and of the Weld
County Planning Commission as submitted, and having been fully
informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of the County of Weld, State of Colorado, for change of
zone from "A" Agricultural District to Mobile Home District, "MH-UD"
Unit Development of a tract of land as appears on plat, said area being
more particularly described as follows:
A tract of land situated in the E+ of Section 35, Township
6 North, Range 67 West of the Sixth P. M. , Weld County,
Colorado, being more particularly described as follows:
Considering the East line of the NE4 of said Section 35 as
bearing S 00° 33' 20" E and with all bearings contained
herein relative thereto. Commencing at the NE corner
of said Section 35, thence S 000 33' 20" E 1319. 94 feet
to the NE corner of the 5 of the NE4 of said Section 35,
said point also being the true point of beginning, thence
S 00° 33' 20" E, and along the East line of the NE4 of
said Section 35, 970. 00 feet, thence S 89° 36' 28" W,
1040. 00 feet, thence S 000 33' 20" E, 352. 00 feet, thence
S 89° 36' 28" W, 555. 00 feet, thence N 00° 33' 20" W,
1322. 00 feet to a point on the North line of the 5z of the
NE4 of said Section 35; thence N 89° 36' 28" E 1595. 00
feet to the true point of beginning, containing 40. 00
acres, more or less,
is hereby granted under the conditions following:
1. Any water and sanitation facilities to be installed shall be
approved by the State Health Department.
2. All applicable subdivision regulations, zoning regulations
and mobile home and mobile home park regulations shall be followed
and complied with in accordance with the zoning resolutions of Weld
County, Colorado.

3. Subject to purchase and dedication of 100 feet of land for
public road right of way along the north side of subject property, and
subject to building said road to connect with Eastman-Kodak Road, to
be comparable thereto, and to be built in accordance with county road
specifications without cost to Weld County, Colorado.

Pursuant to Notice published in the Greeley Booster on
December 4th and 25th, 1970, hearing on the above
application was held in the District Court Hearing Room,
fourth Floor of the Weld County Courthouse at Greeley,
Colorado, on Wednesday, January 6 , 1971 , at the hour of
2 : 00 o'clock p .m. , before the Board of County Commissioners ,
Glenn K. Billings , Chairman, Harold W. Anderson and Marshall

WHEREUPON, the following proceedings were
duly had:
CHAIRMAN GLENN BILLINGS : We will call this
hearing to order.
Docket Number 38 . Pursuant to the zoning laws
of the State of Colorado, this public hearing will be held
in the office of the Board of County Commissioners o₹
Weld County, Colorado, Weld County Courthouse , Greeley,
Colorado, at the time specified. All persons in any
manner interested in the following proposed change o₹
zone are requested to attend and may be heard. 'this
zoning change is in regard to Roger Gump , d/b/a Windsor
Meadows , 3960 South Bellaire , Englewood, Colorado,
January 6th, 1971, at 2: 00 o'clock p.m.
Mr. Telep , would you make a record.
MR. TELEP: Thank you, Mr . Chairman. Let the
record show that this cause came on for hearing this day,
January 6 , 1971 , at 2 :00 p .m. , in accordance with the
notice as was published and is required by law.
let the record further show that this is the
petition for a change of zone from "A" agricultural
district to "MH-UD" mobile home-unit development district
brought by Roger Gump , doing business as Windsor Meadows ,
of 3960 South Bellaire, Englewood , Colorado.
Let the record further show that this request

for a change of zone covers a tract of land situated in
the east half of Section 35, Township 6 North, Range 67
West of the 6th Principal Meridian, Weld County, Colorado,
and more particularly described in Meets and Bounds , and
as has been published, containing forty acres , more or less .
Let the record further show that the petitioner
is present . Let the record further show that there is on
file a recommendation, a favorable recommendation from
the Windsor Planning Commission and also a favorable
recommendation for the change of zone from the Weld
County Planning Commission.
Mr. Chairman, I believe we are ready to proceed,
and perhaps the petitioner or someone on behalf of the
petitioner would like to make an opening statement, and
proceed with the hearing at this point .
CHAIRMAN GLENN BILLINGS: At this time I would
call upon the petitioner and would ask that anyone who
testifies please give your name and address so that it
will be a matter of record, and much easier for us to
put into minute form.
MR. GUMP : My name is Roger Gump . I am the
petitioner in this action. I would wish to introduce
Jim Nichols of M & I Engineering, who would like to
present a summary of the different things we have gone
through during this period. He can familiarize you with

all our plans and answer any questions you might have.
MR. NICHOLS : I am Jim Nichols of M & I
Incorporated at 4710 South College Avenue , Fort Collins ,
Colorado .
If you are familiar with the Windsor area ,
I have an aerial photo mosaic of the area that is under
consideration, which is a brief outline of the area , with
the aerial photo, and of the blueprints which I see you
have in front of you.
This is the area in the black, or the dark
blue is the area that is under consideration, which is
this area as outlined in red on this aerial photo.
The property to the north and west is owned
by Kodak. The property directly north of the property
in question is owned by the Ehrlichs , who are Mr. and
Mrs .Ehrlich who are sitting in the audience . If you
would stand so maybe if they don't know you they might
recognize you.
Also directly to the west is the Webber property.
I am sorry to say Mr. Webber is ill and is unable to
attend today. He has attended at the other meetings .
Mr and Mrs . Lamb, who are the present owners
of the area around and with the area under consideration,
at this time are at the far south end over there .
The property is bounded on the south of it

