RESOLUTION RE: APPROVE RENEWAL APPLICATION FOR AN OPTIONAL PREMISES (COUNTY) LIQUOR LICENSE FROM IHRF, INC., AND AUTHORIZE CHAIR TO SIGN - EXPIRES AUGUST 1, 2021 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, IHRF, Inc., presented to the Board of County Commissioners of Weld County, Colorado, an application for the renewal of an Optional Premises (County) Liquor License, for the sale of malt, vinous, and spirituous liquors, subject to the rules and regulations found in Article 3, Title 44, C.R.S., and WHEREAS, pursuant to Exhibit 5-H of the Weld County Code, said applicant has paid the sum of $175.00 to the County of Weld for the renewal of the existing license, and WHEREAS, said applicant has exhibited a State Liquor License for the sale of malt, vinous, and spirituous liquors for consumption by the drink on the premises only, outside the corporate limits of any town or city in the County of Weld at the location described as follows: 18233 County Road 96 Pierce, Colorado 80650 WHEREAS, the Licensee shall host "responsible vendor" training every six (6) months as agreeable to the Colorado Department of Revenue Liquor Enforcement Division, and this training shall be open to other area licensees. Each employee shall be "responsible vendor" trained, and the Licensee shall provide documentary evidence that each employee has been "responsible vendor" trained to the Weld County Sheriff's Office within thirty (30) days of the first available "responsible vendor" class after hiring. Evidence of such shall be included in the referral report submitted by the Sheriff's Office at the time of annual renewal. The Sheriff's Office has recommended denial based on an event occurring last August 2019, which is outlined in their referral response. We will present the application to you then, but I wanted to remind you of the procedures and options. Typically, a liquor license renewal is not a public hearing, but Weld County Code section 12-2-30 (Application for renewal) allows you to schedule one if you find probable cause to believe that any of the factors contained in section 12-2-40 exists. I have attached these code provisions for your review. If you find probable cause, you may schedule a public hearing (like a show cause hearing) at which you would consider whether good cause exists to refuse to renew the liquor license, considering all the factors in section 12-2-40. This is "Phase 1" of the public hearing. If you find good cause exists to refuse to renew the license, "Phase 2" of the public hearing requires you to consider the aggravating or mitigating factors outlined in section 12-2-50. Both phases would take place on the same day. Your options on Monday will be to either (1) renew the license, or (2) schedule a public hearing. Because this is a quasi-judicial hearing, I will be present next Monday to answer any questions you may have. Evidence that the licensee or applicant has failed to comply with any special terms or conditions that were placed on its license in prior disciplinary proceedings or arose in the context of potential disciplinary proceeding. C. Evidence that the licensed premises have been operated in a manner that adversely affects the public health, welfare or safety of the immediate neighborhood in which the establishment is located, which evidence must include a continuing pattern of fights, violent activity or disorderly conduct. For purposes of this Paragraph C., disorderly conduct has the meaning as provided for in C.R.S. § 18-9-106. D. Evidence that the licensee is no longer of good character. E. Whether there have been any violations in the last one-year period by the licensee or by any of the agents, servants or employees of the licensee of the provisions of the Colorado Liquor Code, or any of the rules or regulations authorized pursuant to the Colorado Liquor Code, or any of the terms, conditions or provisions under which the license was issued. F. Evidence showing excessive noise, rowdiness or disturbances on a continuous basis in the immediate area of the licensed premises which were substantially as a result of the operation of the licensed premises. G. Evidence of persons being convicted under C.R.S. § 42-4-1301, of driving under the influence of alcohol or driving while alcohol impaired after becoming intoxicated at said licensed premises. H. Evidence that the reasonable requirements of the neighborhood are not being met. Seriousness of the factor in terms of the affront to the public. B. Corrective actions taken by the license holder. C. Prior violations, offenses and occurrences at the licensed premises and effectiveness of prior corrective action. D. Prior violations and offenses by the licensee. E. Violation, offense or occurrence as a repeated course of conduct or as a single event. F. Likelihood of recurrence. G. All circumstances surrounding the violation, offense or occurrence. H. Willfulness of violations, offenses, or occurrences. I. Length of time the license has been held by the licensee being disciplined. J. Previous sanctions imposed against the licensee. K. Other factors making the situation unique to the licensee or premises subjected to discipline. Deputy estimated over 100 vehicles and over 500 people leaving the area as he approached the scene. Deputy estimated 30 security personnel and 6 portable toilets on scene. 19W030487: 08/17/2019 Adult female reports that she was hit in the face by another female. Two days after the assault the victim called in to the deputy handling the case. The victim refused to prosecute and would not provide the deputy the suspects name. 19W030488: 08/17/2019 A security guard was hit in the head while trying to break-up a fight. His injury required a trip to the hospital. He received 6 staples to treat the injury. Unknown suspect. A check in Spillman for the applicant Ana Ornelas provided no information. No other significant calls for service were found during a search of Spillman for the address. It is the recommendation for the Sheriff's Office that the liquor license not be issued for this event, due to the above listed incidents.
