Annexation Impact Report

i. A map or maps of the Town and adjacent territory showing the following information:
a) The present and proposed boundaries of the Town in the vicinity of the proposed annexation.
b) The present streets, major trunk waterlines, sewer interceptors and ouffalls, other utility lines and ditches and
the proposed extension of such streets and utility lines in the vicinity of the proposed annexation.
c) The existing and proposed land use pattern in the areas to be annexed.
Please see the attached maps depicting the information as outlined above.
ii. A copy of any draft or final pre -annexation agreement, if available.
There is no annexation agreement associated with this application.

A statement of the Town's plans for extending or providing for municipal services within the area to be annexed.
This annexation includes existing road right -of way and former UP RaOilroad property now owned by the Town of
LaSalle. All of the annexed property will be included in the rebuilt WCR 39. ROW. The Town of LaSalle will
maintain the roads under an existing agreement with Weld County and the State of Colorado. The only Town of
LaSalle municipal services to be extended to the annexed area will include road maintenance and police protection.
The Town has evaluated existing road maintenance and police resources and does not anticipate the need for
additional resources to serve the area to be annexed at this time.
iv. A statement of the Town's plans for the financing of municipal services to be extended into the area to be
annexed.
The only municipal services to be extended to serve the Annexations is Road Maintenance and Police Protection.
The Town has evaluated existing road maintenance and police resources and does not anticipate the need for
additional resources to serve the area to be annexed at this time.
v. A statement identifying all existing districts within the area to be annexed.

PETITION FOR ANNEXATION OF UNINCORPORATED
TERRITORY IN THE COUNTY OF WELD, STATE OF COLORADO
TO THE TOWN OF LASALLE, COLORADO
TO THE MAYOR AND BOARD OF TRUSTEES OF LASALLE, COLORADO:
The undersigned, in accordance with the Municipal Annexation Act of 1965, Part 1, Article
122, Title 31, Colorado Revised Statutes, as amended, hereby petition the Board of Trustees of the
Town of LaSalle, Colorado, for the annexation of the following described unincorporated territory
located in the County of Weld, State of Colorado, to -wit:
See Legal Description contained in Exhibit A
In support of said Petition, your Petitioners allege:
1. It is desirable and necessary that the above -described unincorporated territory he annexed to
the Town of LaSalle, Colorado.
2. The requirements of Section 31-12-1.04, C.R.S., as amended, exist or have been met, to -wit:
a. Not less than one -sixth of the perimeter of the area proposed to be annexed is
contiguous with the Town of LaSalle;
b. A community of interest exists between the area proposed to be annexed and the
Town of LaSalle.
c. The said territory is urban or will be urbanized in the near future; and
d. Said area is integrated with or is capable of being integrated with the Town of
LaSalle.
3. The requirements of Section 31-12-105, C.R.S., as amended, exist or have been met, to -wit:
a. In establishing the boundaries of the territory to be annexed, no land held in identical
ownership, whether consisting of one tract or parcel of real estate or two or more
contiguous tracts or parcels of real estate, has been divided into separate parts or
parcels without the written consent of the landowners or landowners thereof, unless
such tracts or parcels were separated by a dedicated street, road, or other public way;
and
b. In establishing the boundaries of the area proposed to be annexed, no land which is
held in identical ownership, whether consisting of one tract or parcel of real estate or
two or more contiguous tracts or parcels of real estate comprising 20 acres or more
(which, together with the buildings and improvements situated thereon has a
valuation for assessment in excess of two hundred thousand dollars for ad valorem
tax purposes for the year next preceding the annexation) has been included without
the written consent of the landowner(s); and
c. That no annexation proceedings have been commenced for the annexation of part or
all of the subject property to another municipality; and
d. The proposed annexation would not have the effect of extending a municipal
boundary more than three miles in any direction from any point of such municipal
boundary in any one year, and
e. The proposed annexation will not result in the detachment of area from any school
district and the attachment to another school district.
f. If a portion of a platted street or alley is to be annexed, the entire width of the street
or alley has been included within the area annexed, and reasonable access will not be
denied to any landowners, owners of any easement, or the owners of any franchise
adjoining any platted street or alley which is to be annexed to the Town of LaSalle
but is not bounded on both sides by the Town of LaSalle.
4. The owners of more than fifty percent of the area proposed to be annexed, exclusive of
dedicated streets and alleys, have signed this petition and hereby petition for annexation of
such 'territory.
5. The signatures on this petition comprise more than fifty percent (50%) of the landowners of
the territory to be annexed and said landowners attesting to the facts and agreeing to the
conditions contained herein will negate the necessity of any annexation election.
6. Upon the annexation ordinance becoming effective, all lands within the area proposed to be
annexed will become subject to all ordinances, resolutions, rules, and regulations of the
Town of LaSalle, except for general property taxes of the Town. of LaSalle, which shall
become effective as of the January 1 next ensuing.
7. The Petitioners have submitted the petition with the intention that the property will be
developed in accordance with the Town of LaSalle Land Use Code, Comprehensive Plan,
Municipal Code, resolutions and ordinances.
8. There shall be no duty or obligation upon the Town of LaSalle to furnish water or sanitary
sewer facilities to the area proposed to be annexed. Such services will be provided at such
time, in the sole discretion of the Town, when such services for water and sanitary sewer can
be economically and reasonably be installed to service a sufficient number of inhabitants
within the area so as to make the construction and establishment of such services feasible
and at no additional cost for the same or similar type of services provided to inhabitants
within the existing corporate limits of the Town.
9. Attached as Exhibit B is an annexation map containing the following:
a. A written legal description of the boundaries of the area to be annexed; and
b. The boundary lines and the location of each ownership tract, contiguous boundary of
the annexing municipality, and location of right-of-ways and utility easements within
the area.

