RESOLUTION RE: APPROVE PARTIAL VACATION OF SPECIAL USE PERMIT, SUP-170 - DIAMOND LAND, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution #72-0314, dated October 4, 1972, the Board did approve the request of W. H. Webster for Special Use Permit, SUP-170, for expansion of an existing cattle feedlot operation in the A(Agricultural) Zone District, on the following described real estate, to-wit: NE1/4 and NW1/4 of Section 6, Township 5 North, Range 64 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request from the current property owner, Diamond Land, LLC, 134 Oak Avenue, Eaton, Colorado 80615, to partially vacate Special Use Permit, SUP-170, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said partial vacation, conditional upon the following: 1. Pursuant to Section 23-2-280.6 of the Weld County Code, the applicant shall submit a revised SUP map, titled "Partial Vacation of Special Use Permit, SUP-170", conforming to Section 23-2-260.D of the Weld County Code. DEPARTMENT OF PLANNING SERVICES MEMORANDUM OUy'Y.I �II�II������GGGGGG To: Weld County Board of County Commissioners Hearing Date: April 27, 2020 From: Michael Hall, Weld County Department of Planning Services Subject: Partial Vacation of SUP-170 Owner: Taurino Martinez Cabrera Address: 24921 County Road 60 '/z, Greeley, CO 80631 Legal Description: Part the of NE4 of Section 6, Township 5 North, Range 64 West of the 6th P.M., Weld County, CO Location: North of and adjacent to County Road 60'/; west of and adjacent to County Road 51 Parcel Number: 0963-06-0-00-004 Parcel Size: +1-2.17 acres Zoning:A(Agricultural) Summary: The proposed partial vacation seeks to remove a 2.17-acre excepted parcel, created in 1963 and owned by Taurino Martinez Cabrera from the SUP-170 boundary. This Cabrera parcel is erroneously included in the Special Use Permit SUP-170 boundary for the adjacent 24,000 head feedlot, approved by BOCC Resolution in October of 1972. An anonymous citizen-complaint was received on December 19, 2019 that a commercial landscape business is being operated on the Cabrera parcel. The Weld County Property Portal shows that SUP-170 encumbers the parcel. Because of the parcel's apparent association with the SUP, it normally would proceed through the probable cause - show cause process to remedy the violation instead of working through the standard code compliance process. As a result, Weld County Planning staff seeks to update the SUP-170 map via a partial vacation to remove the excepted Cabrera parcel from the SUP boundary. Based on the attached property research, it is the opinion of Planning staff that the excepted Cabrera parcel has never been a part of SUP-170 for several reasons. 1) The excepted parcel has been conveyed independently from the feedlot as the past and current feedlot deeds expressly exclude the 1963 parcel from the NE4. 2) The excepted parcel has been historically taxed as "Residential", which further supports that it is not a part of the SUP-170 feedlot. 3) When the feedlot was expanded in 1972, the owner of the excepted parcel was not party to the application and was not named as an applicant in the Resolution. 4) The draft map of SUP-170 from 1972 shows the excepted parcel under separate ownership. On March 25, 2020, Planning staff contacted the owners of the feedlot, being Diamond Land LLC via email to explain the issue and to review the case history. Planning staff asked Diamond Land to submit their approval of the partial vacation and were notified that the partial vacation request would go before the Board of County Commissioners; however, they are not required to attend. On March 26, 2020, Trent Horton, representative of Diamond Land submitted a Letter signed by the property owner that agrees to the partial vacation request. Planning staff drafted the partial vacation map and if approved by the Board, will be recorded with the Weld County Clerk and Recorder. Once the map is recorded, the Cabrera parcel will proceed though the code compliance violation process for the unpermitted business. Memorandum - SUP-170 Page 1 of 1 2020-1211 PL9 PROPERTY HISTORY NE4 6-5-64 December 20, 1962: A metes and bounds parcel was excepted out of the NE4 of 6-5-64 via deed. Beginning at the SE Corner of the NE4 then west 221' then north parallel to east boundary of the NE4 468' then southeast to a point on the east boundary of the NE4 which is 286' north of the SE Corner of the NE4 to the POB Webster Feed Lots, Inc. sold the newly-created excepted parcel to Richard and Esther Hergenreder. August 7, 1963: The excepted parcel from 1962 was expanded 30' further to the west via a corrected deed. No new parcels were created. Beginning at the SE Corner of NE4 then west 251' then north parallel to east boundary of the NE4 468'then southeast 310.28'to a point on the east boundary of the NE4 which is 286' north of the SE Corner of the NE4 to the POB Webster Feed Lots, Inc. re-sold the corrected (expanded) excepted parcel to Richard and Esther Hergenreder. 1964: A single-family residence was built on the excepted parcel per the Assessor's Property Card and Property Report March 13, 1965: Richard and Esther Hergenreder sold the excepted parcel to William & Sharon Hagemeister. May 23, 1968: William & Sharon Hagemeister sold the excepted parcel to Dallas & Pauline Baker. December 24, 1969: SUP-32 was approved by the BOCC for an expansion to an existing use by right feedlot on a four acre portion of the NE4. The applicant was Webster Feed Lots. This USR had no map; only a Resolution. It is unclear where the four acre area encumbered by the feedlot expansion was located. However, it was not located on the excepted parcel. September 11, 1972: SUP-170 was approved by the BOCC for an expansion to the Webster Feed Lots, permitted by SUP-32 from 15,000 to 24,000 head, increased pen area and other improvements. The acreage of feedlot pens increased from