We were awarded $306,424.00 with a County Match of $76,606. The current grant pays partial salary and benefits for: 1 County Court VW Assistant 1 District Court VW Assistant 1 Juvenile VW Assistant 1 part time VW Clerical The federal OVP-VOCA Grant funds were set at 6 million dollars annually for a number of years. The US Legislation increased funding for two-year grants and Colorado received 23 million dollars for 2015-2016. Funding was increased for 2019-2020 to 46.5 million dollars. The RFP for OVP-VOCA funds for 2021-2022 has once again increased this time to 67 million dollars. The Colorado Division of Criminal Justice has given notice to applicants that based on the federal cap and the level of federal collections, awards for the 2023-2024 grant period could be affected and for agencies "to start thinking about the impact of reduced funding" We feel it is prudent to request additional personnel in the 2021-2022 OVP-VOCA Grant, otherwise the additional 20.5 million dollars available in this grant cycle will be designated to other programs and therefore not available for the 2023-2024 grant cycle. The two-year grant request is for $734,575.60 with a 20% County Match of $183,644.00. Haro Upgrade Restitution Clerk (16) to Restitution Assistant (20) NO BOCC STAFF USE Date Set: Time: JUSTIFICATION OF NEW POSITIONS OR RECLASSIFICATION OF POSITIONS 1.Reclassify part-time VW Office Tech II (Grade 8)— to full time VW Office Tech III (Grade 15) This part-time VW Clerical position has historically been funded by a 19`" JD VALE Grant and VW Administration Funds (CVC & VALE). VOCA funding was obtained in 2019 to increase this position from 20 hours a week to 30 hours a week when the VALE Grant funding source leveled off and VW Administrative funds decreased. The position has always been classified as a Grade 8 VW Office Tech II. We believe the low grade was selected as it was considered to be an entry level, part-time position to gain access to higher paid positions in the District Attorney's Office. The position's main duties have always been as a first line to answer and re -direct in -coming calls to VW Assistants and processing of returned Post Office VRA letters. We have had the same person in this position since 2013 and with her years of experience, the duties of the position have increased to include: fully assist the majority of callers without re -directing the call, processing all VRA Sentence Outcome Letters, back-up on VRA letters, training new VRA Notification Clerk, and collecting VW Unit stats regarding: VRA letters sent, Trials, and Call Offs. The added duties make it difficult to complete these duties timely in 20 hours a week. In 2019, with the addition of 10 hours a week from VOCA funding, this position was tasked with additional responsibilities in creating reports to gather and compile VOCA stats as well as continuing with all of her increased duties over the years. On May 29, 2019, HB-1064 was signed into law mandating Post Sentencing Agencies (DOC, DYC, Jail, Work Release, Community Corrections and State Hospital) to proactively enroll VRA victims on their Victim Notification Systems which alert victims of the status of the offender. Prior to passage of this bill, only victims who signed up for Post Sentencing Notification were notified of an offender's status. Since the bill went into effect, the Post Sentencing Agencies have been relying heavily on District Attorney's Offices to provide them with victim contact information. The VW Office Tech II responds to the majority of these requests from all Post Sentencing Agencies which takes a minimum of 3 hours a week to process. DOC, which has the most requests for victim contact information, has asked for contact information for 283 victims since the process began midyear 2019. We have just been notified from DOC that they are now are enrolling VRA victims retroactively for all offenders sentenced to DOC for VRA crimes committed on or after January 1, 1993 (the date VRA went into effect). The Office Tech II spent 1.5 hours processing 11 requests from DOC on the RUSH retroactive cases. This list from DOC contains an additional 19 offenders that the VW Office Tech II will try to process by the end of the week because DOC will send new lists next week for both retroactive cases and new cases. When VOCA increased hours for this position in January 2019, we had no idea that this bill would pass which would cause these workload consequences to the VW Unit. The request to VOCA is to make this a full-time position classified the same at the VRA Notification Clerk at a VW Office Tech III (Grade 15). BOCC STAFF USE Date Set: Time: 2- NEW POSITION: full-time County Court Victim Witness Assistant In 2005, the VW Unit had one County Court Victim Witness Assistant that focused on victims of misdemeanor domestic violence. All misdemeanor domestic violence cases were filed in one courtroom handled by two seasoned prosecutors. In 2006, when a County Court Judge was added to the bench, the VW Unit was able to add a 20 hour a week VW Intern (with grant funds) to assist with the domestic violence cases. This enables the full-time VW Assistant to focus on other VRA cases and assist prosecutors in four County Court Divisions with trials and other court hearings VRA victims wished to attend. In 2014, the Chief Judge notified the District Attorney's Office that all four County Court Divisions would be handling domestic violence cases (instead of one dedicated domestic violence division) beginning 2015. The docket change meant that logistically the VW Assistant and VW Intern need