RE: APPROVE AGREEMENT FOR SERVICES FOR COUNTY ROAD 49 PARKWAY
EMERGENCY REPAIR WORK AND AUTHORIZE CHAIR TO SIGN -
TML CONSTRUCTORS, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for Services for County
Road 49 Parkway Emergency Repair Work between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, on behalf of the Department of
Public Works, and TML Constructors, Inc., commencing upon full execution of signatures, with
further terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Agreement for Services for County Road 49 Parkway Emergency
Repair Work between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Works, and
TML Constructors, Inc., be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 11th day of May, A.D., 2020.

PASS -AROUND TITLE: Emergency repair work on 49 Parkway (U.P. Rail Crossing)
DEPARTMENT: Public Works DATE: 4.28.2020

Brief description of the problem/issue:
Weld County Parkway is currently down to two lanes just north of WCR 54 by the Union Pacific Rail Crossing,
due to concrete panels which must be repaired by U.P. Public Works staff had a meeting on site with U.P and
determined that there are a couple of reasons why the U.P panels continue to break. Public Works
recommended that we replace the existing 18" Hot Mix Asphalt section with an Asphaltic Plug Joint to help
with the expansion of the concrete roadway after U.P. replaces the damaged panels and U.P agreed with this
approach.
Public Works has contracted out this work in the past and only one company has been awarded this work, TLM
Constructors out of Greeley. Public Works contacted six companies for price quotes, and we received only two
quotes. One quote is from TLM out of Greeley for a total amount of $43,717.00 and ABCO Contracting, Inc
out of Denver for a total amount of $55,000.00. Both contractors cautioned us that the factory that produces
this product has been shut down due to COVID-19 and they only have few months of supply left. Delays in
securing a contract for this work may lead to a chance that this product will not be available by mid to late June.
We did discuss this with Rob Turf Purchasing Manager, and he agreed to move forward with a pass around.
Attached to this pass around are pictures of the area that needs repaired, the asphaltic plug joint product specs
and price quotes from TLM and ABCO. Public Works will use funds that have been budgeted in 2020 for
WCR 49 Parkway Maintenance.
What options exist for the Board? (include consequences, impacts, costs, etc. of options):
1) Place on the next available BOCC agenda.
2) The Board may request a work session to discuss this further.
Recommendation:
Staff recommends approval for TLM Constructors to complete this emergency repair work on WCR 49
Parkway for a total amount of $43,717.00.

Notes:
• Asphaltic Plug Joint — Quoted price includes sandblast prep and installation of an 18 Inch wide by 6 Inch
thick Asphaltic Plug Joint. Material used will be Thorma-Joint Asphaltic Plug joint and will be from the
CDOT APL. Quoted price excludes steel bridging plate because a joint opening is not present. Quoted
price is based on removal and a 2 inch thick asphalt patch being placed by Weld County forces prior to
TLM Constructors mobilization to the project.
• Mobilization — Price is based on one mobilization. TLM Constructors does anticipate one day prep time
without work between phases 1 and 2 to allow County forces to complete removal and asphalt patching,
this is included in the 1 Each Mobilization unit price. Additional mobilizations beyond this note if required
will be billed at $1,500.00 Each.
• The above quoted work is estimated to be completed in 4 work days (2 days per half of roadway). TLM
Constructors will require that traffic be shifted to north bound lanes then to south bound allowing TLM to
have half of the roadway to work in at a time. Traffic Control to be provided by others. TLM Constructors
will not be held responsible for lane rental fees or additional costs for traffic control.
• TLM Constructors will not be held liable for heaving or settling of the Asphaltic Plug joint caused by
movement of the Concrete Roadway or the existing Railroad Track.

Terms: Signature affixed hereon constitutes a binding contract between Contractor and Customer.

A 1.5% FINANCE CHARGE (which is an Annual Percentage Rate of 18%) will be added each
month to all past due accounts.

PRODUCT DESCRIPTION:
Thorma-Joint is the original asphaltic plug expansion joint system. Introduced to
the US market by DSA, Ltd. in the late 1980's, it continues to be first choice
among bridge engineers seeking a cost effective reliable joint system for low
movement structures.
Thorma-Joint is a combination of BJ Supe 0 (a polymer modified asphalt binder),
specifically graded %"aggregate, A36 mild steel plate and heat resistant backer
rod. When installed properly and according to DSA's specifications, Thorma-Joint
is capable of withstanding up to 2" of cumulative movement and providing a water
tight seal to protect the bridge deck and sub structure.
