At a Regular Meeting of the Town Board of Trustees, held on August 12, 2020, action was taken adopting Resolution 2020-09, to set the review with the Planning Commission on Wednesday, September 2, 2020, 6:00 p.m., and set a public hearing for Wednesday, September 16, 2020 at 7:00 p.m. at Ault Town Hall Council Chambers, 201 First Street, Ault, CO, to receive evidence and determine whether the proposed annexation meets all legal requirements and is in the best interests of the Town of Ault, and to consider the Initial Zoning. So(ns),PI- TP), cMQ4w/Mtt/TP), pw(ER/cH/SS/EP), ASR(DKtsG), £ i5(5(,) 09 /03/20 2020-2730 TOWN OF AULT RESOLUTION NO. 2020-09 A RESOLUTION FINDING THE PETITION FOR ANNEXATION SUBMITTED BY PROPERTIES AULT LLC., TO BE IN SUBSTANTIAL COMPLIANCE WITH C.R.S. 31-12-107 AND SETTING A HEARING BEFORE THE BOARD OF TRUSTEES TO CONSIDER ANNEXATION WHEREAS, a written petition has been filed with the Town Clerk requesting the annexation of certain property to be known as the United Ready -Mix Annexation and WHEREAS, the Board of Trustees for the Town of Ault desires to initiate annexation proceedings in accordance with the Municipal Annexation Act, Section 31-12-101, et seq., Colorado Revised Statutes; and WHEREAS, the Board of Trustees must set a public hearing to determine if the proposed annexation complies with the Town of Ault Land Use Code. IT IS THEREFORE RESOLVED by the Board of Trustees of the Town of Ault, Colorado, this 12th Day of August, 2020, as follows: 1. That the Board hereby accepts the annexation petition for the United Ready -Mix Annexation. 2. That the Board hereby finds and determines that the annexation petition is in substantial compliance with the requirements of C.R.S. 31-12-107(1), Section 30 of Article II of the Colorado Constitution in that the annexation petition contains the following: (a) An allegation that it is desirable and necessary that such area be annexed to the municipality; (b) An allegation that the requirements of Colorado Revised Statutes sections 31-12- 104 and 31-12-105 exist or have been met; (c) An allegation that the signers of the petition comprise more than fifty percent of the landowners in the area and own more than fifty percent of the area proposed to be annexed, excluding public streets and alleys and any land owned by the annexing municipality; (d) The signatures of such landowners; (e) A request that the annexing municipality approve the annexation of the area proposed to be annexed; (f) The mailing address of each such signer; (g) The legal description of the land owned by such signer; (h) The date of signing of each signature; and (i) The affidavit of the circulator of such petition that each signature therein is the signature of the person whose name it purports to be. 3. That the Board of Trustees fmds and determines that the annexation map accompanying the annexation petition for the United Ready -Mix Annexation is in substantial compliance with the Municipal Annexation Act in that the map contains the following: (1) A written legal description of the boundaries of the area proposed to be annexed; (2) A map showing the boundary of the area proposed to be annexed; (3) Within the annexation boundary map, a showing of the location of each ownership tract in unplatted land and, if part or all of the area is platted, the boundaries and the plat numbers of plots or of lots and blocks; (4) Next to the boundary of the area proposed to be annexed, a drawing of the contiguous boundary of the annexing municipality and the contiguous boundary of any other municipality abutting the area proposed to be annexed. 4. That the Board of Trustees desires to initiate annexation proceedings in accordance with law. 3. That the Notice attached be adopted as a part of this Resolution. The Notice establishes the date, time, and place a public hearing will be held to determine if the proposed annexation complies with section 30 of article II of the Colorado Constitution and sections 31-12404 and 31-12-105 of the Colorado Revised Statutes or such provisions thereof as may be required to establish eligibility under the terms of the Act. The Town Clerk is directed to publish a copy of this Resolution and Notice as provided in the Act. DULY PASSED by the Board of Trustees this 12th Day of August, 2020. Rob Piotrowski., Mayor Annexation Assessment Report for United Ready Mix Annexation Properties Ault, LLC ("Applicant") is submitting this application for annexation of the property located at 15415 Highway 14, Ault, CO 80610 ("Property") into the Town of Ault ("Annexation"). The Applicant currently leases the property to United Ready Mix for use in its batch concrete operations. The Applicant's desire to be annexed into the Town of Ault is dependent on approval of this application to have the Property zoned as Industrial to allow for continued use of the Property for batch concrete operations. Granting this Annexation application will have little, if any, negative impact on the infrastructure of the surrounding area and the Town of Ault. The Property has been used for batch concrete operations under a Use by Special Review permit since October of 2005. The Property is located in the vicinity of other annexed land which is also zoned for industrial use. The nature of the surrounding properties and the planned continued use of the Property as a concrete batch plant should pose no conflict or create an additional burden on the community and existing services and facilities of the Town of Ault. No significant increase in the burden on public facilities and services is anticipated at this time. The Property currently has water, gas, electric and phone services. The Property uses a septic system in lieu of sewer. Traffic patterns will remain consistent in the area and the current operations on the Property have not resulted in increased burden on roadways, transit, or impeded access to any properties in the area. Long term plans involve considerations for encouraging independent haulers to pick up concrete on the property. This should have little impact on the traffic pattern and roadways as the only variance would be the entity which performs the transport and not the number of transports occurring. There will however be significant benefit to the Town of Ault by annexing in the Property. Ault will benefit from this annexation by way of crucial tax dollars that will begin being directed to the Town of Ault instead of only to Weld County. There is also a potential for increased revenue as United Ready Mix LLC considers increasing their operations through the sale of tools and encouraging independent haulers to purchase and pickup the concrete products at the Property resulting in increased sales tax within in the Town of Ault.
