DISCUSSION: Mr! Lorenson read a letter from the Health Department advising Mr. Stroh
to contact the Soil Conservation Service for assistance in a drainage problem.
A letter of complaint on the expansion of the feed lot was also read from Mr.
and Mrs. W. D. Hicks. James Stroh presented their plans and commented on the
complaint? Mr. Stroh inquired if they would move one pen (#8) would they meet
the 660' requirement. The pen with the 20' set-back has been in existence for
several years. Mr. Lorenson had recommended denial because of the set-back.
MOTION: By Mr. 'Weigand to table the matter until a report from the Soil Conservation
. Service is received and a letter of intent regarding pen #8. Second by Mr.
Watson. }1 unanimous vote of "Aye". Motion carried.

previously heard the application, he recommended the matter be tabled until
the next Meeting.

DISCUSSION: Mr. Lorenson stated he recommended approval of the site. Letters of
approval have been received from the Health Department and the Extension office.
Should be subject to construction being completed within one year. Mr. Lacy
explained his plans for the coming year include one new building and the extension
. of the two existing buildings. The plans include a home but would beat a later
time.
RESOLUTION:
Be it therefore resolved to recommend approval to the Board of County
Commissioners subject to construction being completed within one year. Motion
by Mr. Watson, second by Mr. Olark. Motion carried. Mr. Weigand abstained from
voting.

recommended that the plat be approved subject to the following modifications:
there should be an addition of a street name, a bond be posted for $43,000.00
for the streets, the addition of 'the acreage be included in the legal description,
and the he place for the approval of the city on the plat be deleted. There is
a letter of approval from the City which is all that is necessary. Mr. McRae
stated this filing meets the existing' estate zoning.
RESOLUTION:
Be i therefore resolved to recommend approval to the Board of County
Commissi ners subject to the recommendations of Mr. Lorenson. Motion .by Mr.
Weigand, second by Mr. Watson. A unanimous vote of "Aye". Motion carried.

is fort a request for a Land Use Permit as requested by Mr. Gordon Lacy
of Roilte 4, Ault, Colorado, March 8, 1971, Time is 10:15 A. M.
At this time Mr. Telep will you make the record.
Mr. Telep: Thank you Mr. Chairman. Let the record show
this cause came on for a hearing this day, March 8, 1971, at the hour
of 1015 A. M. upon the application of Gordon Lacy of Route 1, Box 4
Ault, Colorado, requesting a land use permit for a chicken operation
to be conducted upon a parcel of land located in the East Half of
the East Half of the Southwest Quarter (EfEj-SWf) of Section 11, Township
7 North, Range 66 West of the 6th P. M., Weld County, Colorado.
Let the record further show that this hearing was published
in the Greeley Booster on January 22 and February 26, 1971 respectively"
and as required by law
Let the record further show that there are in the file several
receipts showing that the adjacent landowners were duly notified by
certi_ied mail of this hearing today.
Let the record further show that there is on file a resolution
of the Weld County Planning Commission dated Janury 5, 1971 recommending
favorIbly for this site approval with limitations and the Planning Director
will probably tell you more about that in detail.
Let the record still further show that Mr. Gordon Lacy
is present.
Mr. Chairman I believe we are ready to proceed.
Mr. Anderson: At this time Gordon do you want to come
to the mike and tell us your problem.
Mr. Lacy: We wanting to further our operation there
by building at the present time another house the same size as the
one we have - we have three in operation now and also along with
some discussion with the Planning Commission we have some future
plans for the balance of this year. This was part of the discussion
we had at the hearing with the Planning Commission on January 5th

I believe it was. The building we are proposing to build like I
say axe the same as the buildings that we have. They are 120 by
40 for enclosed operations.
Mr. Anderson: What it is - is just another house that you
are asking for?
Mr. Lacy: Thats right. At this time and the discussion
we had - the balance of the year - when we first set this up I discussed
this With some people in the Planning Office and they suggested that I
plan my full and complete building over the next 4 or 5 years and
then when we had the hearing they felt they should cut it back to 1
really
year, which is very agreeable to me because I/don't have that much
idea whats going to happen the next 4 or 5 years. But at the present
time light now I'm here to get the one building and the possibility
of extension of the 2 buildings during the year - this coming of this
year 1971. The extensions will be tied right on - in other words -
the building we are building now is completely new and the extension
will be tied on to the present building.doubling.themLup.sTherelwasssi n
also some discussion the possibility but I doubt very seriously that
there was a possibility of building a small grain storage building
there for grain. This would be a very small part of the operation
or part of the building program.
Mr. Anderson: Do you have anyone here Gordon to support
your application or are you the only one here?
Mr. Lacy: I am the only one here that I know of.
Mr. Billings: This application Gordon is the one that
you are working on now?
Mr. Lacy: Thats right.
Mr. Billings: Do you also in this, Burman, these extensions
on the other 2 buildings - are they built into this request? Or is the
request for only one building.
Mr. Lorensen: Well we had orginally suggested to him

