HomeMy WebLinkAbout20203482.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WEDNESDAY, NOVEMBER 25, 2020 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, November 25, 2020, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Mike Freeman, Chair Commissioner Steve Moreno, Pro-Tem — EXCUSED Commissioner Scott K. James Commissioner Barbara Kirkmeyer Commissioner Kevin D. Ross Also present: Assistant County Attorney, Bob Choate Acting Clerk to the Board, Isabella Juanicorena Assistant Controller, Chris D'Ovidio MINUTES: Commissioner Ross moved to approve the Minutes of the Board of County Commissioners meeting of November 23, 2020, as printed. Commissioner James seconded the motion, and it carried unanimously. • AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Ross moved to approve the Consent Agenda, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. • PUBLIC INPUT: John and Marisa Bell, Kersey residents, stated the County vacated a 30 -foot utility easement and they requested the help from the Board of County Commissioners to reinstate said easement. Mr. and Mrs. Bell submitted a packet of information to the record (Exhibit A). In response to Chair Freeman, they shared the easement was vacated in 2012 or 2013, but further explained discovery of the vacated easement caused them to withdraw an application to the Department of Planning Services for a land split. Commissioner James suggested the residents work with the Department of Planning Services to investigate the easement issues. Minutes, Wednesday, November 25, 2020 Page 1 2020-3482 BC0016 O/O9 i ao i • NEW BUSINESS: 1) CONSIDER CONTRACT ID #4245 MEMORANDUM OF UNDERSTANDING FOR CHILD WELFARE AND ADULT PROTECTIVE SERVICES HOTLINE AND AUTHORIZE CHAIR TO SIGN - PROWERS COUNTY: Tami Grant, Deputy Director of the Department of Human Services, requested to enter into a Memorandum of Understanding (MOU) for 2021 with Prowers County to continue to purchase Call Coverage Services from the Prowers County Hotline for Child Welfare and Adult Protection Services (APS). Commissioner Kirkmeyer moved to approve said memorandum of understanding and authorize Chair to sign. The motion was seconded by Commissioner Ross and it carried unanimously. • 2) CONSIDER CONTRACT ID #4258 MEMORANDUM OF UNDERSTANDING FOR DISASTER RECOVERY NATIONAL DISLOCATED WORKER GRANT (CORESPONDS) AND NATIONAL EMPLOYMENT RECOVERY DISLOCATED WORKER GRANT (RECOVERCO) AND AUTHORIZE CHAIR TO SIGN - JEFFERSON COUNTY: Ms. Grant presented the Memorandum of Understanding (MOU) with Jefferson County and shared the purpose of the grant is to provide various career and training services in response to the COVID-19 Pandemic Health Emergency. She stated the grant includes two (2) sub -awards; the first for RecoverCO and the other for COResponds. Commissioner James moved to approve said MOU and authorize the Chair to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. • 3) CONSIDER CONTRACT ID #4250 CHILD PROTECTION AGREEMENT FOR SERVICES (BID #B2000037) AND AUTHORIZE CHAIR TO SIGN - ROUNDUP FELLOWSHIP, INC.: Ms. Grant stated the agreement will provide child welfare mentoring and prevention services. Commissioner Ross moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural counties In the United Slates, ranking fifth in total market value of egriiculturol products sold. The rural areas of Weld County may be open and spacious, but they ore intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long—standing agricultural proctices and lower level of services thou i ln town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: e open views. spaciousness, wildlife. lack of city noise and congestion. and the rural atmosphere and way of life.Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long—established agricultural practices to accommodate the intrusions of urban users into the rural area. Well me agriculturol activities will generate off —site impacts, including noise from tractors and equipment: slow —moving farm vehicles on rural roods: dust from animal pens, field work, harvest end grovel roads; odor from animal confinement. silage, and manure, moke from ditch burning: flies and mosquitoes: the use of pesticides and fertilizers in the fields. Including the uof aerial spraying. Ditches and re cannot simply be moved "out of the way of residential development without threatening the efficient deliveryof irrigation to fields which is essential to farm production. Section 35-3.5-102, C.R,S., provides that an agricultural operation sholl not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or nobly associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (Twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities.The sheer magnitude of the oreo to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the aunty and the distanceswhich must be traveled may delay all emergency responses. including law enforcement, ambulance, and fire, Fire protection is usually provided by volunteers who must leave their labs and families to respond to emergencies. County grovel roods, no matter how often they are bladed, will not provide the some kind of surface expected from a paved road. Snow removal priorities mean that roods from subdivisions to arlerloi may not be cleared for severol days after a major snowstorm. Snow removal for roads within subdivisions ore of the lowest priority for public works or maybe the private responsibility of the homeowners. Services in oral areas. any cases. will not be equivalent to municipal services. Rural dwellers must, by necessity. be more self—sufficient than urban dwellers. Children are exposed to different hazards in the county than in on urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power far pumps and center pivot operations, high speed traffic, sand burs. puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling hildrer's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children.