by the Cache La Poudre River; on the east by the county
road, and the property directly east and across the road
is owned by the Hendricks .
Across the river the property adjacent to it
is owned by Yarnell .
We have made petition to the county for rezoning
and planning a development of this property. It was then
referred to the Windsor Planning and Zoning Board, passed
unanimously there ; went to the utilities commission, they
passed it, if my memory serves me right, unanimously; and
then in December it was passed by the Weld County Planning
and County Board unanimously.
Now, keeping in mind the area , the area is forty
acres as described in the petition. The gross area , forty
acres , the minimum lot size is called frontage, and the
set-back, ten foot set-back, is twenty two feet , no more
than six units per acre. This was as per request of the
County Planner. And net minimum lot area , three thousand
square feet. Average lot area is four thousand square
feet. The number of unit spaces , like I said, per acre,
was six.
It 's based on a cluster type area , with paved
streets , a valley pan, or gutter for drainage.
There are green areas adjacent to and around
the property.

There have been contours set out on one foot
contours so we could determine the slope of the land.
We do have that information available for the Planning
Commission.
The width of the streets are as called for ,
minimum forty foot from the entrance and twenty five foot,
if I remember correctly, for the ones here, this is the
road surface area . This is the northern portion of the,
the county road on your right and my left here , with an
entrance at this point, with a recreational clubhouse ,
office building , with shuffleboard in the area .
Some recreational areas , the common green
area is this area for some swing sets , et cetera . This
area is a confined area for swing sets or play ground,
which you could back up all the trailers and put the
trailers with small children in this area , they would
have their own play ground as such.
A trailer storage area , or storage area for
campers , boats , et cetera in this area .
At your lower right hand corner of sheet one
of two, shows the typical layout of each pad, as proposed.
MARSHALL ANDERSON: Is this off street parking
over here?
MR. NICHOLS : There is off street parking.
There is a covenance that has been worked out which will

not allow any parking onthe streets overnight. But there
are a few spaces for parking. And I think a copy of that
plus - -
MR. KEENAN: A copy has been made.
CHAIRMAN GLENN BILLINGS: The specifics are
on the first map , I believe.
MR. NICHOLS: There also has been taken under
advisement, the water is from the north Weld County
District. The power is from the REA , gas is from Public
Service Company. The sewer is from and will be serviced
by the Windsor, proposed sewage treatment plant which is
now under construction. We will have , in this location
of the park, a lift station which will collect all this
water and then pump it back across to and connect into
the proposed Windsor sewage outfall system and into their
facilities . And the town of Windsor has given their
approval on this connection, with stipulations that it
has to be in, I think it had to be in within - -
MR. GUMP: We have to start the park within
ninety days after they complete the sewer plant.
MR. NICHOLS : There is a berm which is around
this area on the south, for the proposed flood channel
as set out by a report for Kodak, which was engineered
by Nelson, Haley, Patterson and Quirk, and we have
received permission from them to use this report rather

than to go into an extensive report of our own.
MR. MARSHALL ANDERSON: You are talking about
that berm, is there going to be a road on that, or how wide
is it going to be?
MR. NICHOLS: I have a cross section. This is
a typical cross section. And of course it will vary in
height from along the south, which would be along this
area in here, as it goes north, this berm in height will
decrease until it tapers out to the existing ground because
of the fall, the natural fall of the area . There is a low
area right in one spot in here which will have to be
filled, which we are well aware of . And even that low
area does appear in the report. It says that the water
can get up to this area . We have allowed, from this
report , a two foot free-board above the proposed high
water mark. In this report their criteria was all based
directly on an obstruction at this bridge at this time .
But, as you know, things change. If the area channel
is cleaned out down below , lots of other things can either
hinder or help the situation. If it 's cleaned out or
all the bridges widened or anything , this is to allow
the flood plane to decrease to the north.
CHAIRMAN GLENN BILLINGS : You made the statement
this is proposed. Is it proposed, or is it going to be
built?

MR. NICHOLS : It will be part of the park.
This was a requirement that was stipulated by the Planning
and Zoning Board, thatthis berm would be built as part of
the park, as a protection tothe park.
MR. KEENAN: In addition to what you just
indicated, relative to the provisions for construction
of the berm, it is outlined in the planned unit development
that is on file , and the developer is tied to this
commitment made in the planned unit development. It
does stipulate in there that this berm will be constructed.
So it is tied in in the approval.
MR. MARSHALL ANDERSON: If you build that big
berm around there , how do you get rid of the surface water
out of the court?
MR. KEENAN: This would be an answer for the
engineer .
MR. NICHOLS : The water will normally run off ,
we have outlets and we will have to put headgates at this
point, with a headwall or just a flat gate, and if the
water gets too deep, say it floods there, you might have
to use pumps to get it out .
CHAIRMAN GLENN BILLINGS: I think his reference
is to regular rain water.
MR. NICHOLS : Through this inlet catch basin
out here to a pump through here and out and to the point
where these headgates and flappers are, as required. You
will notice that there are low areas in the streets , and
most of it does collect in this area , which we take out
this way into the borrow pit and down south, for the

