Dear Commissioners:
I have reviewed the application for the Amen Aggregate Resources USR2O-0008 and have the
following comments;
1. I have communicated with Mr, Dick Coulson on a few occasions concerning the Reorganized
Farmers Ditch Company. I regard Mr. Coulson a person of good character and one that would
work to address any concerns that surrounding residents may have about the Amen Aggregate
Resource Mining Operation and Hot Mix Asphalt Plant. In my opinion, he is old school, his word
and handshake are all you need.
2. Noise
In the application I noticed the noise modeling was calculated on 220 heavy vehicles and 34
light vehicles and other equipment that is part of the mining operation, However, under the
Traffic document the calculations used were 430 vehicle trips per day. Why the difference in
vehicle numbers? Shouldn't these vehicle numbers be similar for each category.. Noise and
Traffic?
3. Noise Compliance
a. There is no issue if the mining operation and asphalt plant adhere to #1. HMA operates
during daytime hours 7 am to 6 pm, the hours noted in the application document. Not 7 pm.
b. Put in place a 20 ft or higher tall berm that reduces the noise level to the residents living
north of the facility.
c. Adheres to Table 2 of the Noise Document.

d. Has a "Hotline" phone number to call if there are issues.
3. Dust
The fugitive dust represents all sizes from PM2 to PM 10. The environment around the
proposed facility commonly has daily -sustained winds ranging from 5 to 36 mph with gusts up
to 61 mph record during the last two years. Regarding dust and odors from the facility,
southern winds represent about 21% of the wind direction which hopefully would have a
minimal affect on residents north of the facility. One recommendation would be to curtail work
at the facility if winds exceed a certain speed and direction towards the north residents.
4. Trees
Appears in Cell 1 that trees that are adjacent to the Hill and Brush Ditch will not be removed.
However, a recommendation would be to leave those trees (see below) so that they help to
buffer noisereduce fugitive dust and still make the site aesthetically pleasing.
Asphalt Plant
I would like to note that the HIM Plant that Mr. Coulson plans to move to the site from another
location does not seem to be invasive from a standpoint of size and emissions. Should thing
change relative to size or appearance then there should be an opportunity for residents to
review and comment.

with the permit. The notice for this hearing stated:
A Site Specific Development Ran and Use by Special Review for open mining (sand, gravel and
stone) and processing of minerals, an asphalt plant, including the importing of materials
associated with an asphalt batch plant, recycling of asphalt, mine office/scale house and scale,
a fueling/lubricating station, portable generators, mobile mining equipment parking and storage
and employee and vendor parking in the A (Agricultural) Zone District
The Department of Planning Services is requesting the request be modified to
A Site Specific Development Plan and a Special Review Permit, U R2O-0008, for open mining
(sand, gravel and stone) and processing of minerals, with ancillary operations and equipment

Over the weekend, I have developed a sinus infection which I am prone to this time of year and
is likely due to environmental conditions. I do sound like I have a cold Depending on how I

My thought was, one of my team could operate PowerPoint while I narrate via speakerphone

Development Standard No. 3 states
All sand and gravel operations shall be conducted during the hours of daylight except in the case
of a declared emergency disaster or in the case of a declaration requiring night construction,
public or private emergency, or to make necessary repairs to equipment. This restriction shall not
apply to operation of administrative and executive offices or repair facilities located on the
property. (Department of Planning Services)
Proposed New Language:
All sand and gravel operations shall be conducted during the hours of 7:00 a.m. to 7:00 p.m. (to
accurately reflect the Coulson Excavating Company, Inc. and Croissant Family Farm, LLC
operations plan) except in the case of a declared emergency disaster or in the case of a
declaration requiring night construction, public or private emergency, or to make necessary repairs
to equipment. This restriction shall not apply to operation of administrative and executive offices or
repair facilities located on the property. (Department of Planning Services)
Comment: Weld County Code, chapter 23, Article IV, Division 4, Section 23-4-290 Operations
policies, states: The policies outlined below represent a minimum model for operations standards
for the proposed use. Stricter standards may be imposed by the Board of County Commissioners
during the review process to ensure the protection of the health, safety and welfare of the
inhabitants of the County.
Section 23-4-290.0 states: "All sand and gravel operations shall be conducted during the hours of
daylight except in the case of public or private emergency, or to make necessary repairs to
equipment. This restriction shall not apply to operation of administrative and executive OFFICES
or repair facilities located on the property. Upon request, the Board of County Commissioners may
authorize additional hours of operation for sand and gravel operations when the Board deems
appropriate."
Development Standard No. 4 states
The number of on -site employees shall be up to thirteen (13). (department of Planning Services)
Proposed New Language
"The number of on -site employees is anticipated to be thirteen (13)."
Comment: Weld County Code, Chapter 23, Article II, Division 4, section 23-4-260 Application
requirements, states: "A detailed description of the proposed operation and use shall be supplied
Details for the following items, when applicable, are required.}"
Section 23-4-260.C.3 states "The number of shifts to be worked and the maximum number of
employees." The Planning Department requests an upstand limit number for employees as this

