RESOLUTION
WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a proposed sale of a
tract of land more particularly described as follows, to-wit:
A parcel of land located in the Southeast Quarter of the
Southwest Quarter of the Northeast Quarter (SEISWINEI)
of Section Twenty-Eight (28), Township Two (2) North,
Range Sixty-Eight (68) West of the Sixth P. M. , Weld
County, Colorado, and more particularly described as
follows:
Beginning at the Southeast Corner of the Southwest
Quarter of the Northeast Quarter of said Section Twenty-
eight (28), thence West along the one half section line
of said Section 28 to a point on the East side of the Lower
Boulder Ditch where it crosses said one half section line
of said Section 28; thence Northeasterly along the
boundary of said Lower Boulder Ditch to a point on the
East line of the Southwest Quarter of the Northeast
Quarter (SWINE+) of said Section 28; thence South along
the East line of the Southwest Quarter of the Northeast
Quarter (SWINE+) of said Section 28 to the point of
beginning, containing four (4) acres, more or less
by Jack A. Mleynek and Helen F. 1VIleynek does not come within the
purview of the definition of the terms "subdivision" and "subdivided
lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as amended, and
WHEREAS, the Board of County Commissioners of the County
of Weld; State of Colorado, desires to exempt this particular division
of land upon the recommendation of the Weld County Planning Director
for the reasons as stated and pursuant to its authority under CRS
106-2-33(d), 1963, as amended,
NOW, THEREFORE, BE IT RESOLVED, that the proposed sale
of the hereinabove described tract of land by Jack A. Mleynek and Helen
F. Mleynek be exempted from the definition of the terms "subdivision"
and "subdivided land" as provided for in the new Weld County Subdivision
Regulations at Section 2-1, A. , (3) adopted August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the j2d day of December,
A. D. , 1973.

Dear Sirs:
My wife and I live on a 200 acre farm three miles south of Rinn
Community which we bought in 1967. Besides the usual outbuildings
the farm has two older houses, one of which has been our residence
since buying the farm. Due to some reorganization within the
company I work for it appears we may need to move from this area
within the next year. Should this happen we do not wish to sell
the farm but would like to sell the house we have been living in
along with two adjoining horse corrals and two acre pasture in
order to get some cash to help us relocate in a new community.
We do not want to rent this house because of the time and main-
tenance required on an older house such as this and there is still
the second house available for our lessees. Besides this we feel
that private owners would take better care of the house than renters.
The house and acreage is located in the southeast corner of the
north quarter section and is naturally separated from the rest of
the farm by the Lower Boulder ditch which also makes the ground
unsuitable for farming because of its small size . The house has
Left Hand Water, septic tank, and 30 ft , easement to it from County
Road #7.
We are seeking an exemption because last year, not expecting to be
transferred by my company, we sold a five acre piece of marginal
farm land on the south side of the property to a friend for which
we of course had to apply for a minor subdivision. Since doing
that the only way in which we can sell the extra house and land
is by obtaining an exemption from you. I realize that we are
requesting rather special treatment but because of the unforseen
circumstances causing our possible relocation to another community
and because we feel that the exemption would place no additional
demands on local utilities, schools or communities or remove any
farmland from production we are requesting that this exemption
be granted in order to ease some of the costs of our relocation.