-normal rain storms , surface runoff .
MR. HAROLD ANDERSON: Does this drain lead
right into the borrow pit?
MR. NICHOLS: Yes , it does . There is no
facilities or pipe to take it any further down to the
south of the park. We don' t have any storm sewer. It's
very flat . I am sure you are aware it's flat through
there .
MR. MARSHALL ANDERSON: Do you people intend
to provide that drainage to the river, or are you going
to require the county to do it , that surface water in the
court"?
MR . NICHOLS : Well, at the present time it
was dumped into the borrow pit, but if the request is
that we will have to facilitate some kind of a structure
of some kind of drainage facility from this point to the
river, which is approximately another , I really don' t
know, another five hundred feet, six hundred feet , I
am not sure, it 's this portion from here down and around,
goes just straight down and straight through this way,
if we can.
MR. MARSHALL ANDERSON: We have been real
unfortunate in the past to pick up drainage - -
MR. GUMP : No. I can assure the board that
we -will take care of any surface drainage on our own to

the river. This ground, the one hundred and sixty two
acres that we control there , does adjoin the river. And
so this forty acre tract is in the northeast corner and
we will certainly drain it to the river at no expense
to the county.
MR. MARSHALL ANDERSON: I would kind of like
to have that understood.
MR. GUMP : Right.
MR. NICHOLS: Do you have any other questions
that might have arisen'?
Z would like to show you next, unless you have
further questions with the park layout.
I don' t have the utility layout per se, but
we do have the utility layout, preliminary plan. It
doesn' t mean we won't change the cite pipe a little bit
or we are going to put the fire hydrants in there for
fire protection, as required. I don't think we need one
every five hundred feet. But there will be fire protection
and fire hydrants at strategic locations within the park.
MR. MARSHALL ANDERSON: You are going to work
with the Windsor Fire Department on that?
MR. NICHOLS : We will work with the fire
department . We haven 't shown them our layout yet , because
it isn ' t our final stage . Until we know it is the final
layout, then we will go ahead and present the utility

plans again to all utility companies for their approval .
Telephone, power, and all that. They will have to approve
them. They tentatively, or they did approve the preliminary
layout at their utility commission meeting .
One more thing , I will just bring this up .
This is a picture of the flood, the highest water we had
last June . And we just took some colored pictures of that
area . It shows the proximity of where the farm is . Let's
see if I can explain it to you. This is locking east,
and the property as you see, this is the road, this is
the farm, and the lines in this area .
This is the Cache La Poudre River as it runs
down through here. You can see the flooding of this
area .
Kodak, you know, you are aware they are doing
some channel changes in this area . This is what one
cf the reports was written for , the reports from N.H.P. & Q.
to divert the higher water that flows into the channel up
north. it 's tot the proposed, it is the, it will be the
existing or sewage treatment facility for Windsor.
This is looking east again.
This is the area in question right around in
here .
This is looking northeast, each one, as you can
see, by -where the river is .

This is looking almost directly down on the
property.
And this is the property in question here .
And this is the water here .
This is the club house, and there is a swimming
pool proposed for the club house with a sauna bath,
recreational room, laundry facilities , with a small
office for normal administrative duties of the park.
This is a planned view of the same area with
the meeting room, game room, laundry facilities and small
kitchen, and with a sauna bath here and a pool, and some
areas for picnics , within the unit itself , and fenced in.
There will be strategic trash locations , I
will bring this up now, in the area that people can, where
trash will be collected by some company, outside service ,
to collect trash within the area .
I -don ' t have anything else myself at this time .
Maybe Mr . Gump has .
MR. GUMP: Well, I would like to assure the
Board that this park will, we expect this to be the
finest park in the whole county. And the berm will all
be a landscaped berm so it will act as , for two reasons ,
it will help on flood control and it will also be an
attractive barrier between this and any adjacent property.
Now, the school board, we have met with the

Windsor School Board. We have proposed, I think, something
new clear across the country, which they have gone along
with and given their approval . We are going to offer the
school, or pay the school five dollars per month per each
occupied space . That will go directly to the Windsor
school. At the end of the first year we will sit down
and assess whether this has covered the difference between
what an average property owner in Windsor would be paying
for schools against what each one of our spaces is paying.
And then this will be adjusted up or down, as the case
may be .
MR. MARSHALL ANDERSON: In other words , is that
on an occupied space or total space?
MR. GUMP : This will be on each occupied space .
-But it does not matter whether the person has children or
-not. In other words , we will have it on the adult section
of the park where there will be no children at all. They
will still participate in this funding of the schools .
And this will be paid direct to the school , and we will
adjust it accordingly so each year we are sure that we are
paying all our fair share that we should be paying. We
are not trying to avoid or evade this in any way.
CHAIRMAN GLENN BILLINGS: Are these homes going
to be set on foundations?
MR. LUMP: Well, with the school board, we have

