No. 1706850 Mary Ann +m.erstein, Rescrder RESOLUTION WHEREAS, a public hearing was held on March 26, 1973, in the chambers of the Board of County Commissioners, Weld County, Colo- rado, for the purpose of hearing the petition of Virgil Mathews, First National Bank Building, Greeley, Colorado, requesting change of zone from "A" Agricultural District to "B-UD" Business Unit Develop- ment of a tract of land as hereinafter recited, all as appears on plat as submitted and made a part hereof by reference, and WHEREAS, the petitioner was present and represented by counsel, James H. Shelton, and WHEREAS, there was some opposition to the change of zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements from those present, and WHEREAS, the Board of County Commissioners has studied the recommendations of the Weld County Planning Commission as sub- mitted, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, County of Weld, State of Colorado, for change of zone from "A" Agricultural District to "B-UD" Business Unit Development of a tract of land as appears on plat, said area being more particularly described as follows: A tract of land located in the Southeast Quarter of the Southwest Quarter of Section 7, Township 5 North, Range 66 West, of the Sixth P. M. , Weld County, Colorado and being more particularly described as follows: Beginning at the South Quarter Corner of said Section 7, and considering the South Line of the Southeast Quarter of the Southwest Quarter of said Section 7 to bear South 89 deg. 59'50" West with all bearings contained herein being relative thereto: Thence South 89 deg. 59'50" West, along the South line of said Southeast Quarter of the South- west Quarter, 1322. 47 feet to the Southwest Corner of said Southeast Quarter of the Southwest Quarter; Thence North 01 deg. 07'37" West, along the West Line of said Southeast Quarter of the Southwest Quarter, 1338. 18 feet to the Northwest Corner of said Southeast Quarter of the Southwest Quarter; Thence South 89 deg. 50'44" East, along the North line of said Southeast Quarter of the Southwest Quarter, 1323. 20 feet to the Northeast Corner of said Southeast Quarter of the Southwest Quarter; Thence South 01 deg. 05'56" East, along the East Line of said Southeast Quarter of the C 730022 Southwest Quarter, 1334. 53 feet to the Point of Beginning, said tract containing 40. 574 acres more or less, is hereby granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. All applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the zoning resolutions of Weld County, Colorado. 3. The City of Tree1ey's Planning -Commission has reviewed the proposed zone change from County -Agriculture to _County Business Unit Development for a KOA Campground site. The Commission unanimously moved that they have no objections to this change of zone as long as the following conditions are met: 1 . ) The Water Director indicated that the developers would have to extend, from a point approximately one-half -mile to the East, an eight inch (8" ) water line to proviAe sufficient service. Presently there is an existing four inch (4") distribution line and a 24" transmission tine. The 24" trans- mission line will not be allowed to be tapped at this time and the four inch (4") distribution line is inadequate to service this development. 2. ) The Greeley Fire Department has requested that, if -this property is to be serviced with Greeley's water, that adequate fire hydrants be provided within the -development, rather than the chemical fire extinguishers, as illustrated. 3. ) It was indicated -that a six inch (b") master meter be installed at the -property line anzt that all of the water, including water for fire protection, -be metered. In this way the lines within the park itself will be the responsibility of the owner. 4.) The package sewage treatment facility is an -adequate means of disposing of the sewage; however, the City of Greeley's Public Works Director would like to review all possibilities for the sewage plant prior -to it being installed. The applicant must also agree -that when the City of Greeley's sewer line comes within reasonable distance to the property, that they will attach it to the system. V A K0A Campground 30 November 1972 Page Two 5. ) It was felt that twenty (20) drive-thru sites with sewer facilities in Phase I and 21 -drive-thru sites in -Phase II was an inadequate number of sites with sewer capabilities. The staff felt that a minimum of 35-40% of -the sites should be capable of handling sewage. 6. ) A ten (10) foot utility easement should be provided around the _perimeter of the property, except that _portion affronting on the County -Road #5$. 7. ) A question has arisen regarding the possibility of installing the _proposed dam across sheep Draw. Although this _proposal would serve adequately -in control of the drainage of the area, the facilities of such a _proposal seems impossible .because Af the Colorado water laws. We felt that this item should be investigated in more Aepth with written statements from the appropriate authorities regarding the facilities. 