Home My WebLink About710301.tiff y✓/a £71 FINDINGS AND RESOLUTION CONCERNING PETITION OF DONALD COULS©N AND BETTY COULSON FOR A DOG KENNEL OPERATION The petition of Donald Coulson and Betty Coulson, Rt. 3, Box 320, Golden; Colorado, for permission to locate a dog kennel operation on the following described property, to-wit: A parcel of land located in the Southwest Quarter (SW4) of Section Twenty-five (25), Township Four (4) North, Range Sixty-five (65) West of the Sixth P. M. , Weld County, Colorado, more particularly described as follows: Commencing at the Southwest corner of•said Section; thence East along the South line of said Section 160 2/ 3 rods;to a point; thence North at right angles 160 rods; thence West at right angles 160 2/3 rods to the West line of said Section; thence South at right angles 160 rods along the West line of said Section to the point of beginning; excepting therefrom right of way conveyed to the Farmers Reservoir and Irrigation Company by deedlrecorded in Book 406, at Page 2, of Weld County, Colorado records and except reservations as contained in patent recorded in Book 201 at Page 401 and in deed recorded in Book 346 at Page 537 of said Weld County Records, and - i came on forihearing on February 8, 1971, and the Board of County Commissioners of the County of Weld, having heard the testimony and evidence adduced upon said hearing, and having c'onsidered the testimony, evidence and statements and recommendations of the Weld County Planning Commission filed with said Board, and having made physical inspection of the above-described premises, and having carefully weighed the same, now makes the following findings: 1. The evidence and investigation shows that the location of said dog kennel operation lies in a potential growth area and same would be too visible and unsightly and not indicative of good planning. 2. The evidence and further investigation shows that the inhabitants of the immediate vicinity and of the surrounding area are unanimously opposed to having a dog kennel operation at the proposed location. 3. Still further investigation by the Board shows that said location - for a dog kennel operation would be a noise nuisance to the surrounding property owners, including owners of cattle herds.. 4. That each of the preceding findings, in and of themselves and independentlof each other, constitutes a separate and individual ground for denial o the request for said dog-kennel operation. • II . PL0648 710301 RESOLUTION WHEREAS, the Board of County Commissioners of the County of Weld has heard the application of Donald Coulson and Betty Coulson for permission 'to locate a dog kennel operation on the following described property, to-wit: A parcel of land located in the Southwest Quarter (SW4) of Section Twenty-five (25), Township Four (4) North, Range Sixty-five (65) West of the Sixth P. M. , Weld County, Colorado, more particularly described as follows: I ' Commencing at the Southwest corner of said Section; thence East along the South line of said Section 160 2/3 rods; to a point; thence North at right angles 160 rods; thence West at right angles 160 2/3 rods to the West line of said Section; thence South at right angles 160 rods , along the West line of said Section to the point of beginning; excepting therefrom right of way conveyed to the Farmers Reservoir and Irrigation Company by deed recorded in Book 406, at Page 2, of Weld County, Colorado records and except reservations as contained in p4.tent recorded in Book 201 at Page 401 and in deed recorded in Book 346 at Page 537 of said Weld County Records, and WHEREAS, the said requested dog kennel operation is in an agricultural zone as set for.th.'by,the.:Weld County Zoning Resolution, and WHEREAS, according.to Section 3. 3 (3) of the Zoning Resolution of Weld County,• said dog kennel operation may be' authorized upon the approval oflthe Board-of County Commissioners of Weld County, and WHEREAS, said Board has made its findings upon the evidence and testimony submitted to it, including independent investigation by the Board, which findings precede this Resolution and by reference are incorporated herein and made a part hereof, and WHEREAS, the said Board has carefully considered the petition, evidence and testimony and the recommendation of the Weld County Planning Commission, and given the same such weight as it in its discretion deems proper, and is now fully advised in the premises; NOW, THEREFORE, BE IT RESOLVED, that the petition of Donald Coulson and Betty Coulson, Rt. 3, Box 320', Golden, Colorado, for per- mission to locate a dog kennel operation on the land indicated above be, and it hereby is denied upon each of the grounds set forth. in the Board's findings therein. Will start with a small breeding kennel. State regulations are very strict which they will have to abide by. Mr. Lorenson recommended approval for the following reasons: the operation has been approved by the Health Department, the nearest residence is 1/2Imile away and there are only 3 residences within a mile radius of the site. Subject to a plot plan being filed, state the maximum number of animals and a written statement.on the type of operation they plan. RESOLUTION: Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Mr. Lorensons requests. Motion by Mr. Heitman, secondlby Mr. Bowles. A unanimous vote of "Aye". Motion carried. • SUBJECT: Right/of/way Dedication by Patrick Collins . LOCATI.ON: SEil Sec.12 T2 R68 tape . 316 DISCUSSION: Mr. Collins bought a lot in a non-conforming subdivision. Before . being issued a building permit, he was requested to dedicate an additional 20' oil R/W to the County. , RESOLUTION: I Be it therefore resolved to accept the dedication with the County being responsible for having the instrument recorded. Motion by Mr. Bowles, :second' by Mr. Anderson. A unanimous vote of "Aye". Motion carried. • DISCUSSION: Ken P. Nelson of Longmont inquired the Planning Commission's feeling on zoning-on a parcel of ground in the SWJ Sec 35 T2 R68 from Agriculture . to Commercial. The Puritan Substation owned by the PSC is being abandoned. • The property will revert to the original owner. Dennis Scholl reported the State Highway Department has plans for an intercharge at this corner. If they have to acquire property for this purpose, it would be much more expensive for commercial property than for agricultural property. Mr. • • NelsonIstated they had had several inquiries for commercial property at this location. Mr. Lorenson pointed out actress the intersection to the southwest there !is approximately 17 acres of commercial property that is not being used. It was agreed a change of zone would not be considered until they had a direct proposal rather than zone it commercial and then look for something to go in there.