come lip to this quite a bit, but you come to a point of
what really constitutes a foundation in a mobile home
park. And the Windsor Planning Commission has stipulated
that after a mobile home is there nine months or longer
it has to be put on a foundation. But when we got into
this deal on the schools , it hasn' t been done anyplace
else that I know of in the country, you get into the
ad valorem tax, or whether you are just , what the situation
this trailer is in. And this is why we took the bull by
the horns . We felt, and we are going to offer the direct
payment to the schools regardless whether it 's a trailer
Dr whether it 's been there nine months or whatever, we
will pay the money ourselves directly to the school, so
there will be no later misinterpretation of what a
foundation would constitute or whether the trailer was a
permanent attached fixture or not. We are assuming that
it 's all permanently attached, and then paying whatever
excess that we can handle by the ad valorem tax.
MR. MARSHALL ANDERSON: I have got a question
here, that has been brought before us . I was over there
yesterday looking at it . There is a county road being
-proposed between the existing road and the road south of
Windsor, 292 1 guess it is , 257 . Now, as I see this park,
we are looking at what, two hundred and forty spaces?
MR. GUMP : Right .

MR. MARSHALL ANDERSON: Possibly five hundred
automobiles .
MR. GUMP : Yes .
MR. MARSHALL ANDERSON: Now, all these people,
they only got one access in and out of this place, is
that right?
MR. GUMP: You mean where the club house is?
MR. MARSHALL ANDERSON: No. I mean one access
entrance to the park.
MR. GUMP : Right, correct.
MR. MARSHALL ANDERSON: Now, I think that is
going to throw an awfully lot of traffic on that one road,
both north and south. Everybody has got to go out that
road. Has there been any thought with Webbers or the
people north or west of you, to make another entrance
to this park?
MR. GUMP : I think it is thoroughly possible .
We do have a right of way going through Eastman's property
-to 257 . But I really feel that probably throwing a lot
of people out on a busy highway wouldn't really be as
advantageous as the county road that exists , possibly,
because it 's a quieter road. We would be the main
population factor on this road. You could go south or
-north on the county road. So I don' t feel funneling a
lot of people through Eastman's , I don 'tknow whether that

would please them very much.
MK. MARSHALL ANDERSON: That is beside the point.
Because Eastman's - -
MR. GUMP : I understand that.
MR. MARSHALL ANDERSON: We are going to
dedicate a right of way, east-west road through that
plant, if we open that road up east . And they are also
going to dump five hundred cars a day out that north-south
road. So if you think you are on a quiet road you are
thinking wrong.
MR. GUMP : I feel their road, their access
is going to be north of ours .
MR. MARSHALL ANDERSON: That's right . But we
still have got a half mile there between the oiled road.
The thing I am wondering, in movement of traffic , we
instructed our engineer yesterday to sit down with the
Eastman people to see if we could work out a traffic pattern
over there -on that road. And I think we are looking at
this mobile court here , it might be in order for you
people to join forces with them and see what we can come
up with, with a traffic pattern or road system.
MR. GUMP : We would be glad to.
MR. MARSHALL ANDERSON: Within that area , because
when you think you got a quiet road there , you don' t .
MR. GUMP: We are certainly willing to work with

them in any way, because it' s to ourbenefit as much as
to anybody else 's .
MR. MARSHALL ANDERSON: Say this court is full,
you are going to have six, seven hundred people in there .
MR. GUMP: Could be.
MR. MARSHALL ANDERSON: Two hundred cars ,
three hundred cars , five hundred coming out o₹ Eastman's .
I just am wondering if you people had even thought about
that .
MR. GUMP : We hope some of the cars out o₹
Eastman's will turn and go into our park.
MR. MARSHALL ANDERSON: But we are faced with
the proposition of about two miles of county road there.
MR. GUMP: I understand, going south from the
pavement .
MR. MARSHALL ANDERSON: Do you know what I
mean, Mr. Lorenson?
MR. LORENSON: I think it would probably be
to your advantage and to ours to go along with our county
-engineers and work with Mr . Gump and Kodak and find out
if maybe there dioul dn't be another entrance to this park
on this other proposed road which would also give access
in more than one direction . I think very definitely we
are going to be creating quite a traffic problem in that
nne county road.

MR. GUMP : 14e do control the access clear to
257 . So I mean I tan assure you, if you want a west gate,
we can provide it for you.
MR. MARSHALL ANDERSON: Well, the thing about
it is I can 't zee any sense of having two on 257 . But
_I would like for, Z think it 's in order for you people
and Eastman and the county to get together and see if
we can' t design a road in there, because we know the
oiled road in front on the north side of Eastman's is
overloaded now. And the road is overloaded east. And
all we got to do is improve that road down by the trailer
court and it 's overloaded.
So that is the reason I think we are going to
have to find some more outlets around here somewhere.
MR. GUMP.: Well, we do possess the right o₹ way
to get to 257 . We certainly will work with the county
and Eastman and so forth to make it satisfactory.
MR. MARSHALL ANDERSON: I think now is the time ,
when you can 't do anything else .
MR. GUMP : l am sure now is the time. It's
cheaper now than it is six months from now.
MR. MARSHALL ANDERSON: We have got all these
-heavy thinkers , somebody ought to be able to come up with
something.
MR. LORENSON: You are talking about a northerly