approximately 81.6 acres to 118.3 acres. This expansion was to be located on the portion of the NW4 of 6-5-64 located south of the Ogilvy Ditch and the NE4 of 6-5-64. The only applicant was W. H. Webster. However, the excepted parcel, which is also part of the NE4 of 6-5-64, was owned by Dallas&Pauline Baker. The excepted parcel should have been excepted from the legal description of the SUP-170 as the Bakers were not part of the SUP application. Additionally, a draft map found in the SUP file shows the Baker excepted parcel excluded from the feedlot area. In error, the entire NE4 of 6-5-64 was encumbered by the SUP. No recorded SUP map was found. April 28, 2000: Dallas & Pauline Baker sold the excepted parcel to Shaun Hafley. May 30, 2013: Shaun Hafley sold the excepted parcel to David Berardi. November 30, 2016: David Berardi sold the excepted parcel to Taurino Martinez Cabrera. December 19, 2019: A citizen-initiated complaint was received about an unpermitted landscape business on the excepted parcel owned by Taurino Martinez Cabrera. December 31, 2019: An inspection by Planning Staff, substantiated the complaint and documented the unpermitted landscape business. H. Webster, Route 4, Box 164A, Greeley, Colorado, requesting permission for expansion of an existing cattle feed lot operation on the following described property, to-wit: The Northeast Quarter (NE4) of Section Six (6), Township Five (5) North, Range Sixty-Four (64) West and the Northwest Quarter (NW4) of Section Six (6), Township Five (5) North, Range Sixty-Four (64) West of the Sixth P.M., Weld County, Colorado, and WHEREAS, the petitioner was present and represented by counsel, and WHEREAS, there was some opposition to the request of petitioner for the expansion of said cattle feed lot operation, and WHEREAS, the said requested cattle feed lot operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said cattle feed lot operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner, and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of W. H. Webster, Route 4, Box 164A, Greeley, Colorado, for expansion of an existing cattle feed lot operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to expand said cattle feed lot operation and shall have up to one year from date hereof to begin construction for the expansion thereof. 3. That when expansion of said cattle feed lot is completed, same shall not contain more than 24, 000 head at any one time. 4. That petitioner shall construct sealed lagoon or lagoons as proposed. 5. Subject to a greenbelt being established at least 200 feet wide along State Highway No. 263 thus screening off such roadway with a suitable type of vegetation. PL0609 79(1114 • 6. Subject to only one road entrance onto the property from State Highway No. 263. 7. Subject to a 20 foot road right of way dedicated to Weld County for road purposes along County Road No. 49. 8. Subject to said feed lot facility being located not less than 660 feet from State Highway No. 263 in accordance with Section 3.3-A (2) (B) of the Zoning Resolution of Weld County. • 9. All applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Planning staff has identified the need for the partial vacation of SUP- 170 for a 24k head feed lot. Staff contacted the property owner, being Diamond Land, LLC, and they agreed to the partial vacation, see attached. SUP-170, approved in 1972, erroneously encumbers a separate property that was never part of the feed lot.The partial vacation will pull back the SUP from that other parcel, owned by Taurino Cabrera, which is violation, so that the feed lot SUP is not affected. Regarding our conversation earlier,SUP-170 for a 24k head feedlot extends over an adjacent parcel owned by Taurino Martinez Cabrera.The Cabrera parcel has an unpermitted business on-site. In order to proceed with a violation on the Cabrera parcel,a partial vacation of the SUP is needed to remove the SUP boundary from the Cabrera parcel. It is the opinion of Planning staff that the 2.17-acre excepted parcel, created in 1963 and now owned by Cabrera, is not a part of SUP-170 for several reasons: 1)the excepted parcel has been conveyed independently from the feedlot and the past and current feedlot deeds expressly exclude the Cabrera parcel from the NE4. 2)the excepted parcel has been historically taxed as "Residential",which further supports that it is not a part of the SUP-170 feedlot. 3)when the feedlot was expanded in 1972,the owner of the excepted parcel was not party to the application and was not named as an applicant in the Resolution. See the attached chronological property research timeline for detailed information. In order to proceed with a partial vacation,the property owner that holds the SUP being Diamond Land, must request in writing that they agree to the partial vacation of SUP-170 from the excepted parcel. Once the partial vacation request is submitted, Planning staff will work with Diamond Land to complete a partial vacation map.This map will show the before and after boundary of the SUP and will be recorded with the Weld County Clerk and Recorder. Once the map is recorded,the Cabrera parcel will proceed though the code compliance violation process. Per Section 23-2-280.B of the Weld County Code-Changes to a Special Review Permit: "Any decrease in the land area occupied by a Use by Special Review Permit shall qualify the landowner to be able to request a partial vacation of the Use by Special Review from the Board of County Commissioners". After staff discussion,the Planning Department will present the request before the BOCC using your request letter as evidence that you approve of the action. You do not have to attend the hearing and there is no fee to this process. Please let me know if you have any questions. I will keep an eye out for your emailed response, giving Planning staff permission to proceed with a partial vacation of the SUP.
