The purpose of the hearing is Qdcn cs1de an application from Continental Oil Company to amend the Permit k: ' ubsurface Disposal, dated November 9, 1973, issued to Continental Oil ompany and CER Geonuclear Corporation by the Water Quality Control Division, for the operation of a subsurface disposal system in connection with the testing of the RB-E-01 nuclear stimulated well, in Section 14, Township 3 South, Range 98 West, Rio Blanco County, Colorado and providing for the discharge of wastes underground from 5,600 to 6,072 feet subsurface, so as to (i) increase the permitted total volume to be injected from 24,000 barrels to 34,000 barrels; (ii) provide a limit of 450 curies in the radioactive contents of all permitted wastes in place of the permit limit of 0.05 micro Ci/ml; and (iii) extend the permitted discharge period beyond November 10, 1974. The Commission is to determine (i) whether waters of the State will he polluted by the proposed activity or (ii) if waters of the State may be polluted thereby, whether such pollution will be limited to waters of a specified limited area from which there is no risk of significant migration and that the proposed activity is justified by public need. A prehearing conference will be held August 20, 1974, at 9:00 A.M. at 4210 E. 11th Avenue, Denver, Colorado in the office of the Techni- cal Secretary to the Commission. The purpose of this conference is to con- sider any matters which will simplify the issues and aid in disposition. Any person who desires to appear as a party to the proceeding pursuant to CRS 66-28-401(3) and CRS 3-16-4(2) is requested to file his request prior to August 20, 1974. The authority for the Commission to hear, consider and approve or disapprove said application is contained in sections 66-28-202, -401, and -505, Colorado Revised Statutes as amended in 1973.