entrance or westerly entrance?
MR. MARSHALL ANDERSON: I think it should be
in the northwest corner, somewhere in there . I don't know
whether you people have thought about that or not.
MR. GUMP : We have an assigned right of way
by Eastman up to the northwest corner Df Webber 's property,
which in turn would be directly west of the northwest
corner of the park. So we could provide an east-west road
that way.
IKR. _MARSHALL ANDERSON: What I am getting at,
all those people coming out from the court in the morning,
I am sure they are not all going to be working at Eastman,
they will work in FDrt Collins Dr LDveland, because yDu
got to go clear across town to go to work. And everybody
is going to be jammed up -on that Eastman road.
MR. GUMP : I think you are very, very right
on it and I agree with you one hundred percent.
MR. MARSHALL ANDERSON: But I think now is the
tine to get a road planned and designed in there . The way
it seems , as far as just the cDunty side of it, we are
faced with two bridges on that road regardless of what
happens , one at seven thousand dDllars and the other about
fifty.
MR. GUMP : is this on the east-west road we
would build?

STIR. MARSHALL ANDERSON: You are going to change
that whole line of river bottom. That old wooden bridge
just wouldn ' t carry it, if you are going to put traffic
on it.
MR. GUMP : You are talking about the one going
on the east side of the park?
MR. MARSHALL _ANDERSON: Yes .
MR. GUMP : But if we have an entrance going
south, we won' t have any entrance going onto 257 without
a bridge.
MR. IVIAR-SHALL ANDERSON: But I can visualize
a minimum of one thousand cars a slay on that two miles ,
-from what I understood yesterday. Di-dn' t you, Sam?
Wasn't that what they said, five hundred; and they state
they run five hundred,that is a thousand, that is just
for openers .
CHAIRMAN GLENN BILLINGS: You mentioned that you
were going to get water from the north Weld Water District.
Have they agreed in writing _that they are going to provide
you with water?
MR. GUMP: Yes . They signed a petition, we
furnished three acre feet of water per acra developed,
and they will take eare of the water.
CHAIRMAN GLENN BILLINGS: Do you have any
questions , Harold?

CHAIRMAN GLENN EBILLINGS : Marshall, do you have

MR. MARSHALL ANDERSON: a have asked enough,
I think.
-CHAIRMAN GLENN BILLINGS: Z would have Dne
question. I note here on the legal here , regarding land-
scaping, I assume that -this is going to be your responsibility
as a developer for all the landscaping?
MR. GUMP : That 's correct.
CHAIRMAN GLENN BILLINGS : To snsure we have the
type of park you say in Weld County, or Colorado?
MR. GUMP: Now , we have also filed a covenants
to go with the park, which we want rules and regulations
of the park, caring of spaces around the mobile -homes ,
storage of extra things they would have and so forth.
CHAIRMAN GLENN BTLLINGS : In other words , they
are not going to be able to come in and put up some kind
of -a shack alongside a trailer , or something like this?
MR. GUMP : That 's right . All Df this will be
governed by the county directly and which will not be
able to change at a whim of - - say an owner way down
the line came along and said well, this isn' t what we feel
should happen. These will he filed on record with the
county and they will be adhered to .

CHAIRMAN GLENN BILLINGS: Do you have any other
people that you want to call to testify or give any
information regarding this?
MR. NICHOLS : The only thing I would like to
ask that if the people adjacent to the area , Mr. and Mrs .
Ehrlich, Mr . and Mrs . Webber aren't here, Mr . Webber did
-make his comments on the planning commission hearing . I
think you will find in that that they are favorable . And
I would like these people to speak for themselves if they
have anything to say.
MRS . EHRLICH: We are not opposing it.
IR. LAMB: We are not opposing it.
EHAIRMAN GLENN BILLINGS : Let the record show
that the Lambs and the Ehrlichs have indicated they are
not in opposition to the approval of this change of zone ,
and are residents in the area . Is there anyone else here
who would like to make a comment in favor of - - Mr. Lamb?
MR. LAMB: Mr . Chairman, I might add that Mrs .
John Webber called this morning and said that John is in
the weld County Hospital, not able to attend this afternoon,
and she has had a bad cold and couldn't come herself . They
-are not opposing the park in any way. In fact, they are
supporting it on petition.
CHAIRMAN GLENN BILLINGS : Is there anyone else
who would like to comment in favor of this change of zone?
If not, is there anyone here who would like to comment in
opposition?
Let the record show that there is no one present

at this hearing in opposition to this change of zone, and
that there are four people who have indicated their approval.
Is there anyone else who would want to comment? We have
two or three other people in the audience, and I assume
they have no comments .
MR. TELEP: Mr . Chairman, I would just like to
make an observati m here , that the petitioner has shown the
board and has talked about several exhibits , and I would
just like to recommend to the Board that these particular
exhibits be identified and properly introduced into
evidence . And of course I think it would be in order
that they can be or may be removed. Would that be all
right? If you could properly identify them and then
introduce them into evidence , purporting what they reflect,
I would appreciate it very much.
CHAIRMAN GLENN BILLINGS : Mr . Lamb.
MR. LAMB: Mr. Chairman, we have talked this
trailer park over in the school board for School District
RE-4, Weld County, and the school district feels that the
arrangements for having the youngsters meet at the club
house so that all the youngsters from the park will be
picked up at that one point by a bus and taken from there
to the Windsor schools will be satisfactory,and the board
approves that plan.
MR. MARSHALL ANDERSON: Is this a perimeter road?