to be in multiple places at once to support domestic violence victims while handling all their other VW duties. Additionally, instead of two seasoned prosecutors handling these cases, all eight prosecutors are now assigned DV cases which require the VW Assistants to spend more time training prosecutors in the dynamics of domestic violence. This docket change could not be handled by one VW Assistant and one part-time VW Intern, so the VW Intern position was upgraded to a full- time VW Assistant (VOCA funding) providing two full-time County Court VW Assistants to support victims and prosecutors in all four county court divisions. In 2018, the Chief Judge notified the District Attorney's Office that daily bond hearings for all defendants (misdemeanor and felony crimes) would be heard in one County Court Division each day. The result of more defendants appearing in court means more time in court for everyone including VRA victims. Since all defendants charged with a crime involving domestic violence are held without bond, the time spent with domestic violence victims awaiting a case to be called has at times doubled. The consequence is that one of the two County Court VW Assistants are attending lengthy bond hearings each day which keeps them from the many other VW duties they have. In 2019, County VW Assistants assisted 805 new domestic violence victims. In late 2019, a County Magistrate was added to handle the daily Arraignment Docket rather than one of the four County judges. The nine County Court prosecutors rotate the Arraignment Docket as well as their regular Division Docket and the two County VW Assistants juggle being in five courtrooms at times which is especially difficult on Wednesdays which are trial days. In 2020, one of the four County Court Judges will be piloting a project to have three trials go each week rather than one. This project will require witnesses for all three trials to appear in court on Tuesday as the judge determines which case will go to trial first, second and third during the week. In 2019, County Court cases which proceeded to trial numbered 99. If the court finds the pilot project to be successful, this process will be implemented in all four County Court Divisions. Two weeks a month two divisions will handle three trials each week and two weeks a month two divisions will set docket. This process will greatly impact the County VW Assistants as they will need to coordinate BOCC STAFF USE Date Set: Time: witnesses for six trials a week rather than two while needing to support victims in the two docket divisions at the same time. Our Careless Resulting in Death cases are the most intense cases County Court VW handle. Victim families who's loved one has been killed due to a defendant's careless driving case can experience the same emotions as families who's loved one has been murdered. The defendant's potential punishment in a Careless Driving Resulting in Death is miniscule (Probation and some jail time) compared to a defendant who is convicted of murder (up to a life sentence). These cases have many interested family members who sometimes have different input as to how to resolve the case. This means there are times, in just one case, that VW Assistant must set up more than one family meeting with the prosecutor, establish rapport and have separate victim contact for updates. In 2019, County VW Assistants assisted families in 10 Careless Resulting in Death cases. The request to VOCA is to add a new 3`d County Court VW Assistant to allow VW Assistants to provide the most effect services to victims and support prosecutors. A DA VW Assistant's dual role: (1) to support and educate victims as they go through the criminal justice system by being with them in court, contacting them after court hearings and answering their questions. (2) to assist the Deputy DA in the prosecution of the case by maintaining case management on all witnesses subpoenaed for court hearing and coordinating those witnesses. 3- NEW Restitution Assistant and upgrade Restitution Clerk to Restitution Assistant. The current Restitution Clerk position was created and funded by Weld County Government in 2009 and classified as Grade 16. The position, in 2009, compiled and documented approximately 2000 victim restitution requests (the majority of them traffic cases). In 2O18, the Restitution Clerk processed 5357 victim restitution requests from victims of felony non-VRA crimes and crimes filed in county court (traffic offenses, misdemeanor domestic violence and sexual crimes). Presently, the Restitution Clerk 1- reviews restitution documentation submitted by victims and follows up with them for clarification; 2 -contacts victims who have not submitted restitution documentation to see if they wish to request restitution and if so how to submit documentation. 