7. Business Purposes: To (a) construct, own and operate a pipeline and appurtenant facilities
for the public purpose of transportation of oil, oil products, gas, liquefied minerals and
other mineral solutions in order to serve the public as a common carrier pipeline for hire,
such pipeline and appurtenant facilities to be located from, in or around Platte County,
Wyoming and continuing through Wyoming in a southeasterly direction (including through
some or all of the following Wyoming counties: Goshen and Laramie), into and through
Colorado in a southeasterly direction (including through some or all of the following
Colorado counties: Weld, Morgan, Washington and Kit Carson), into and through Kansas
in a southeasterly direction (including through some or all of the following Kansas
counties: Wallace, Logan, Wichita, Scott, Lane, Ness, Hodgeman, Pawnee, Stafford, Pratt,
Reno and Kingman Harper, and continuing in a southeasterly direction into Oklahoma to
a products terminal in Payne County, Oklahoma (including through some or all of the
following Oklahoma counties: Grant, Kay, Noble and Payne), provided, that the route and
location of the pipeline and appurtenant facilities as initial planned are subject to change
based upon, among other things, commercial commitments, final design, local, state and
federal governmental approvals, and construction necessities; (b) hold and otherwise own
and manage all capital contributions and other assets as may be developed, constructed,
acquired by or contributed to the Company; and (c) engage in all lawful activities
necessary, customary or incidental to any of the foregoing activities, including, but not
limited to, any future expansion projects for the pipeline and appurtenant facilities.