MR. GUMP : No, this is an overlay.
CHAIRMAN GLENN BILLINGS: At this time will
you please identify those exhibits .
MR. NICHOLS : Yes . Applicant's A, as I
presented to the County Commissioners , is a colored
rendering of the recreational building and the recreational
facilities .
Applicant' s Exhibit B, as referred to, was
a planned view of the recreational facilities showing
location of the building, showing the rooms within the
building , the swimming pool location and the land.
MR. TELEP: That is a complete floor plan?
MR. NICHOLS: Yes .
Applicant's Exhibit C is nine colored aerial
photos of the area , the Lamb farm, the area showing the
proposed mobile park.
Applicant's Exhibit D is an aerial mosaic of
the Lamb farm and the adjacent properties to the proposed
mobile park.
Applicant's Exhibit E are the operating rules
and regulations for the mobile park which are to be filed
and recorded.
Applicant 's Exhibit F is an exhibit showing a
cross section of the berm as well as the profile of the
north-south, in the north-south direction with relation to

the high water as proposed in the report, engineering
report, and shows the landscaping of the berm itself ,
and the cross section view.
At this time I would like to withdraw Exhibits
A , B and C, and present D, E and F for your consideration.
CHAIRMAN _GLENN BILLINGS: Mr Lorenson, would
you like to fill the board in on your recommendations?
MR. LORENSON: Mr. Chairman, before I make any
recommendations I would like to ask the developer several
questions .
You submitted to the planning department a
log of borings that you took to investigate soil, and as
I understand it, that hole number 42 was the one that you
used as a typical one for the site?
MR. GUMP: I have to refer this to our engineer.
}IR. NICHOLS : I am sure that is correct. I
don' t have a copy of that.
MR. LORENSON: And where did you find the water
table when you checked this site, -of the ground water?
MR. NICHOLS : I didn't personally check it .
One of the fellows did. It was about five, six feet
below the ground. The borings were taken by Empire
Laboratories of Fort Collins . So 1 would rather refer
to their report rather than I would our report .
MR. LORENSON: This indicates that that was

taken on August 30th, and September 20th, 1968, shows that
test hole number 42 to be approximately a foot and a half
below the surface, is that about right?
MR. NICHOLS : That 's right.
MR. LORENSON: And also there is a depth of
gravel in there that is approximately between eight and
nine feet, by their calculation. So this would be lying
over a gravel deposit?
MR. NICHOLS : Yes .
MR. LORENSON: Okay. I think this might be
of interest.
One other question I would like to ask is if
there were significant developments upstream from this
site say similar to this one what would happen to the
water, not the water table, but the flood plan, generally?
MR. NICHOLS: It's a hypothetical question.
MR. LORENSON: Yes , it is .
MR. NICHOLS : I am sure it depends , maybe
nothing will ever happen. Maybe it will stay the same .
The reason I question this is because of the type of
storm that can contribute to the area . If we get a
localized storm we would get one effect. If we got a
generalized storm we get another effect. If we get a
period of three or four days of storm, prior to a heavier
storm or heavier rainfall intensity, so Z really don ' t

know. It 's sort of a hypothetical question. I can' t give
you a direct answer to it , I don't know .
MR. LORENSON: Okay. Thank you.
MR. GUMP: Mr . Lorenson, I believe I can answer
somethingabout your water tables . I believe Mr lamb told
me once that when that area is flood irrigated, they have,
Mr. Lamb has twelve shares of Whitney Ditch, Mr . Webber
has twelve shares of Whitney Ditch, I don' t know how
much Mr . Ehrlich has . But when this is all being irrigated
your test holes , per se, your water tables Are much higher,
you know , when they are not irrigating.
MR. IAMB: Mr . Chairman, for the record, about
thirty years ago we put a tile drain emptying into the
Poudre River just directly behind our barn, and extending
roughly north approximately halfway up the Ehrlich fence ,
and then northeastward over into the extreme northeast
corner of our property, and that tile drain at the shallowest
point is approximately three feet deep. The deepest point
where it crosses under the irrigation -ditch, directly
north of our house is , the ditch is about eight feet
deep. That tile drain runs the year round and pulls
underground water and empties it directly into the Poudre
River.
Then some years before that we put in a tile
drain emptying into the Poudre River just slightly west

