The statement in the 5t1i recital about the 7 qualified individuals in accurate. However, only 5 of the 7 indicated willingness to serve on the Board and the Board is only a 5 -member board. Unfortunately, this is the first I have seen of the resolution and it incorrectly identifies the date of the election art which the directors will be up for election. Given the date of the County's approval of the resolution is was at that time already impossible to hold a May 5, 2020 election for the special district. The election is required to be held by statute within 6 months of the appointment and only on certain statutorily allowed dates — as such the soonest the election can be held is October 6, 2020. A map and legal description of the boundaries of the District are enclosed herewith. Our firm represents eligible electors of the District and is requesting the Board of County Commissioners of the County of Weld, Colorado (the "County") appoint directors to fill the vacancies on the Board of Directors of the District pursuant to § 32-1-905(2.5), C.R.S. Iii Bruce, As a follow-up to our brief conversation this afternoon, here is some additional information in response to some of the questions I was able to catch during today's BoCC meeting. The Board was entirely vacated due to transition of the property from the former owner to the current owner sometime during or before 2018 - With no Board of Directors the District is completely unable to take actions or comply with statutory requirements, this would include responding to a request for an annual report or quinquennial finding of reasonable diligence Based on the last available financial information from the District, the District has not assessed a mill levy or issued any bonded indebtedness. - The eligible electors that have submitted letters of interest in serving on the Board of Directors are qualified under purchase contracts with Anadarko E & P Onshore, LLC 1 Once the BoCC appoints a Board of Directors that Board of Directors shall call for nominations for a special election within six months after their appointment. We are now too late for that to occur in conjunction with the May 5, 2020 regular election, instead this would occur as a court -order special election within the statutorily required 6 -month window. I will leave the only questions I head, which I am listing below, for Chad to respond to since they are outside of the scope of what I have been advising on: 1. Shortly after the COZ was approved the Board approved the Service Plan. However, the developer never followed through with the final plan / plat. The Board gave a two year extension in 2014 to get the final plat recorded in 2016. Right about the time this extension expired the developer sold the property to Anadarko for $5,250,000. Kim and I spoke to reps from Anadarko about two years ago asking them if they had any plans to develop and their response at that time was "no". We even suggested at the time to change the zoning back to Ag if they were not going to develop. We heard crickets after that. Chris Kennedy who is the planner for Mead said that Oxy approached them last year to discuss annexation, but they haven't received a formal annexation petition as of today. Tom Chend L.
