HomeMy WebLinkAbout20200142.tiffRESOLUTION RE: AMENDMENT TO SMALL TRACT OIL AND GAS LEASE COVERING CERTAIN PROPERTY OWNED BY WELD COUNTY, COLORADO, AND AUTHORIZE CHAIR TO SIGN - GRIZZLY PETROLEUM COMPANY, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Weld County, Colorado, is the owner of vast acres of mineral lands located in Weld County, Colorado, and WHEREAS, the Board approved a Small Tract Oil and Gas Lease for Grizzly Petroleum Company, LLC, 1801 Broadway, Suite 500, Denver, Colorado 80202, recorded at Reception No. 4319508, dated July 19, 2017, and WHEREAS, the Board has been presented with an Amendment to a Small Tract Oil and Gas Lease, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Grizzly Petroleum Company, LLC, 1001 17th Street, Suite 2000, Denver, Colorado 80202, commencing upon full execution of signatures, with further terms and conditions being as stated in said amendment concerning 4.042 net mineral acres, more or less, described to -wit: Part of Section 11, Township 4 North, Range 67 West of the 6th P.M., Weld County, Colorado, as further described in Exhibit A to said lease amendment WHEREAS, after review, the Board deems it advisable to approve said amendment, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Amendment to a Small Tract Oil and Gas Lease, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Grizzly Petroleum Company, LLC, be, and hereby is, approved. The Lease is hereby amended by deleting the Legal Description in the "Exhibit A" therein attached to the Lease and replacing the Legal Description in said "Exhibit A" with the Legal Description in the herein attached "Exhibit A". 3. Lessor does hereby give, grant, bargain, sell and convey to Lessee a leasehold estate in the described land situated in the County of Weld, State of Colorado, and more particularly described in the herein attached "Exhibit A" on the same terms as contained in the Lease and any amendments thereto, and Lessor does hereby ratify, adopt and confirm the Lease as amended.