3 -reviews police reports to verify all victims have been sent a Victim Impact Statement (VIS) by clerical staff and if not, have a VIS sent to them. This position has grown over the years not only in the amount of work processed but in the type of contact with victims as they try to recover from the financial mental and physical impact of the crime. The restitution process presently done after the defendant has been sentenced and prior to the 60-90 day deadline the court orders for a Notice of Restitution to be filed. We propose to change the workflow to a proactive approach contacting victims as soon as a case is entered into our data system. The proactive approach should assist in cases being BOCC STAFF USE Date Set: Time: resolved quicker meaning less court hearing dates thus lessening the daily dockets in county court. More importantly, the proactive approach will quickly identify victims who have been seriously injured so appropriate victim referrals can be made (i.e. Crime Victim Compensation) and contacting the assigned Deputy DA and Victim Assistant to alert them to the case. District Attorney's Offices with a separate position to process crime victim restitution usually classify this position as a VW Assistant and pay the position the same as a docket VW Assistant. The present skill level requirement for these duties is much different than it once was in 2009. We are proposing the present Restitution Clerk position (Grade 16) be reclassified to a Restitution Assistant at Grade 20 which is the same classification as the Crime Victim Compensation Assistant and is between Grade 16 and a VW Assistant of Grade 24. The Weld DA Victim Witness Assistance Unit (established in 1980) is the only District Attorney' Office based victim assistance unit in Weld County providing services to victims of crime as they move through the prosecution of a criminal case. Experiencing a crime can, for many victims, be the most difficult time in their lives. The criminal justice system is often challenging and stressful to navigate, but the Victim Witness Assistance Unit (VW Unit) makes every effort to assist victims as they move towards recovery from the physical, emotional, and financial impacts of crime. The VW Unit is dedicated to upholding victim's rights as outlined in the Colorado Victim Rights Act (VRA) and provides necessary assistance to victims of crime through advocacy, courtroom support, criminal justice education, and resource referral services. Presently, the Victim Witness Assistance Unit staff consists of 14 staff (13.75 FTE) working with victims of felonies, misdemeanors, and traffic cases. In 2019, the VW Unit provided 42,770 services to 3,007 unduplicated victims who fall under Colorado's Victim Rights and 1833 victims of traffic crashes and 1748 victims of financial crime. The VW Unit provides services to all victims and witnesses involved in the prosecution of criminal cases which have occurred in Weld County, Colorado. We serve individuals of all races and ethnicities, languages and cultures, those who identify as deaf, LGBTQI, disabled (physical, intellectual, developmental disabilities), as well as those who live in varying geographic locations. An area of emphasis for the VW Unit has been serving those with language barriers. In order to make sure that `non-native English speakers know their rights and are able to participate in the criminal justice process to the fullest, we have eight Spanish speaking VW Unit Staff, access to a language line service, knowledge of local translators for language and ASL, contact letters in primary East African languages to reach a greater number of our refugee population, and VRA letters in English and Spanish. We serve victims speaking fifteen different languages: Karenn, Karen, Burmese, Chuukese, Malay, Korean, Vietnamese, Mandarin, Somali, Kinyarwanda, Oromo, Swahili, French, Napoli, and Spanish. ,As Weld County's population grows, the number of cases prosecuted by the District Attorney's Office also increases. The increasing population of Weld County results in an ever- increasing caseload of victims of crime needing services. Weld County is Colorado's third largest county covering 4,016 square miles in the northern part of the state 49 miles from Denver and continuing to the Wyoming border. The population of 314,305 (2018) has seen an increase of 24% since 2010. Page 3 of 24 Updated: 01/24/2020 `Greeley, Colorado's population is now 137,069 (2018) and was listed as the 23rd fastest -growing city in the United ;States; an increase of 12% from 2010. The top ten fastest growing cities in Colorado include these Weld County cities: #5 Windsor with a 45.8% increase (located in Weld & Larimer counties) #8 Erie with a 42.3% increase (located in Weld and Boulder counties) and #9 Lochbuie with an increase of 40.2%. Weld County has 32 incorporated municipalities of varying sizes as well as a populated unincorporated Weld County. The county seat and principal city, Greeley, is located in the west central part of the county and contains approximately 113 of the county's population. Generally, most of the remaining population resides within a 20-30 mile radius of Greeley; the northeastern part of the county is sparsely populated. The diversity of Weld County continues to grow along with the population. Weld County has a varied population of refugee and immigrant non-English speakers from Burma, Southeast Asia, China, Vietnam, Korea, Thailand, Africa, Rwanda, Ethiopian, Kenya, Somalia, Egypt and Europe. Weld's population is 65.4% White; 29.6 Hispanic or Latino; 1.5% Black or African American; 1.6% American Indian; 1.8% Asian; and 2.3% Two or More Races. (Limit of 10,000 characters) The requested VOCA funded project focuses on Victim Witness Assistance Unit Staff to support the unique needs of victims of juvenile offenders, domestic violence victims, victim families whoseloved ones have been killed in Careless Driving Resulting in Death or severely injured, and victims of traffic or financial crimes. Victims of Juvenile Offenders are navigating a system operates differently than a traditional adult criminal justice process as juvenile offenders have support of an attorney, GAL, Department of Human Services casework and their parents. These cases drag on through the Juvenile Criminal Justice System as the court gives offenders many opportunities to comply