Mary Ar,i rauvrsrr,;.n Remr,fa- _I RESOLUTION WHEREAS, a public hearing was held on Monday, March 8, 1971 at two o'clock p. m. in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing a petition of Frank .a C. Stewart, P. O. Box 365, Platteville, Colorado, requesting a change of zone from "A" Agricultural District to "C" Commercial District, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the change of zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, and WHEREAS, the Board of County Commissioners has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the petition of Frank C. Stewart for change of zone from "A" Agricultural District to "C" Commercial District, said area being more particularly described as follows: A parcel of land located in the Northwest Quarter (NW+) of Section Eighteen (18), Township Three (3) North, Range Sixty-six (66) West of the 6th P. M. , Weld County, Colorado, more particularly described as follows: Commencing at a point 2, 967 feet east of the Northwest Corner of Section Eighteen (18), Township Three (3) North, Range Sixty-six (66) West and proceeding Southerly 100 feet along the Easterly line of the Union Pacific Railroad which intersects the East West Center line of Section Eighteen (18) at a point 2, 986 feet east of the Southwest Quarter Corner of the Northwest Quarter of said Section 18, to the true point of beginning; thence continuing Southerly 9° 8' East along the same line for a distance of 210 feet, thence Easterly 210 feet on a line parallel to the North line of Section 18, thence Northerly 9° 08' West for a distance of 210 feet and thence Westerly parallel to the North line of Section 18 a distance of 210 feet to the true point of beginning, is hereby granted under the conditions following: 1. The request is for a Change of Zone from "A" Agriculture District to "C" Commercial. +1t this time Mr. Telep will younmake a record. Mr. Telep: Thank you Mr. Chairman, Let the record show that this cause came on for a hearing this day, March 8, 1971, at the hour of 2:00 o'clock P. M. , on the application of Frank C. Stewart of Box 365, Platteville, Colorado, -requesting a Change of Zone from "A" Agriculture District to "C" Commercial District of a parcel of land located in the Northwest Quarter of Section 18, Township 3 North, Range 66 West of the 6th P. M., Weld County, Colorado and more particularly described in metes and bounds and as was published as required by law in the Greeley Booster on January 22 and February 26, 1971 -respectively. Let the record further show that there is on file receipts verifying that notices were -sent by certified mail to the adiacent landowners notifying them -of this hearing today. Let the record still further show that there is on file a resolution from the Weld County Planning Commission recommending favorably as to this Change of Zone and the reasons thereon and they will be more expounded upon by the Planning -Director. Let the record still further show that the applicant $rank C. Stewart is present in person. 1 believe we are ready to proceed Mr. Chairman. Mr. Anderson: Alright Mr. Stewart if you would like to state your case. Mr. Stewart: I am Frank C. Stewart of P. 0. -Box 365 Platteville, Colorado. As was stated by the petition placed before you for this Change of Zoning I felt that I needed someway to have a sister business so to -speak to my sod farm so that I could have an opportunity to build up to the point where I could keep tome permanent employees rather than try to work with seasonal Employees all the time. Seasonal employees are not very reliable, not very efficient. I realize they also need to eat but I need a few fellows for key people to guide some of these folks it would help me to do a better job of regular work which is producing sod and landscaping. The liquid petroleum business, one that is principally needed in the winter time would let people who are sufficienty skilled to drive trucks and meet people and make deliveries of this kind. Course we are there in an area adoing the the Union Pacific Railroad tracks, because we neighbors who are commercial feeding operation. We have Great Western Grower Service Center, their beet dump, the American Chemical Company has a space in there and then we have across the road a mobile home court. I felt this wasn't out of keeping with the type of operation we would have there as far as the total activity. So for this reason we asked to set aside an area that would be 110 feet square adjoining the railroad track. J think we can place a tank and conduct this type of business. There may be some additional points, I notice that Mr. Lorensen's initial study. I think that this covers most of the point that are important today. The only other one would be that in looking for a business that might be of consistant with what we are doing and one that would have an opportunity for its presence we looked into the other business of this kind and we found that there was a propane business in Evans, Greeley, Brighton and Longmont as being the one that were serving this area. Since these were all about 17 miles apart it put the people in this area a great distance from the 'supplier, and quite frequently would run out of propane whenever we were having a serious storm as compared to the ones nearest their plants first. So it seemed quite logical being this far from that we weren't seriously competing with the other people and yet that we would have an opportunity to find enough business to make it possible. Mr. Anderson: Do you have any questions? Mr. Ashley: I the no questions 3 Mr. Billings: No questions. Mr. Anderson: Burman, what do you have to say on this? Mr. Lorensen: Mr. Chairman, the Planning Commission has recommended that this be considered favorably for the following reasons; the existing surrounding land use are of commercial nature and he has already mentioned a good number of them, adiacent rail service, and I also felt there was a need for this type of service as proposed. Mr. Anderson: Is there anyone in the room supporting the application? Is there anyone in the -room objecting to the application'? If not let the record show that Mr. Stewart, the applicant, is the only one here. There is no one in the room objecting. What is your pleasure. Mr. Billings: Mr. Chairman, I think that the evidence that has been presented here, especially to the need of the facility in the area, I didn't realize that there was that much distance between services. I move that we approve the application of Mr. Frank Stewart for Change of Zone from "A" Agriculture District to "C" Commercial District. Mr. Ashley: I second the motion. Mr. Anderson: You have heard the motion, how do you vote on the motion? Mr. Billings: S vote in favor of the motion. Mr. Ashley: I vote yes. Mr. Anderson: The Chair votes yes.
