Although some of the elected municipal officials may be out of office after the April elections, it appears best that the present municipal representatives be reappointed . If there are vacancies after the April elections, then new representatives can be chosen. The "citizen interest" need not be and probably should not be all from the county planning commission. Enclosed is a copy of the HUD requirements . Policy bodies not already meeting the requirements in 7-c(2) which become effective October 1, 1971, must submit documentation at the time of certifi- cation indicating the steps to be taken to meet at least those minimum requirements by the time of the next certification. (4) Initial Certification. Initial certification may be granted an APO not previously certified and whose by-laws , charter, articles of incorporation or other organizational documents must be amended in order to permit compliance with the policy body representation requirements of 7-b(2) , above, provided that at the time of initial certification the APO submits to the HUD Area Office : (a) copies of such documents with the sections to be amended referenced, and (b) a statement of the steps to be taken to comply with these requirements. Certification may be withdrawn at the end of 180 days of the certification period if the policy body is not constituted in accordance with the j requirements of 7-b(2) . c. Policy Body Composition. (Minimum Requirements for !, Certification or Recertification Effective Octiber 1; 1971) (1) Area Representation. The policy-making body of the APO must include representatives of units of general local government which, in aggregate, have within their jurisdiction not less than 75 percent of the population of both_ the short-range planning area and the entire AP.l, and membership is the APO must be open to all units of general local government within the AP,1. The APO's j comprehensive planning program must encompass conditions , trends and needs of the entire AP.l. (2) Representation on Policy Body. Except where specifically prohibited by State law:l/ (a) Local Government. At least two thirds of the voting membership of the policy-making body of the APO shall be composed of or responsible to the elected officials of a unit or units of general Local government within the APS. Such persons include mayors, city or county managers, city councilmen, or others of similar rank and breadth of responsibility. 1/ If an APO believes that these representation requirements cannot be achieved because specifically prohibited by State law, copies of / such State law must be submitted to the HUD Area Officd . Page 9 7/70 HUD-Wash., D. C. MPD 6415.1A , i i I (b) Citizen Interests. The policy-making body of the APO must meet the citizen interest representation provisions set forth in 6-e(2) (b) . (c) Executive Committees. Executive committees or similar groups must meet the provisions set forth in - 6-e(2) (c) . (3) Initial Certification. Initial certification may be granted an APO not previously certified and whose by-laws, charter, articles of incorporation or other organizational documents must be amended in order to permit compliance with the policy body representation requirements of 7-c(2) , above, provided that at the time of initial certification the APO submits to the HUD Area Office: (a) copies of j such documents with the sections to be amended referenced, and (b) a statement of the steps to be taken to comply with these requirements. Work Program, Funding and Staff Resources (Requirement) A prospective APO must show evidence that an acceptable comprehensive planning annual work program (as described in paragraph 13) covering a period of not less than twelve months has been adopted-1/ by it and that adequate fund and staff resources are or will be available to carry out such a program. The HUD Area Office will in no case certify an SMSA-based APO which does not have at least a full-time administrator or director who is directly employed by and responsible to said organization. e. Equal Employment Opportunity (Requirement) At the end of the first 180 days of the certification period, documentation must be submitted to the HID Area Office indicating action being taken in establishing and implementing an "Affirmative Action Program" in accordance with paragraph 6-d as required for recertification. 1/ "Adoption" as used in this context, and the remainder of this Circular, means formal action taken by the APO to indicate acceptance as APO policy. 7/70 Page 10 HUD-Wash., D.C.
