From the 2017 Court of Appeals decision: Plaintiffs first argue that there was no competent evidence in the record supporting the board's finding that the proposed use would be compatible with the existing surrounding land uses. We agree because the board's conclusion that the project would be compatible relied on an unsupported conclusion that the proposed use would mitigate noise to a residential level.
