Executive Director NOTICE OF FINAL ADOPTION Pursuant to the provisions of Section 3-16-2 (11) (K) , Colorado Revised Statutes , 1963 , as amended NOTICE is hereby given that on April 16 , 1974, the Colorado Water Quality Control Commission adopted certain rules subsequent to a public hearing held pursuant to and in accordance with due and proper legal notice. The Commission, after hearing all interested persons present adopted the rules captioned as follows : REGULATIONS FOR THE CONTROL OF WATER POLLUTION FROM FEEDLOTS A copy of said rules , as adopted by the Commission, is attached and made a part of this Notice . The legal authority for the Commission to adopt the rules is contained in Sections 3-16-2 , 66-28-201 , and 66-28-205 , Colorado Revised Statutes , as amended . Te cal Secretary Water Quality Con of Com salon 740500 a 7/ 7' COLORADO DEPARTMENT OF EALTH Water Quality Control Commission As Adopted : April 16 , 1974 Effective: August 1, 1974 REGULATIONS FOR THE CONTROL OF WATER POLLUTION FROM FEEDLOTS Authority: Articles 66-28-205 , 66-28-206, and 66-28-207 (c) , CRS , as amended , 1963 . DEFINITIONS : 1. The term "feedlot" means a concentrated , confined animal or poultry growing operation for meat , milk or egg production or stabling, in pens or houses wherein the animals or poultry are fed at the place of confinement and crop or forage growth or production is not sustained in the area of confinement . 2 . The term "operator" means any individual , partnership , or cor- poration, or association doing business in this state . 3. The term "process wastewater" means any process generated waste- water and any precipitation (rain or snow) which comes into con- tact with any manure , litter , or bedding, or any other raw materi- al or intermediate or final material or product used in or result- ing from the production of animals or poultry or direct products (e. g. , milk, eggs) . 4 . The term "State waters" means any and all surface and subsurface waters which are contained in or flow in or through this state , except waters in sewage systems , waters in treatment works of disposal systems , waters in potable water distribution systems , and all water withdrawn for use until use and treatment have been completed . 5 . The terms "ten-year twenty-four-hour storm" and "twenty-five- year twenty-four-hour storm" mean a storm of a 24-hour duration which yields a total precipitation of a magnitude which has a probability of recurring once every ten or twenty-five years , respectively, as shown in Annex A. REGULATIONS : 1. An operator of a feedlot shall not discharge process wastewater and storm run-off water from the feedlot to state waters except as the result of storms in excess of precipitation as defined below: a. Existing facilities : 1) The operator shall provide and operate all REGULATIONS FOR THE ( TROL OF WATER POLLUTION FROM FEEDLOTS As adopted: April 16, 1974 Effective: August 1, 1974 wastewater control facilities as necessary to re- tain without discharge to state waters all process wastewater pollutants produced by the feedlot and all storm runoff which enters the feedlot as the result of precipitation equal to the amount result- ing from a ten-year twenty-four-hour storm. 2) The manner of disposition of the retained wastewater is the responsibility of the operator , but where land disposal of this water is employed , the operator shall provide and operate a waste disposal system capable of restoring the retention requirements of conditions 1) above, within 15 days after such precipitation events , unless impeded by inclement weather. 3) The authorized discharge resulting from the precipita- tion events that are in excess of condition 1) above, shall be as the result of excess flow or over flow be- yond the retention capability of the wastewater con- trol facilities . This authorization shall not permit a discharge from the feedlot due to dewatering or lower- ing of the wastewater level below the design retention capability of the wastewater control facility. b . New facilities : 1) The operator shall provide and operate all wastewater control facilities as necessary to retain and dispose without discharge all process wastewater pollutants produced by the feedlot and all storm runoff which enters the feedlot as the result of precipitation equal to the amount resulting from a twenty-five year twenty-four-hour storm. Executive Director NOTICE OF PUBLIC HEARING BEFORE A HEARING OFFICER FOR THE COLORADO WATER QUALITY CONTROL COMMISSION Pursuant to the provisions of sections 3-16-2, 66-28-202, 66-28-205, 66-28-207, and 66-28-402, Colorado Revised Statutes 1963, as amended NOTICE is hereby given that public hearings will be held under the authori- ty of the Colorado Water Quality Control Commission on a proposed control regulation titled CONCERNING THE DRILLING OF WELLS This proposed regulation is designed to protect the waters of the state against pollution or degradation resulting from the drilling of wells, from the inter- connection of subsurface formations and aquifers, and from the interconnection of subsurface formations and aquifers with the surface by requiring notifica- tion to be given to the state of certain drilling activities and by requiring those undertaking such activities to take precautionary measures and to file reports of work performed. This proposed regulation is not intended to require an agency permit, certifi- cate, approval, registration, charter, membership, statutory exemption, or other form of permission prior to drilling. (Caution: it is also not intended to relieve a would-be driller of the obligation to secure such licenses as might be required by other regulations or by statute) . The purpose of the hearings is to provide opportunity for interested persons to submit written and oral data, views, and arguments on these proposals. Written data may be submitted prior to as well as at the hearing. The Colorado Water Quality Control Commission encourages public participation so that it may have the benefit of the views and experience of the people of the state as to the effects of the proposal and as to any modifications thought desirable by in- terested persons. (Any person desiring to take a part in the hearings more ex- tensive than submitting written and oral data, views, and arguments is advised to consult 66-28-402, C.R.S. , 1963 as amended) . The views and data so submitted will be taken into consideration by the Commission prior to rewriting the pro- posals to final form for adoption as a control regulation. AUTHORITY: This regulation is promulgated by the Water Quality Control Commission pursuant to the following authority: Section 66-28-102, 66-28-202, 66-28-205(and in particular subsection (1 )(c) and (2)(g) ), and 3-16-2, C.B.S. (1963, as amended through 1973). 