with court orders. Insignificant penalties for juveniles and now efforts at the .Colorado Legislature to classify a person as a juvenile in the criminal justice system from under 18 years old up to 25 adds extreme frustration and anger by victims and their families. The Juvenile VW Assistant provided assistance to 360 victims in 2019; a 39% increase from 2017 when the position was first funded by VOCA. REQUEST: Continue VOCA funding for a Spanish bi-lingual Juvenile VW Assistant. Victims of felony domestic vi ience are subject to being involved in a lengthy criminal justice system. Since 2008, due to VOCA funding, a system has been implemented by the VW Assistants anticipate a victim's attendance at the initial Bond Hearing to be able to provide immediate support in an overwhelming and busy courtroom scene. District Court VW Assistants provided assistance to 292 new domestic violence victims in 2019; a 116% increase from 2019 to 2019. VOCA provided funding for 89 of these victims. REQUEST: Continue VOCA funding for a Spanish bi-lingual District VW Assistant. Victims of misdemeanor domestic violence also are subject to being involved in a lengthy criminal justice system. Since HB-1210 went into effect in 2014, giving all defendants in custody the right to legal counsel in plea negotiations, the District Attorney's Office could no longer resolve 25%-30% through our DV Fast Track Misdemeanor Domestic Violence Program. The impact is these cases are in the court system longer and victims need continual assistance from a VW Assistant as the case is reset over and over. in 2015, the Chief Judge reversed the decision to have one dedicated misdemeanor domestic violence courtroom and reassigned all four County Court Divisions to be assigned to domestic violence cases. This decision coupled with the change in law in 2014, we were no longer able to provide adequate assistance to domestic violence Page 4 of 24 Updated: 01/24/2020 as7C7VeliVere to obtain gr na t fund ing To reclassify the pad time VW Intern position a second fufl time County Court Victim Assistant to provide acceptable assistance to victims in all four courtrooms. Presently, the two County VW V Assistants are handling misdemeanor domestic violence crimes in a high -volume setting, witr multiple cases every day coming on for first appearance bond hearings. County VW Assistants assisted 805 new domestic violence victims in 2019. VOCA funding provided for 464 of these victims. CarSess Driv[Ing Resulting in Death and Careless Driving Resulting• in Injury These cases are filed in County Court as traffic and are the most intense cases County Court VW Assistants handle as victim families who's loved one has been Killed or hurt seriously due to a defendant's careless driving can experience the same emotions as families who's loved one has been murdered or of become a victim of vehicular assault. In Careless Driving Resulting in Death cases, the greatest difficulty victim's families are faced with is the defendant's potential punishment of only being jail and/or Probation compared to a defendant who is convicted of murder faces prison time up to a life sentence. County VW Assistants must support families who are absolutely devastated and inconsolable in feeling their loved one's death does not matter in the criminal justice system. Although Careless Driving Resulting in Injury cases are not VRA crimes, our office tries to identify victims who have been seriously injured with a permanent physical or mental loss and provide proactive assistance. When Careless Driving Resulting in Injury cases are reviewed the accident report and perhaps a police report does not adequately portray the seriousness of a person's injuries. We would like to expand assistance to all cases filed as Careless Driving Resulting in Injury with the help of a third County VW Assistant and Restitution Assistant (see Restitution Assistant below). The two County VW Assistants are presently assisting 18 victim families in these type of cases. Impact of County Cou docket changes Three recent bench changes to dockets which are significantly impacting victim services provided by County Court VW Assistants Unit are: 2018- All in -custody defendants appear in front of one County Court Judge for the initial Bond Hearing and entering a Mandatory Protection Order. This change has impacted the two County Court VW Assistants supporting domestic violence victims. The hearings become lengthy which keeps them from serving other victims and performing the many other duties they have in the VW Unit. 2019 - A County Court Magistrate was funded to handle the daily Arraignment Docket rather than one of the four County judges. This change has impacted the two County VW Assistants who must juggle being in five courtrooms at times which is especially difficult on Wednesdays which are trial days. 2020 - One of the four County Court Judges will be piloting a project to have three trials go each week rather than one. —his project will require witnesses for all three trials to appear in court on Tuesday as the judge determines which case will go to trial first, second and third during the week. In 2019, County Court cases which proceeded to trial numbered 99. If the court finds the pilot project to be successful, this process will be implemented in all four County Court Divisions. Two weeks a month two divisions will handle three trials each week and two weeks a month two divisions will set docket. This process will greatly impact the County VW Assistants as they will need to coordinate witnesses for six trials a week rather than