8. ) That a solid screen be _provided along the _property lines of the property. Such screening shall be of a type which will provide a minimum height of twenty feet (20' ) within 15 years and of such a type that will provide adequate year-around screening, such as evergreens. The developer should also dedicate the rinund and open-space, as required -by the County Subdivision e tions and this land should be located in the vacinity of Sheep's Draw. since the County does not have any facilities for development and maintenance of such facilities the developer should be responsitle for such development and maintenance until such time as the area is annexed to the City of Greeley or a recreation district is formed. Points we noted that would merit consideration are as follows: I. Dam a. The water in Sheep Draw has been filed upon; the downstream users would have to be satisfied in order to interrupt the stream flow. b. Possible pollution of the water going downstream. c . Possibility of raising water table on adjacent lands. II. Sanitary Waste Disposal a, Possibility of pollution of stream by the system. The stream is used for stock water below the site. III. Existing Irrigation Structures a. The underground pipeline and syphon of the North Boomerang cannot be interferred with for operation or maintenance. ,I IV. Soils a, There may be outcroppings of underground sandstone formations , that are not indicated on the soils map, that could be difficult to lay water and sewer lines through. V. Law and Order a. A facility such as this would demand policing by the proper law enforcement agency. For the more technical aspects as to soils and hydrology we asked assistance from the Soil Conservation Service. Their comments are as follows: "This site consists of approximately 40 acres located in the abovementioned section. The soils within the site are 51B-C, Vona Sandy Loam, 3 to 5% slope; 53-D, Otero Sandy Loam, 5 to 9% slope and 55-B, Ascalon Sandy Loam, 1 to 3% slope. The Otero and Vona are deep, sandy soils with moderately rapid movement of air and water through the soil. They have only slight limitations for campgrounds where the slopes are less than 5%. Where placed on slopes of 5 to 9% the limitations are moderate. The Otero soils have moderate to severe limitations for reservoirs and sewace lagoons because of the Mr. Burman Lorenson - November 28, 1972 Page 2 moderately rapid movement of water through the soil. The Vona soils have severe limitations for reservoirs and sewage lagoons because of rapid movement of water through the soil. Wind erosion will be a problem if these soils are left without adequate cover. The Ascalon soils have only slight limitations for campgrounds. Because of moderate to moderately rapid movement of water through the Ascalon soils the limitations for reservoir and sewage lagoons are moderate. The control of erosion and sediment will be a problem during the construc- tion phase because the area is subject to high intensity storms that will cause severe erosion of soil particles on the surface when vegetation is removed. A minimum of vegetation should be removed at any one time. Temporary seeding or mulch should be used on areas exposed for a period of ' time to prevent wind and water erosion and sediment production which might find its way into Sheep Draw. If there are heavy road cuts and £ills , jute matting or mulch should be used on such areas to help control erosion after seeding of permanent grasses . The developer should prepare a plan showing how he intends to control erosion and sediment production during construc- ; tion and after construction is complete. Sheep Draw, a water course on a drainage of about 8 square miles, passes through the development area. Consideration must be given to provide ade- quate spillway facilities for the proposed dam. Flood plain boundaries have not been shown; therefore, it is not known what effect flooding will have on the campsites or facilities. It does appear very likely that after construction of the dam, as shown on the plan, some campsites will be inun- dated at times of peak runoff from 25 year frequency storms and storms of greater intensity. All natural runoff drainageways should be used and no major changes or alterations of the drainageways should take place. This siphon pipeline serves irrigated lands in over 9 sections. Any disturbance of the ground area or the underground support for this siphon pipe- line would be disastrous to the farms irrigating under this system. The Boomerang Lateral Company must object most strongly and would consider bringing action, if necessary, to protect its right of way for this siphon line from any encroachment , not onlylon the surface, but underground whether underneath or on top of -the siphon pipeline since the unnecessary operation, maintenance and repair of any underground water or sewer lines serving the KOA Kampgrounds could damage the supporting groun,i for this siphon line . The plat submitted to the Boomerang Lateral Company indicates the planners and developers of the KOA Kamngrounds intend to cross in several places the right of way of the siphon pipeline and to have certain facilities installed on the surface of the grounds underlying the siphon pipeline. Were it necessary* to make emergency and immediate repairs to the siphon pipeline, the presence on the surface of facilities to serve the campgrounds :could cause a problem which should be avoided. Sheep draw is a low flow watercourse whose water quality could be affected quite adversely if the treated sewage effluent quality is not excellent. 2. Such an operation would strain many types of sewage treatment systems because of the intermittent plant loadings. Therefore, it is recommended that a polishing pond follow any secondary treatment system to guard against the discharge of inadequately treated wastes because of an upset system. The secondary system chosen should be one that is little affected by variable plant loading. 3. Sewage treatment systems require proper operation and maintenance to produce a well treated effluent. The type of secondary treatment system used should be simple to operate and require as little maintenance as possible. An example of such a system would be an aerated lagoon. 4. Operators of small sewage treatment systems such as this will have to "be on their toes" all the time to assure that their effluent meets State effluent standards, if adopted as proposed. 3. The owner of this development will have to file with the Water Pollution Control Commission a NOTIFICATION OF PROPOSED DISCHARGE TO WATERS OF THE STATE NON-MUNICIPAL OR NON-SANITATION DISTRICT SEWAGE TREATMENT WORKS. He should _contact the local, health department, or this Division to _obtain the forms. He will then have to submit other material , such as engineering reports and plans, along with the forms.