The undersigned are the owners of more than fifty percent of the territory included in the area
proposed to be annexed, exclusive of streets and alleys.
11. The petitioners further request that the Town of LaSalle, Colorado, approve the annexation
of the area proposed to be annexed.
12. Pursuant to Town of LaSalle Ordinances Section 15-10, the following information is
provided:
a. Petitioners have read the LaSalle Annexation. Ordinance and will comply with its
provisions.
b. The boundaries of all special districts having jurisdiction over the area to be annexed
as well as rights -of way, utility easements, water and ditch rights are identified on.
Exhibit C.
c. A Certificate of Ownership and. Encumbrances showing that the property to be
annexed is owned in fee simple, clear of all liens and encumbrances except for the
current year's property taxes is attached hereto and known as Exhibit D.
d. The names and street and mailing addresses of all property owners within 300 feet of
the land proposed to be annexed is attached and known as Exhibit E.
e. Petitioners propose that the property to be annexed be zoned I-1 Light Industrial.

A RESOLUTION FINDING THAT THE PETITION FOR ANNEXATION
OF CERTAIN PROPERTY KNOWN AS THE "WELD COUNTY ROAD 39
ANNEXATION # 1 AND # 2" IS IN SUBSTANTIAL COMPLIANCE WITH
THE REQUIREMENTS OF G.R.S.. 31-12-107(1) AND ESTABLISHING A
DATE FOR A PUBLIC HEARING BEFORE THE BOARD OF TRUSTEES
OF THE TOWN OF LASALLE, COLORADO TO CONSIDER THE
PROPOSED ANNEXATION
WHEREAS, the Board of Trustees received a petition for annexation of certain property
herein described and known as the Weld County Road 39 Annexation #1 and #2; And,
WHEREAS, the Board of Trustees finds that the annexation petition and accompanying
annexation map substantially comply with C.R.S. 31-12-107 and Section 30 of Article II of the
Colorado Constitution.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF LASALLE, COLORADO:
Section 1. The Board of Trustees finds that the annexation petition and accompanying
annexation map are in substantial compliance with the requirements of C.R.S. 31-12-107 and Section
30, Article II of the Colorado Constitution.
Section 2. The property proposed to be annexed consists of approximately 4.52 acres of
property located in the West One Half of Section 32, Township 5 North, Range 65 West of the 6th
P.M., County of Weld, State of Colorado. The property to be annexed is described in Exhibit "A"
attached to this Resolution.
Section 3. The Board of Trustees hereby accepts the petition for annexation of the property
described as Weld County Road 39 Annexation #1 and #2.
Section 4. The Board of Trustees hereby determines that it will consider an Ordinance
annexing the property into the Town of LaSalle at a regular meeting of the Board of Trustees on the
8th day of September, 2020 at 7:00 p.m. at the LaSalle Town Hall located at 128 N. 2nd Street,
LaSalle, Colorado. At such hearing the Board of Trustees will accept public comments and will
determine whether the applicable requirements of C.R.S. 31-12-104 and 31-12-105 have been met,
and determine whether the area should be annexed to the Town.