two while needing to support victims in the two docket c ivisions at the same time. E VEST: Continue VOCA funding for a Spanish bi-lingual County Court VVV Assistant and add a 3rd County Court VW Assistant. The court's revamping of County Court dockets is putting an ever-increasing strain on the two VW Assistants who need to assist domestic violence victims at the same time in more than one cou -troom, as well as assisting victims of other crimes as well as completing the myriad of other responsibilities. The addition of a 3rd County Court VW Assistant not only allow acceptable services to be provided to our victims but also permit us ;to provide more attention and proactive assistance to traffic victims of severe traffic injuries. R$ stotuti n Assistant `Victims of traffic crashes experience many of the same "but for" emotions as any other crime victim as well as dealing with physical injuries and mental harm that can have long-lasting effects such as TBI, paralysis, loss of limb or function. Additionally, the victim's vehicle may have been totaled by a defendant with no insurance causing a domino effect in the victim's daily life. Victims of financial crime also can have long-lasting financial and Page 5 of 24 Updated: 01/24/2020 emotional impac The current Restitution Clerk position was created and funded by Weld County Government in 2000 and compiled and documented approximately 2000 victim restitution requests (the majority of them traffic cases). Presently, the Spanish bi-lingual Restitution Clerk processes 4500 victim restitution requests a year. This entails gathering and clarifying restitution information submitted by victims after a defendant is sentenced or reaching out to victims who have not submitted information. The VOCA project requests upgrading the present Restitution Clerk to a Restitution Assistant and adding a second Restitution Assistant to enable staff to be proactive in contacting victims. Upgrading the position recognizes the additional victim advocacy role to be taken during the proactive contact with victims for restitution information which will also ascertain which victims need more resources (i.e. victims seriously hurt in traffic crashes, large financial impact) provide additional resources (i.e. Crime Victim Compensation) and alert the assigned Deputy District Attorney and/or VW Assistant. REQUEST: VOCA funding to reclassify present Restitution Clerk to Restitution Assistant and add a 2nd Restitution Assistant. VW Unit Clerical Supp rt This part-time VW Clerical is first line to answer and re -direct calls in the VW Assistance Unit, approximately 80% being victims of VRA crimes. This position is filed by a Spanish bi-lingual person who has been in the position since 2013 and has seen her duties increase as her experience increased. The position originally funded at 20 hours a week with VALE ADMIN funds, was increased to 25 hours with VALE Grant funding and in 2019 VOCA Grant funding added 5 hours, making this a 30 hour a week position. Due to the impact of gathering VOCA statistics as well as looking up victim contact information to Post Sentencing Agencies (DOC, DYC, Jail, Work Release, Community Corrections and State Hospital) we need the position to be full time. The additional responsibilities warrant upgrade classification. Center of the Rockies Sexual Assault Nurse Examiner) and Weld County Child Case Review. All these programs have a crime victim component to their agenda. The contacts made at these meetings are invaluable in networking, gaining new contact resource people, and brainstorming system changes. The agencies most utilized most by the DA Office VW Assistance Unit: A Woman's Place, Sexual Assault Victim Advocate Center, and Catholic Charities Victim Service Unit, Greeley Police Department Victim Assistance and Weld County Sheriffs Office Victim Assistance. These programs support the immediate and ongoing safety, therapeutic and financial needs of victims and witnesses in our community. The collaboration of agencies serving crime victims ensures that we are able to provide wrap around, individualized services to each person we serve. Additionally, the Weld District Attorney recently signed an MOU with Free Our Girls who provides services for human trafficking victims in Northern Colorado. The clerical VW staff person utilizes the DA ACTION Stat Report to pull quarterly reports to capture VOCA required statistics. The process to learn how data is pulled, what needs to be tweaked and how VW needs to enter data has been an ongoing process throughout 2019 to the present The Project Director compiles statistics quarterly and reports to the VVV Staff on the progress of the intended outcomes/impact of the data collection. This discussion provides insight into any unintended changes or outcomes and identifies for VW Staff the status of the projected timeframe goals. Our goal is that in 2020, our hand -counted stats will equal the DA ACTION Stat Report. Client survey are provided to victims at the conclusion of the court process, asking them to rate services from "Very Satisfied" to "Very Unsatisfied", overall experience from "Very Good" to "Very Poor", and include any additional Comments in the "Additional Comments anchor Contact the Project Director" section. Returned surveys will be reviewed and analyzed to ensure goals and objectives are being met, and to use feedback in effecting programmatic change as needed. Responses are shared with the Victim Witness Unit and Prosecutors on a quarterly basis. Evaluations regarding the VOCA funded project had an 88% approval rate in 2019.