of the previnusl y mentioned drain, and extending roughly
northwestward up to within a few feet of our northwest
corner, which is adjacent to the corner of the Ehrlich
property and the -Kodak property and the Webber property.
And this drain always runs year round and drains seepage
water, or water table water into the Poudre River. Of
course when there is heavy irrigation going on to the
-north and northwest of us , it drains on more heavy than
it does at this time nl year. But they do run, even at
this time of the year .
MR. LORENSON: Mr. Chairman, it 's the planning
commission's recommendation that this be approved, and
primarily, according to the resolution, it has been
approved by the Windsor Planning Commission and with
the stipulation it should have a berm installed. Since
this point in time I have talked with the engineer for
the developer and he has answered some of the questions ,
but they are not spelled out within the planned unit
development at this time . And that is for the fire
protection, the statement as to lire protection as
on their word only, and it is not part of the planned unit
development. We have been attempting to upgrade our
requirements , and lire protection is one of them. And
the other item, every road within this -development is a
private road, it 's not public access , and therefor-e we

would request some means fer access for emergency vehicles .
So we would request also a statement to be entered into
the planned unit development which will allow for -emergency
vehicle access . And the planning commission recommends
the approval .
MR. MARSHALL ANDERSON: We11, Mr . Lorenson, if
-that other road is opened up on the north side, or if they
can work out another entrance, how will that be?
MR. LORENSON: Well , I think if we run a road
to it we are going to run one by it , not to it , because the
type of roads and the type of development it is , and have
a road leading out from this park into it, because if you
just run a big road into it, then you have got a public
access problem and none of these roads are public .
'Therefore , it 's going to have to be the type of road that
runs by it , not through it .
CHAIRMAN GLENN BILLINGS : Somewhere along the
Pine I think I lost you.
MR. MARSHALL ANDERSON: How about along the
north side of that property?
MR. LORENSON: All these road in here , they go
noplace , but they are not public roads . The development
and the maintenance and everything , snow removal , is going
-to be the responsibility of the park owner and _developer.
Now, this road out here is a public road. And if you

take and run a road in over here , then you are making
access from a public access into this mobile home park,
and I am saying that possibly a public road should run
along the northeast or west edge , but to break it in
and make it come directly in the park wher-e everything
is leading in from this point , then that puts these roads
in a public thoroughfare type nature . And it 's a different
concept than what they propose within their plan. It
makes a difference .
MR. MARSHALL ANDERSON: Would you want a
recommendation from the fire department of Windsor on
how they want to fight fires?
MR. LORENSON: Yes , I would. I would say that
an the fire protection, that we would get a letter from,
the requirements , from the Windsor Fire Department as to
what their requirements are and negotiate between Mr . Gump
and the Windsor Fire Department on location of hydrants .
And location of hydrants also may mean a difference in
their pipe size and in the ground.
MR. NICHOLS: We don't have any objection to
submit, before we commence construction, their approval
prior to -construction so far as right on the plans , their
approval , Mr. Lorenson, of the sizing and the location.
'The same with the district sanitation.
MR. LORENSON: I really didn't think you had.

MR. NICHOLS: I just wanted to make sure this
is fine.
MR. MARSHALL ANDERSON: I think this ought to
be a matter of record.
MR. NICHOLS : We are willing to submit all
these to the utility company prior to commencement of
construction.
CHAIRMAN GLENN BILLINGS: This was one reason
I didn' t follow through, because you did indicate -you were
getting your water from North Weld . If it would have
been from the City of Greeley, it was just by resolution
last night, that this had to be part of the zoning change
regulation meeting their standards for fire code .
I don't know on this road suggestion problem,
this is something I think you should work out with Mr.
Gump -and the developer. I can see now your suggestion
that if we do open an area onto a main thoroughfare on
the other end it would have a tendency to feed people
through the park, and I think this is not your intent .
MR. GUMP: No, it is not.
CHAIRMAN GLENN ,BILLINGS: And very possibly
this road should run -along the top part here.
MR. GUMP : Our easement with Eastman is for
our use. It is not to provide theppublic a road either .
This is something you must realize. We have sccess to

and from, but it isn't an -access to, you know, run a
major highway through or something like that.
CHAIRMAN GLENN BILLINGS: I am sure this can
be worked out satisfactorily with your people And Mr.
Lorenson so that we don' t create a thoroughfare through
this park.
MR. GUMP : Now, for the emergency etuipment, I
agree they must have proper access to everything . but as
far -as making a short cut from Greeley to Windsor or
Greeley to the front entrance of the plant or something ,
we certainly are not for that , going through the park.
That would kill the whole concept of the cluster deal
and so forth of the park.
CHAIRMAN GLENN BILLINGS : Are there any other
questions or comments? If not, at this time I would
entertain A motion.
MR. MARSHALL ANDERSON: Mr .Chairman, I move
we take this under advisement and see what they come up
with on this _road development.
MR. _HAROLD ANDERSON: I second the motion.
CHAIRMAN GLENN BILLINGS: I have a motion that
we take this under advisement, anti I _think we should solve
the two things , the road situation and the fire protection
situation. I also have a second to that motion. I will
make it unanimous . As soon as we have those two problems

is our understanding based on Town Board action in their

would serve the development with the new treatment
facilities . In view of the elapsed time, the Board of
Commissioners have instructed us to inquire regarding
any subsequent Town Board action that may rescind
the previous provisions of the January 12, 1970 meeting .