from our office that he do his total expansion/before it<got before the
Planning Commission - the Planning Commission had decided that it had
1 better be one step at a time. So the Planning Commissions recommendation
was that to limit it to one new building.
Mr. Anderson: Is that agreeable?
Mr. Lacy: Was it for the one new building or the extensions
of the extension of the out - now when we are talking about extensions
we are only talking about extensions to t2a existing buildings.
Mr.Lorensen: Okay, well the Planning Commission recommendations
subject to the expansion - limited to one new building and to the expansion
of the 2 existing buildings.
Mr. Lacy: Well that is what I wanted to bring up.
Mr. Billings: You are planning on expanding on the 2 buildings
that are on the east.
Mr. Lacy: No - because of the rotation it would be the
east building and apply for the west building now - in other words not
the nary one that is being built because it has to do with rotation
of the birds and the flocks. If there is any further expansion it will
be in this area.
Mr. Anderson: Do you have any question, Harry?
Mr. Ashley: There are 3 building there and you are only
expanding 2 - is that it.
Mr. Lacy: If we go into expansion this year. It will
be according to our growth pattern depending upon what we do with our
sales and our growth pattern.
Mr. Ashley: How iar west of Ault are you?
Mr. Lacy: Approximately a quarter to a half a mile.
Mr. Billings: Right as you go out there, Harry, on Highway
#14 on the north side of the road. Just past Noffsingers.
Mr. Ashley: I have no further questions.
Mr. Telep: Mr. Chairman may I ask Mr. Lacy a question -
Gordon this is an existing operation
Mr. Lac! Oh yes.

Mr. Telep: This is just a request for an expansion
of an existing operation - is that correct?
Mr. Lacy: That is correct.
Mr. Telep: Mr. Chairman, I would like to have the record
reflect that it is beingbmended to show additionally that this is an
expansion of an existing chicken operation. Thank you.
Mr. Anderson: Let the record show the amending of this
recommendation. Is there anyone here in support of this application.
Is there anyone here apposing the application? Does anyone have
any questions? Do you have any recommendations Mr. Lorensen?
Mr. Lorensen: Yes, Mr. Chairman, I - to mention the
recommendations would indicate that this application submitted to
the Town of Ault for comment and we received none and it was
delivered by hand - so we do know that Ault was notified if they
had any objections. The Planning Commission recommended approval
before the County Commissioners for the following reasons: `:
there as a letter of approval from the Health Department and the
Extension Office and also that it be made subject to the conditions
previously mentioned that is to the limit of one new building and
the expansion of the two existing buildings.
Mr. Billings: Mr. Chairman, this was in my area and
I am well familiar with the operation and there being no opposition
to it I would move approval of the request of Mr. Gordon Lacy for
one new building and the addition to two existing buildings.
Mr. Ashley: I will second your motion.
Mr. Anderson: You heard the motion, how do you vote
Mr. Billings?
Mr. Billings: In favor of to motion.
Mr. Anderson: Mr. Ashley
Mr. Ashley: Yes.
Mr. Anderson: The chair votes yes. Let the record show

Dear Sirs,
A survey of the Highland Egg Ranch was made on December 18, 1970
by the Weld County Health Department. The ranch is located in the South
West 2Z of Sectkon 11, Township 7 North, Range 66 West, k mile West of
Ault, Colorado
The purpose of this survey was made in relation to any possible water
pollution resulting from the egg ranch operation. The manure is retained
inside the buildings in pits under the bird cages. The manure is removed
every fourteen days from the pits conveyed into a truck and hauled to area
farms. None of the manure from this operation is stored on the property
of the egg ranch.
The results of this survey indicates that Mr. Gordon Lacy, of the
Highland Egg Ranch has taken preventative measures to avoid water pollution.