number may also impact issues associated with Public Works and Environmental Health
requirements. If the approximate number is anticipated to be thirteen (13), perhaps better to have
a greater number as in not to exceed fifteen (15) employees. For permitting purposes, Weld
County Planning seeks absolutes.
Development Standard No. 13 states
The access to the site shall be maintained to mitigate any impacts to the public road, including
damages and/or off -site tracking. (Department of Public Works)

including damages and/or off -site tracking.
Comment: Weld County Code, chapter 23, Article II, Division 4, section 23-4-240 Design
Standards, states: An applicant for a Use by Special Review shall demonstrate compliance with
the following design standards in the application and shall continue to meet these standards if
approved for development,
section 23-2-250.A.8 and A.9 state:
A.8 states: The access shall be located and designed to be safe; ingress and egress shall not
present a safety hazard to the traveling public or to the vehicle accessing the property. For uses
generating high traffic volumes and large number of large, slow -accelerating vehicles, acceleration
and deceleration lanes may be required to mitigate a potential traffic hazard.
A.9 states: New accesses to public rights -of -way shall be constructed in accordance with this
Code.
The Department of Public Works is deferring to the County Attorney for a determination of the
implications that may result with the removal of the word "any" from the accepted Development
Standard.
Development Standard No. 20 states
The historical flow patterns and runoff amounts on the site will be maintained. (Department of
Public Works)
Proposed New Language:
The historical flow patterns and runoff amounts at the site boundaries will be maintained.
Comment: Weld County Code, Chapter 8, Article XI addresses Storm Drainage Criteria. Section 8-
11-100,A.1 states "Detention ponds shall be sized to store the stormwater runoff generated by the
1 -hour, 100 -year storm falling on the developed site and release of the detained water at the
historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for urbanizing areas
and the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for non -
urbanizing areas. Historic is defined as an undeveloped site with a 2.0% imperviousness.,"
Section 8-11-100.A.5 states "Outlet works should be sized and structurally designed to release at
no more than the 1 -hour, 5 -year historic release rate in urbanizing areas and 1 -hour, 10 -year
historic release rate in non -urbanizing areas without structural or hydraulic failure. Historic is
defined as an undeveloped site with a 2.0% imperviousness.11
The proposed modification is language does not meet the criteria for Storm Water Drainage as
outlined in Chapter 8 of the Weld County Code.

Sources of light should not cause a nuisance or interfere with the use on the adjacent properties in
accordance with the map. Neither the direct, nor reflected, light from any light source may create a

standards affect location, layout and design of the Use by Special Review prior to construction and
operation. Once operational, the operation of the uses permitted shall conform to these standards.
Section 23-2-250.D.1 and D.2 state:
The uses shall comply with the following lighting standards:
1. "Sources of light, including light from high -temperature processes such as combustion or
welding, shall be shielded so that light rays will not shine directly onto adjacent properties
where such would cause a nuisance or interfere with the use on the adjacent properties;
and
2. Neither direct nor reflected light from any light source may create a traffic hazard to
operators of motor vehicles on public or private streets/roads and no colored lights may be
used which may be confused with or construed as traffic control devices."

working as a consultant for Coulson
Excavating Co., Inc. for over 20 years
specializing in the permitting and
compliance of their sand & gravel
operations in Larimer and Weld Counties.

some of the key planning and technical
aspects of the project and how those
aspects will contribute to compliance with
the County's Development Standards.

and close to the best access point.
A traffic Study for the project was
conducted by LSC Transportation
Consultants, Inc. Chris McGranahan P.E. has
certified the report and can be available by
phone to answer any questions.
bThe site access on CR13 will be improved to
include a south sound left turn lane
During the first 2 years of the project, Pit
run will be imported from the Stroh Pit in
Larimer County for processing and feed for
the HMA plant. This phase will generate
about 430 vehicle trips per day.
During the remainder of the project , the
site will generate about 270 vehicle trips per
day

scenarios" as model inputs.
The study predicts the noise generated by
the site will be in compliance with County

A Dust Control Plan was developed .for the
site. The control measures identified in the
plan are also specified in the APEN and
Construction Permit Application submitted to
the CDPHE.
Aside from the standard dust control
measures including watering, revegetation
etc. Notable dust control strategies for this
project include the use of conveyors and the
absence of scrapers.
Technically, reclamation is the jurisdiction of
the Mined Land Reclamation Board,
however it is often of interest to the local
community.

lined water storage ponds.
The ponds include engineered flood control
spillways to route significant flood events
through the ponds to prevent stream
capture.