OPERATING RULES AND REGULATIONS
FOR
WINDSOR MEADOWS MOBILE HOME PARK
1 . Rents: All rentals are monthly, due on the 1st day of each month
and shall be paid in advance by the 7th day of the month. Travel
trailers , campers , boats and extra cars may be parked in the
storage area at the scheduled rate per month per unit.
2 . Utilities: Each unit has its own electrical and gas meter . Bills are
payable on the first of each month and when departing. Costs of
water and trash removal are included in the monthly space rental.
Telephone service is available from the telephone company. No
personal telephone service will be provided by the park management.
3 . Mobile Home Maintenance: The exterior of all mobile homes must be
kept clean and in a neat appearing condition. All electrical, water,
sewer, and gas connections must be kept in a safe and leakproof
condition at all times . Report any park facility out of order to the
management. All mobile homes must not be blocked with anything
other than solid blocks . Ebsting of "For Sale" signs on mobile homes
or automobile in park is prohibited.
4. Patios , Cabanas, Awnings : Complete skirting and awnings of mobile
home are required within 60 days of occupancy. No wood skirting
of any type will be allowed without management's prior approval.
Only County approved awnings may be erected. There must be six
feet of clearance from any part of awnings, fence or mobile home .
5 . Lot Maintenance : All spaces remain under the direct control of the
management. Residents shall maintain their space in a clean, well-
kept and attractive fashion, including the front, sides and back. If
a space is neglected, management will take over its care and bill the
the resident for these services . Each tenant will be required to land-
scape his space within 90 days . Tenant will maintain lawn, flowers,
and shrubs; keep lot clean, grass cut and watered and all trash,
debris , boxes , barrels, brooms, ladders, etc . must be out of sight.
When space is vacated the lot must be leveled and all holes filled.
6. Lot Usage : No towels, rugs, wearing apparel or laundry of any
description may be hung outside the mobile home at any time . Un-
sightly vehicles shall not be permitted to park on mobile home space.:
No repairing of cars will be permitted in driveways , carports , or
streets . Any car dripping gasoline or oil must be fixed to avoid
damage to the paving. Drip pans may be used if kept clean. No
permament parking of travel trailers, campers, boats in driveways .
Storage under mobile home is not allowed. No appliances outside
of mobile home . Patio furniture and barbeque equipment on the patio
and a storage cabinet on the carport side are the only items per-
mittad outside of mobile home .

7 . Recreation Facilities : They are provided for the exclusive use of
park residents and their accompanied guests . All are at tenants
disposal and to be used at their own risk. Tenants desiring to use
the recreation hall for private parties may do so , providing it does not
conflict with park activities . Consult management for appointments .
NO drinking of alcoholic beverages in or around the recreation area
or buildings, except at special park functions approved by the
management. NO glassware or soft-drink bottles in the recreation
area. Closing hour for all facilities is 10 : 00 p. m . , except for special
events .
8 . Guests: There is no charge for guests staying under 7 days . If
guests stay longer than 7 days, they must register at the office and a
charge will be made . No daily or nightly baby-sitting service
will be allowed. Visiting children must be supervised and accompanied
by an adult resident at all times while in the park. Residents will be '
held responsible for the conduct of their guests .
9 . Pets: Only small pets will be allowed, limited to one dog and/or one
cat per space, to be accepted at the sole discretion and judgment of
the management. Pets must be kept on a leash and never allowed to
run at large . Noisy or unruly pets or those that cause complaints will
not be allowed to remain. The droppings of pets must be cleaned off
the lawns, sidewalks , patios, carports and drives by the pet1s owner.
No pets will be allowed in the utility buildings, recreation hall or central
park area.
10 . Vehicles : Speed limit for all vehicles is 15 miles per hour. No parking
on streets or vacant patios . Management will provide a limited area for
parking of travel trailers, boats, campers, trucks, and excess cars,
with a separate charge made for such parking.
11 . Utility Areas: Automatic laundry is for tenants use only.
12 . Garbage: Only uniform 30 gallon size containers as approved by manage-
ment may be used for trash and garbage . All raw garbage must be
wrapped before placing it in cans . Residents must deposit trash at
pick-up points for designated pickup service . All cans will be stored
out of sight behind or inside storage sheds .
13 . Conduct: Disturbing noises, parties, intoxication or misconduct will not
be tolerated. No motorcycles or noisy cars . No soliciting or peddling
permitted without permission from the management. No private enter-
prises or businesses may be conducted in the park by residents .
14. Subletting and Sale : Will not be allowed without prior approval from
management. Prospective buyers or occupants in tenants absence must
submit an application for residency to management for approval . No
transfer of occupany or sale will be allowed until such approval is
obtained.

15 . Fences . Any fence construction on space property lines will be the
responsibility and expense of the tenant. Prior to construction, the
exact location of fencing will be physically inspected and approved by
management. All fence construction will conform to state and county
laws and ordinances with respect to height, length, setback, etc .
16 . Responsibility: The management is not responsible for loss due to fire,
theft, or accident. Violation of any ordinance or law of city, county
or state will not be tolerated. No acts or misdemeanors shall be
committed which would place the management or owners of these premises
in violation of any law or ordinance of city, county or state .

Meadows Mobile Home Park, Official Unit Development.
