RESOLUTION RE: APPROVE PAUL COVERDELL FORENSIC SCIENCE IMPROVEMENT GRANT APPLICATION FOR NORTHERN COLORADO REGIONAL FORENSIC LABORATORY 2021 TRAINING AND AUTHORIZE ELECTRONIC SUBMITTAL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with the Paul Coverdell Forensic Science Improvement Grant Application for the Northern Colorado Regional Forensic Laboratory 2021 Training from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Sheriff's Office, to the Colorado Division of Criminal Justice, Office of Adult and Juvenile Justice Assistance, commencing January 1, 2021, and ending December 31, 2021, with further terms and conditions being as stated in said application, and WHEREAS, after review, the Board deems it advisable to approve said application, a copy of which is attached hereto and incorporated herein by reference. These federal funds are provided to each state in the form of a formula grant based upon the number of Type 1 Crimes found within the five partnered agencies associated with the crime lab. The lab has utilized this grant for the past several years to train and certify the analysts. Having examined the needs of the lab and areas where training is needed most, I have identified training opportunities and am requesting funding. Two classes would be for DME (Digital Media Evidence) staff in the areas of cell phone and computer forensics, which would help assist in the reduction of the cell phone and computer backlog. Part of the training request is to fund two analysts to attend ANAB's Lab Accreditation Auditing Class. This course provides analysts with the knowledge and skills to perform internal audits of the lab for quality control. Finally, funds will be used to send two analysts to discipline specific conferences to ensure their knowledge and skills are current with the changes in their disciplines. Training: There is no future cost impact for the training and there is no supplanting of funds with this request. What options exist for the Board? Project Abstract: Summarize your project in the space provided The Northern Colorado Regional Forensic Lab (NCRFL) is a consortium of 5 law enforcement agencies that have combined staff, and along with CBI staff housed in Greeley, to provide forensic services to the Northern Colorado region, primarily to the participating agencies. The lab in conjunction with the CBI was accredited in May 2015 in chemistry, biology -bodily fluid identification, firearms and latent prints. In addition, the areas of Biology -DNA Nuclear and Digital & Multimedia Evidence (DME) were accredited in 2016. The lab is seeking to train forensic scientists in their area of expertise to continue to improve the quality of forensic services to the people of Northern Colorado and address the concerns of the National Commission on Forensic Sciences (NCFS). This training will also include the training of a new DME analyst that will be involved in the processing of electronic devices associated with the illegal distribution of synthetic opioids. 15. Coverdell Purpose Area iri To improve the quality and timeliness of forensic services and to reduce the number of backlogged cases in forensic laboratories ✓ To implement recommendations as adopted by the National Commission on Forensic Sciences (NCFS) to strengthen the forensic science communities 16. We are seeking training funds to expand the knowledge, skills and abilities of the forensic analysts in the NCRFL. We have several new employees that have been added to our lab and so we are seeking the expanding their skills. We also are addressing the concerns of the NAS and P -CAST reports regarding accreditation and certification. The training we are seeking for our staff will expand their current knowledge and skills within their discipline. This will help them in maintaining their certification and for a few it will aid in their certification process. Additionally, the opioid issues are not solely a drug analysis process. The other areas of the lab are vital in the identification and characterization of both users and distributors, so expanding the skills and knowledge of the analysts in their disciplines will also pay dividends in cases related to opioid use and distribution. 17. ACCREDITATION: Based on the state's priorities, applicant agencies must be fully accredited or applying for funds to assist them in their pursuit of accreditation. The NCRFL is fully accredited in all 5 (Drug chemistry, forensic biology, Firearms, (firearms, tool marks, serial number restoration), Latent prints (fingerprints, shoe and tire tracks) and digital multimedia) disciplines since 2016. The NCRFL successfully completed its second assessment in April 2019. 26. PROJECT PLAN: Clearly describe how project activities will be implemented and how the proposed activities will result in the projected outcomes. See instructions for further information. We anticipate that as a result of the cell phone training received an additional 50-75 phones can be processed in the lab. This will reduce the backlog of cases significantly in the DME- computer forensic unit. We also expect that with the reduction in electronic devices we will be able to quickly respond to requests to identify individuals involved in the sale and distribution of illegal drugs ( opioids) as well as the exploitation of children and human trafficking. The DME certification course allow the examiner to better understand where digital evidence will be found and how to extract it and present the findings in court. The ANAB training for the analysts will prepare them to better understand both the quality practices and auditing principles associated with accreditation. Finally, the !AI and AFTE training conferences assists in maintaining the analyst's certification, knowledge and skills. 