BOX 758 GREELEY, COLORADO 80632 September 10, 2020 To: Board of County Commissioners From: Toby Taylor Subject: Conservation Reserve Program Reassignment (2020-0767) On March 4, 2020, the Board of County Commissioners (BOCC) approved Resolution 2020-0767 to purchase land from Michael McCrery to accommodate a future rail unloading complex and gravel mining site for the Department of Public Works. This resolution authorized the chairperson of the BOCC to sign all necessary documents for the purchase of the property. Exhibit A is the US Department of Agriculture Conservation Reserve Program contract number 2140Q is for this portion of the property. The CRP obligation for the 87.4 acres ends on September 30, 2023. Exhibit B is the US Department of Agriculture Conservation Reserve Program contract number 10430J is for this portion of the property. otherwise approves such amount, provided further, that such approval must specifically reference the patticulat land placed in the CRP under this conti act, (2) To pay the agreed upon annual rental payment, including any incentive payment, based upon the shares to which the parties have agreed as set foith on Form CRP -1 for a pet rod of years not in excess of the contract per rod, i (3) To pay to the pal ticipant, to the extent iequii ed by CCC regulations, an interest penalty on cost- shale payments, incentive payments, and all annual' ental payments not made by the date, as deter mined by CCC, that the payment is due, (4) To make annual tental payments after October 1 of each yea' of the contract period 5 CONSERVATION PLAN A Subject to the approval of CCC, the Conservation Plan will include some o' all of the following info'mation and t equii ements (1) The vegetative or water covet to be established on the CRP land, (2) A tree planting plan, developed in cooperation with the Forest Service, if tees ate to be established as the vegetative cover on the CRP land, (3) A schedule of completion dates fot establishment of the covet on the CRP land, (4) The level of environmental benefits which must be attained on the CRP land, (5) Any other piactices iequued foi the establishment or maintenance of the covet on the CRP land including weed, insect, pest, and other controls of undesirable species, and such maintenance as necessaiy to avoid an adverse impact on surrounding land as determined appiopt late by CCC, taking into consideration the needs of water quality, wildlife concerns, and othei facto's (6) The act cage will not be distui bed dui ing the pi'maiy nesting season for wildlife as determined by CCC (7) Management activities authorized by paragraph 6 B By signing the Conservation Plan, the paiticipant agrees to implement the practices specified in such Conse'vation Plan on the CRP land even if such piactices differ ftom those listed on Foim CRP -1 6 MANAGEMENT ACTIVITIES Subject to the approval of CCC, the Conservation Plan may include managed glazing of har vesting of the cover on the CRP land, including biomass, as necessary to avoid an adverse impact on surrounding land, as determined appropriate by CCC, taking into consideration the needs of the vegetative cove', wildlife concerns, and othei facto's Managed glazing oi harvesting may be plan and with appiopt tate standards and specifications B CCC will not make cost -shale payments in excess of 50 pei cent of the actual or average cost of establishing the eligible piactice specified in the Conservation Plan as determined by CCC It is understood that all cost -shares from all sources must be reported to CCC and that a 'eduction in the CCC cost-shaie may be made iftheie ate othei cost -shares iecerved Such ieductions will be made to the extent required or allowed by the ptogiam regulations C Except as otheiwise provided foi in ptogiam regulations cost -shale assistance may be signup an opportunity to participate in the benefits of the piogi am, (ii) 'educed the number of tenants on the faim as a result of or in anticipation ofemollment in the CRP (b) when the act cage offered is eniolled in the CRP at the time of signup, not piovided tenants with an Interest in the CRP contract act cage an opportunity to patticipate in the benefits of the ptogiam if (i) the tenants are otheiwise involved in fatming other acieage, as determined by CCC, on the faim at the time of signup, 01 (ii) the tenants have an Interest in the acieage being offered on the effective date of the the put poses of this CRP contract, oi made any fraudulent representation with respect to this contract will not be entitled to payments oi any othei benefits made in accordance with this CRP contract and the pat ticipant must refund to CCC all payments received by such participant, plus interest and liquidated damages thereon, with respect to the CRP contact Such liquidated damages will be deter mined in accordance with paragraph 10 of this Appendix B Unless CCC regulations provide otherwise, refunds determined to be due and owing to CCC in accordance with this CRP contract will beat interest contact piesciibed in this contract, the participant agrees to pay an amount equal to the product obtained by multiplying (1) 25 percent of the rental payment rate per acre on Form CRP -1 by, (2) the number of acres that are the subject of the CRP cont act Such amount shall be due as liquidated damages in addition to such othei damages oi amounts as may be due, and not as a penalty 11 NOTIFICATION OF CHANGES TO TERMS AND CONDITIONS OF THE CONTRACT CCC agrees that, if any changes of any teems and conditions of this CRP con act, including changes necessary to reconcile the piactices listed on the conservation distt ict may be obtained by CCC when modifications to this contt act involve a technical aspect of a patticipant's Conservation Plan 15 EFFECTIVE DATE AND CHANGES TO CONTRACT A The CRP contract is effective when, as determined by CCC it has been signed by the paiticipants and an authorized reptesentative of CCC Except as otheiwise determined by CCC, as petmitted by regulations of othei law, the CRP contract may' not be revoked oi revised unless by mutual agreement between the patties If, after the effective date of this contract, CCC determines that the offered acreage was eiioneously enrolled oi otheiwise ineligible foi enrollment, CCC may terminate the contract Such termination shall not effect payments already made to the paiticipants as of the time of teimination