2. PURPOSE: This regulation is designed to protect the waters of the State against po ution or degradation resulting from the drilling of wells, from the interconnection of subsurface formations and aquifers, and from the connection of subsurface formations and aquifers with the surface by requiring notification to be given to the state of certain drilling activities and by requiring those undertaking such activities to take precautionary measures. 3. DEFINITIONS: (1 ) "Administering Agency" shall mean the division of water resources of the state department of natural resources. (2) "Driller" shall mean the person directly in charge of the well drilling operation which is the subject of notification. (Such a person may be an employee of the owner or an independent contractor. ) (3) "Owner" shall mean the person on whose behalf the well drilling operations are to be conducted. (4) "Person" may mean an individual , a partnership, a joint venture, a corporation, or such other legally recognized association or organization. (5) "Registered Area" shall mean that area, not including more than six sections of land, in which a person making notification proposes to conduct well drilling operations. (6) "Well" shall mean any pit or hole drilled in the earth for the purpose of discovering, delineating, evaluating, or exploiting the mineral , water, geothermal or any other properties of the earth. (7) "Drill" shall mean the construction of a well by any means. 4. Both the owner and the driller of each well shall take all measures reasonably necessary to insure that the well is constructed and protected in a manner sufficient to prevent pollution of groundwaters and surface waters. 5. The owner of a well shall fill , plug, or seal the well when it is not in use or when it is abandoned, in a manner sufficient to prevent pollution of groundwaters and surface waters. July 11 , 1974 Proposed Control Regulation - Concerning the Drilling of Wells 6. Subsections 7 through 12 of these rules shall not apply to: (1 ) Wells whose depth is less than 3,000 feet and which satisfy the following conditions: (a) The owner is also the owner of the surface estate upon which the well is located; and (b) The purpose of the well is to appropriate groundwater for beneficial use. (2) Wells drilled for the purpose of producing oil or gas and for whose drilling the approval of the Director of the Oil Gas Conservation Commission is secured pursuant to the "Rules and Regulations , Rules of Practice and Procedure" , promulgated by the Oil and Gas Conservation Commission of the State of Colorado and as amended from time to time. 7. No person shall drill a well nor rework any abandoned or plugged well unless notification thereof has been given to the administering agency. 8. Notification of intent to drill or rework a well or to conduct drilling operations within a given registered area shall be made by the owner upon a Form designed by the administering agency. Such notification shall contain at least the following information (and the form by which notification is made shall indicate the information required) : (a) The name, phone number, and address of the owner (and also the name and address of the owner's registered agent if the owner is a corporation); (b) The name, phone number, and address of the driller (and also the name and address of the driller's registered agent if the driller is a corporation); c) A statement of the relationship between the driller and the owner i .e. such as , the driller is an employee of the owner; the driller is an independant contractor with whom the owner hag contracted for the drilling of the hole; etc. ); (d) A description of the location of the well to be drilled or reworked, or a description of the boundaries of the registered area. Such description shall include the quarter-quarter section, the section, range, township, and county; (e) A description of the proposed drilling program. Such Description shall include a statement of the purpose of the drilling, the maximum number of wells and the maximum depths anticipated, the number and type of drilling units to be utilized, and the approximate diameter of each well . 9. Each person making notification hereunder shall , prior to conducting any well drilling operation, either: - 2 . July 11 , 1974 Proposed Control Regulation - Concerning the Drilling of Wells (1 ) file with the administering agency a performance and compliance bond in the amount of $10,000 secured with a corporate surety authorized to do business in the State of Colorado conditioned that the drilling operations which are the subject of the notification will comply with the laws of theState or Colorado, wif the regulations of the Water Quality Control Commission, and with drilling, plugging and abandon- ment requirements of the administering agency, and conditioned that neither the wells drilled nor the drilling operations will pollute the waters of the state, or will degrade the quality thereof contrary to the Water Quality Control Act of 1973, or contrary to the rules or orders promulgated thereunder; or (2) Maintain such a performance and compliance bond so conditioned for all of the drilling activities conducted by the person making notificatfonin the amount of $25,000. 10. Within 60 days after the completion of the drilling program, or within such greater time period specified by the administering agency, the owner shall file with the administering agency a report of the work performed. Such a report shall be signed by the driller and the owner and shall consist of: (a) a drill record, a map showing the location of the registered area and the location of each well therein, the identifying number assigned to each well , a lithologic log of each well showing in addition to the lithologic data, the date of the drilling, the diameter of the well and the depth drilled, and, if water is encountered, the static water level . (b) a plugging and abandonment report stating the manner in which the wells were plugged and the materials used. 11 . Upon the written request of the owner, the administering agency shall deny the right of public inspection of those portions of the report which the owner has designated as trade secrets, privileged information, or confidential , commer- cial , financial , geological , or geophysical data furnished by or on behalf of the owner, pursuant to Colorado Revised Statutes 113-2-4 (1963) as amended. 12. The purpose of the hearings is to provide opportunity for interested persons to submit written and oral data, views and arguments on these proposals.