27. PROJECT OUTCOMES (EXPECTED RESULTS) Describe how this proposed project will positively impact: a) Improvement in quality and timeliness. The training classes chosen were chosen to provide the examiner with the latest technology and ideas in the performance of their work. As they implement any changes, we anticipate that such changes will include those that will make the lab more efficient and improve the quality of the services we provide. One goal of any training class is to provide information and increase awareness of a specific discipline so that an examiner can be better prepared to process evidence. Such as in the case of DME trainings, where the training in mobile forensics and certification will provide our newest examiners a great grasp of the tools and their usefulness in the examination of phones and computers. Our expectation of analysts is to learn and apply what the learn to become more effective, while applying the knowledge to obtain the most they can from the testing they perform. Additionally, they are expected to share the knowledge and skills throughout the discipline. 28. IMPLEMENTATION APPROACH - Explain the implementation approach to be used to accomplish the goals and objectives being proposed. Upon receipt of the funds, the dates for classes will be identified for both the DME courses. We will add a name to the classes listed once funds are released and secure a spot in both the IACIS certification class and the Mobile Forensic class. Both classes typically are offered in the month of May. Upon completion of the course any required competency test will be given. Once that test is completed, they will begin to apply the knowledge and skills learned to forensic case work. For the ANAB internal audit courses, we will work directly with ANAB to set up a date in 2021 to attend the classes. The course provides instruction and understanding in 17025:2017 and how to apply the ISO standard in the review/audit process back at the lab. Once the courses are complete analyst can conduct internal audit to assist the lab in the quality review process. For the two latent print analysts; we will identify a class specific for the need of each of the two latent print analysts. They will register and attend and complete any requirement of the class. These classes will be required to serve as part of their continuing education for certification or recertification. The IAI conference will provide continued education for a latent print examiner. This is critical to maintaining their certification and knowledge and skills for the discipline. Once returning from the conference the analyst can provide details in trends within the discipline to the other analysts, which will improve the section. The AFTE conference will provide the firearms examiner with continued education for the firearms examiner. This is critical to maintaining their certification and knowledge and skills for the discipline. PLAN FOR FORENSIC SCIENCE LABORATORIES - Please provide the name of the unit of local government that has developed this plan and the years the plan covers. (Provide the signed certification on the Documents tab) The Northern Region Lab Group (NRLG) and CBI signed a MOU in 2013. this group of 6 agencies have determined to use the CBI quality system and its related laboratory policies and procedures to operate as a forensic laboratory. 34. GENERALLY ACCEPTED LABORATORY PRACTICES AND PROCEDURES - Describe how the applicant agency complies with the certification. Provide the name of the certifying accreditation organization being used. See instructions for further information. (Provide the signed certification on the Documents tab) ANAB is the current accrediting body. The NCRFL works with the CBI in providing forensic laboratory services to the region. It has placed itself under the CBI's quality system and therefore operates under all the CBI Forensic Science Services policies and procedures as set up by the Colorado Bureau of Investigation. The policies and procedures have been reviewed by the accrediting body and the laboratory undergoes an annual review to assure compliance. We perform monthly and annual audits, review all work and reports for technical competence and accuracy. All analysts undergo proficiency testing annual as required by policy. New analyst's complete competency testing prior to being release to conduct examinations. 35. EXTERNAL INVESTIGATIONS - Provide a detailed explanation of the process for ensuring an independent external investigation would be conducted in the event that an allegation of serious negligence or misconduct substantially affecting integrity. The CBI quality system has in place a system to review instances of that may affect the quality of the laboratory system. It is defined in the Quality Manual of the CBI laboratory system. Anyone in the system can report on an incident of quality concern in the form of a quality incident review (QIR). 2. All QIRs are eventually provided to the lab director for review before being given to the Quality Manager. Many of these QIRs are resolved at the level of the technical leader or lab manager. All others continue though the review process and in some instances the lab director determines the corrective actions that may need to be taken. That recommendation is then reviewed by the Quality Manager. 3. If on review the lab director determines that the QIR indicates an allegation of serious neglect or misconduct then, in addition to the paper workflow of the QIR, a call to the Quality Manager would occur. 4. The lab director would contact the Quality Manager of the CBI to determine the level of concern. 5. If it was of a serious nature and required an independent investigation then the lab director would contact the Weld County Sheriffs Office, Internal Affairs Unit to make them aware of the allegation and request their services to provide an independent review of the allegation. 6. Due to the unique nature of the regional lab (6 agencies provided staff in the lab) the agency whose employee was involved in the alleged action would be notified. They would be appraised of the situation and informed that an independent review would be done. 7. The lab director would review the results of the independent review and in concert with the CBI quality manager create a plan to follow through with the recommendation of the Weld County Sheriffs Office Internal Affairs Unit.
