LEASE -PURCHASE AGREEMENT.
This Agreement made and entered into. this day of
June, 1976,. by and between ORVILLE J. HOFF and R. HOFF,
Husband and Wife, hereinafter called "Lessors.' and ROBERT V.
DOTSON and COLLEEN E. DOTSON, Husband and Wife, hereinafter
called "Lessees,"
. WITNESSETH: FOR AND IN CONSIDERATION of the mutual promioese, covenants,
and undertakings herein contained, the Parties agree as follows:
1. GRANT OF LEASE HOLD
The Lessors hereby, lease to Lessees and Lessees lease
from Lessors the following described lands lying and being in
the County of Weld, and State of Colorado, to wit:
Lots Two (2) and Three (3) of the Southeast (SE)
Quarter of the Southwest (SW) Quarter of Section
Nine (9)., Township Five (5) North (N) , Range
Sixty-five (65) West (W) of the 6th P.H., accord-
ing to the subdivision of lands by the Union
Colony of Colorado, together with Two (2) shares
of the capital stock of the Greeley Irrigation
Company, and Two (2) shares of the capital stock
of the Orange Street Ditch Company , and the
ELIZABETH KUNTZ WELL AND PLUMPING PLANT and the
appropriation therefor as decreed to the said
WELL AND PUMPING PLANT by Subterranean Well
Priority No. 227SW, pursuant to findings and
Decree, Certified Copy of which La of record in
Book 1370, Page 74, and in Book 1373. Page 533 ,
of the Weld County Records
together with permanent improvements located thereon and together
with all lighting, heating and plumbing fixtures; all outdoor
plants, window and porch shades, venetian blinds, storm windolrs,,::
etrom doors, screens, curtain rods, drapery rods, central air-
conditioning (if any), ventilating fixturea,attached t.v. antennas,
attached mirrors, linoleum, awnings, fireplace screen and grate,
built-in kitchen appliances and wall, to wall carpeting.
2. TERM
The term of this Lease shall be for.four (4) years commencing
on the date first above written and expiring on the sane day and
month of the year 1980.
3. RENT
Lesgeee sha11, as payment of rent for the entire term.herein
described. convey all of their right, title and interest in and to
Lot Ten (10). Panorama Park, a Subdivision of the City of Greeley.
Weld County, Colorado, subject to an existing Deed of Trust in
favor of Northern Colorado Savings and Loan Association and subject
to an existing assessment for curb and gutter improvements i.n an
approximate amount of $3,500.00. The value of the Lessees' interest

as being Twenty, Thousand Dollars ($2C,000.0O).
4. MAINTENANCE AND REPAIR
During the.term of this Lease, the Lessees shall have the
responsibility and obligation at their sole cost and expense to
keep the premiaee in good repair. Lessees shall further pay all
utility expenses .and water rents. Lessees shall. further pay in
• full for all improvements made upon the above described property
and shall not suffer -or permit or cause any liens te be placed
against said property whatever,
5. TAXES AND INSURANCE
SO loagg as t ease s ali remain in effect, the Lessors
shall pay all taxes and aesesaients levied upon the said property
and shall maintain fire,and and extended coverage insurance in an
amount not less than Sixty Thousand Dollars ($60,000.00), and
shall upon demand of Lessees exhibit said policy or'a copy thereof
to Lessees. In the event of damage or destruction to the improve-
ments upon the above described heal estate which result in the
payment of insurance saorliea, the parties agree that such money
shall be applied to the reconstruction of the improvements upon
the said real property. •
6:'.GRANT OF OPTION TO PURCHASE
.The Lessors d o hereby further grant unto the -Lessees en
option to purchase the demised premises together with all personal
.property described above located thereon, which option shall. •
extend to -and until the expiration of the termof the Lease, as
set forth above in paragraph 2.
7. PURCHASE PRICE `
In the event t at essees exercise their option to purchase
the demised premises, the purchase price shall be Eighty-five
Thousand Dollars ($85,000.00), payable in cash or certified funds
at closing. Any unused or unearned rent, prorated to the date
of closing, shall be applied to the purchase price.
• 8. OPTION -EXERCISE PROCEDURE :
Lessees shall exercise their option to purchase the demised .
premises by aerving upon Lessors written notice of their intent
to exercise the option. :Upon receipt of such notification, Lessors
shall furnish Lessees with an abstract of title to said property,.
certified to date, or a current commitment for title insurance
policy in an amount equal to the purchase price, at sellers'. sole
c tion•and expense. Said abstract of title or current commitment
shall be furnished to purchasers within two (2) weeks of the
date of receipt by Lessors of Lessees' notification of intent to

9. Trru
Titles shall be merchantable in Lessors, and they shall eiti C.lyhr
cute and deliver to Lessees a good and sufficient general warranty
deed at closing conveying said property free and clear of all
taxes except the general taxes for the year of conveyance payable
in the followingyear and free and clear of all liens for special
improvements installed on the date of exercise of option, whether

encumbrances except reservations, restrictions, timitatione and
exceptions contained in instruments of record. Any encumbrance

10. CLOSING AND PRORATION DATE

later than thirty (30) days from the date on which Lessors
receive Lesscee' notice of intent to exercise option. General
taxes for the year of conveyance based upon the most recent levy
and assessment, prepaid rent; insurance premiums and irate*set.

closing.
