Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: Parcel(s): 054521000007, 054521400030 The project proposes to: Change of Zone from the A (Agricultural) Zone District to the C-3 (Business Commercial) Zone District ACCESS: Weld County Public Works has reviewed the application materials related to access. Access onto the parcel is from State Highway 14. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to state highways. Please contact Tim Bilobran at the Greeley office (970-350-2163) to verify the access permit or for any additional requirements that may be needed. (State Highway 14) ROADS AND RIGHT-OF-WAY: The property is bounded by State Highway 14. Contact the Colorado Department of Transportation (CDOT) to determine what right-of-way shall be shown on the submitted plat. Reference the documents creating the right-of-way. The gas station is currently served by Briggsdale Water Company and a commercial on-site wastewater treatment system (OWTS)(SP-1300199). The caretaker's residence has an unpermitted OWTS which will be addressed through the site plan review. We recommend the following appear as notes on the plat: 1. Water service may be obtained from Briggsdale Water Company. 2. The parcel is currently not served by a municipal sanitary sewer system. Sewage disposal may be by on-site wastewater treatment systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Activity or use on the surface of the ground over any part of the on-site wastewater treatment system must be restricted to that which shall allow the system to function as designed and which shall not contribute to compaction of the soil or to structural loading detrimental to the structural integrity or capability of the component to function as designed. 4. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of Weld County Environmental Health Services, a fugitive dust control plan must be submitted. 5. If land development exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice application, and apply for a permit from the Colorado Department of Public Health and Environment. T$ #� - To: Kim Ogle, Planner August 18, 2020 From: Hannah Dutrow, Zoning Compliance Officer Subject: COZ20-0006 Referral Upon review of my case files and computer, an active Zoning Violation(ZCV19-00301)was noted on one parcel this Change of Zone will encompass. This violation was initiated due to the presence of Commercial Storage of mobile homes on site without first obtaining the required land use permits. In addition,after initiation of the violation the Weld County Planning Department discovered there were three Dwelling Units on site. This case has not been forwarded to the County Attorney's Office; therefore, an investigation fee IS NOT required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff-initiated complaints. Approval of this application will correct a portion of the violation as it will allow them to permit a Dwelling Unit. Therefore, staff requests that the following be a requirement prior to approval of this Amended Recorded Exemption application. • Removal of all the Pre-HUD mobile homes and debris on site • Permit the remaining Dwelling Unit • Amendment for Site Plan Review SERVICE.TEAMWORK.INTEGRITY.QUALITY Hello
