The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.

ACCESS:
Weld County Public Works has reviewed the application materials related to access. Access will be on to
Interstate 76 frontage road at Exit 48.
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to state highways.
Please contact Tim Bilobran at the Greeley office (970-350-2163) to verify the access permit or for any

ROADS AND RIGHT-OF-WAY:
The property is bounded by State Highway Interstate-76 Frontage Road. Contact the Colorado Department
of Transportation (CDOT)to determine what right-of-way shall be shown on the submitted plat. Reference
the documents creating the right-of-way. Please contact Tim Bilobran at the Greeley office, phone number:
970-350-2163.
The Colorado Department of Transportation (CDOT) has completed a US 85 Planning and Environmental
Linkages (PEL) Study. The objective of the US 85 PEL Study is to develop a strategic vision for US 85
between 1-76 and the Town of Nunn. Please review the US 85 PEL Study to ensure you are in compliance
with the requirements. More information about this study can be accessed at:
https://www.codot.gov/projects/us85pel.
CONDITIONS OF APPROVAL:
A. The plat shall be amended to delineate the following:
1. Show the Colorado Department of Transportation (CDOT) right-of-way on the plat along
with the documents creating the right-of-way. (Department of Public Works)
2. Show the approved Colorado Department of Transportation (CDOT)access point(s)on the
plat and label with the approved access permit number if applicable. (Department of Public
Works)
3. Show and label a 30-ft. minimum access and utility easement to provide legal access to
the parcel on the plat. (Department of Public Works)
DEVELOPMENT STANDARDS (NOTES ON THE PLAT)
1. The property owner or operator shall be responsible for controlling noxious weeds on the
site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Department of
Public Works)
2. All access and utility easements are dedicated for the benefit of all owners of lots depicted
on this plat, including owners of future lots created therefrom, regardless of lot configuration
or number of users, and without limitation of the use or intensity of the use of such
easements. No lot owner may install a gate or otherwise impede the use of such easements
without the approval of all persons with rights of use of such easements. (Department of

3. Access on the site shall be maintained to mitigate any impacts to the public road including
damages and/or offsite tracking. (Department of Public Works)
4. The historical flow patterns and runoff amounts will be maintained on the site. (Department

Environmental Health Services has reviewed this proposal for a Change of Zone from the C-4
(Highway Commercial) Zone District to the C-3 (Business Commercial) Zone District and
Change of Zone from the A (Agricultural) Zone District to the C-3 (Business Commercial) Zone
District.
The site will be served by a well permitted for commercial use and a commercial on-site
wastewater treatment system (OWTS).
We recommend the following appear as notes on the plat:
1. Water service may be obtained from an appropriately permitted well.
2. The parcel is currently not served by a municipal sanitary sewer system. Sewage
disposal may be by septic systems designed in accordance with the regulations of the
Colorado Department of Public Health and Environment, Water Quality Control
Division and the Weld County Code in effect at the time of construction, repair,
replacement, or modification of the system.
3. Activity or use on the surface of the ground over any part of the OWTS must be
restricted to that which shall allow the system to function as designed and which shall
not contribute to compaction of the soil or to structural loading detrimental to the
structural integrity or capability of the component to function as designed.
4. During development of the site, all land disturbances shall be conducted so that
nuisance conditions are not created. If dust emissions create nuisance conditions, at
the request of Weld County Environmental Health Services, a fugitive dust control plan
must be submitted.
5. If land development exceeds 6 months in duration, the responsible party shall prepare a
fugitive dust control plan, submit an air pollution emissions notice application, and apply
for a permit from the Colorado Department of Public Health and Environment.

Dear Kim Ogle:
We have received your March 6, 2020 proposal to rezone a 0. 95 - acre parcel known as Lot 3 of Minor
Subdivision No. S-293 from highway commercial to agricultural for the I-76 Outdoor Storage project .
The parcel is currently used for farming purposes. The proposed land use is an RV parking , storage,
and staging facility.
This referral does not appear to qualify as a "subdivision " as defined in section 3o-28- 101 ( 10) ( a ) ,
C . R. S . Therefore, pursuant to the State Engineer ' s March 4, 2005 and March 11 , 2011 memorandums
to county planning directors , this office will only perform a cursory review of the referral
information and provide informal comments . The comments do not address the adequacy of the
water supply plan for this project or the ability of the water supply plan to satisfy any County
regulations or requirements . In addition , the comments provided herein cannot be used to
guarantee a viable water supply plan or infrastructure, the issuance of a well permit , or physical
availability of water .
There are no permitted wells on the subject property . Estimated water requirements and proposed
water demand were not provided . Bottled water and portable toilets will be provided to employees.
According to the submitted material , and proposed commercial well may be an additional water
supply source. Any well permit applications will be evaluated pursuant to applicable statutes and
rules at the time that they are submitted .
