The Moody property contains 145.556 acres and is located in Weld County, Colorado. The
proposed Project will include 31 single-family lots that range from 3.201 to 6.363 acres in size. The
property's borders include:
• North: Weld County Road (WCR) 80. Belmont Farms Subdivision (Town of Severance)
• East: Undeveloped land in Weld County.
• South: Undeveloped land in Weld County.
• West: Undeveloped land in Weld County.
The area to be developed lies within the Town of Severance Rural Residential zone as designated by
the Hometown Vision Comprehensive Plan. See map below indicating location and vicinity.
Proposed Land Uses
The Mul..in Estates Subdivision Annexation will be a low -density, single-family rural residential
subdivision near the Town's outer fringe, It is proposed to have 31 residential lots that will be
developed over 2 phases with 13 lots in the first phase and 18 lots in the second phase.

Annexation Agreement
Per Colorado Revised Statutes 2013 134 Tide 134, an agreement will be drafted between the
property owner and municipality outlining the responsibilities of each party.
Municipal Services
The area to be annexed as will receive the following municipal services from the stated responsible
agencies:
• Water: To be served by a proposed potable water system from North Weld County
Water District. See more below
• Sewer: To be served by Onsite Wastewater Treatment Systems (OWTS)
• Police: Severance Police Department. See more below.
• Fire & Emergency Services: Windsor Severance Fire Rescue. Neighborhood
access and street design will be required to conform to Town standards. All
construction and fire prevention will be required to adhere to building and fire
codes. See more below.
• Schools: Weld County RE -4 District. Schools serving this site are listed below
along with anticipated student generation. See more below.
• Library District: Clearview Library District. No adverse impacts anticipated at this
time.
• Electric/Communication Service: The developer wibe required to work with
service providers to establish the most efficient manner for extending service to the
community
• Internet service: The developer will be required to work with service providers to
establish the most efficient manner for extending service to the community
Financing Method
The project will be privately funded by the project owner/developer. In regard to long-term site
maintenance the applicant has stated.
"A Landscape Maintenance Fund will be established by the future HOA, which will be
documented in the HOA Protective Covenants. The developer will be required to
contribute financially to the Fund until an HOA Board has been established, and fees begin
to be collected from residents."

School District Impact
The Mullin Estates Subdivision property is within the Weld County School District RE -4. Students
that will reside within the annexation area will be currently served by the following schools:
• Elementary -Rangeview
700 Ponderosa Drive, Severance, CO
• Middle — Severance Middle School
1801 Avery Plaza Street, Severance, CO
• High- Severance High School
1200 Hidden Valley Parkway, Severance, CO
The Town of Severance Reached out to the Weld RE #4 District and Chief Operating Officer
Jason Seybert comments are as follows.
"The above referenced major subdivision for annexation is proposed for a total of 31 single
family homes. Based upon the current concept plan, the following student generation is
anticipated throughout the project. The District will provide a much more comprehensive
referral regarding cash -in -lieu fees, etc. as the development moves through the approval
process.
Projections (number of students) to be added to the district just on this annexation project
of 31 residential units"

Severance Police Department Impact
The Town of Severance reached out to the Severance Police Department and Interim Police Chief
Jim Gerdeman. Interim Chief Gerdeman notified the Town that with Mullin Estate Subdivision only
being a proposed 31 lots it will, "not change much for the Police Department."

Windsor Severance Fire Rescue Impacts
The Town of Severance reached out to the Windsor Severance Fire Rescue, they did not respond
for a comment in the Impact Report however Fire Marshal Sandra Friedrichsen's provided some
comments on the project which are as follows.
- All homes are required to have a permitted fire sprinkler system installed in
them prior to CO, this is being required because of the long dead end.
— Fire hydrants will be required in this subdivision and meet current code on
distance and flow
- We would prefer to have an emergency access somewhere on this property if
possible. There are a lot of oil and gas wells in the area ... and if there is an
incident at one of those, we may need to evacuate the properties in an
efficient manner... If there is current access to the well pad sites, we may be
able to consider one of those an access that we can use.
- The homes and properties must meet all of the requirements of the fire code
and the state for being near oil and gas well sites, whether they are in
production or abandoned.
— Addresses for each house must be visible from the road.
- Dependent on the width of the street, no parking signs may be needed on
the road.
- The cul-de-sac will have to meet all of our standards for size and ability to
turn an emergency vehicle around in it
North Weld County Water District (NWCWD) Impacts
The Town of Severance reached out to NWCWD and Leann Koons Operations Manager's
comments are as follows.
"North Weld County Water District has no conflict with the annexation petition of Mullin
Estates Subdivision into the Town of Severance. The property has historically been served
by North Weld County Water District and the District intends to serve the proposed Mullin
Estates Subdivision. The applicant has approached North Weld with a preliminary concept
plan and is actively working on satisfying requirements of the District to move forward with
the subdivision.

Traffic Impacts
The Town of Severance Transportation Plan adopted April 6, 2015 provides an in-depth analysis of
existing conditions and anticipated needs through year 2035. The analysis projects build out of
residential and commercial uses, the traffic that would be generated and the road improvements
necessary to accommodate the traffic at acceptable levels. The Concept Plan and Management Plan
submitted to the Town anticipates right -of way dedications to WCR 80 to accommodate the
ultimate cross sections for all road improvements. During development review traffic studies will be
required to show improvements required.
Environmental Impacts
Existing land use has been agriculture. Currently staff has no concerns. During development review
environmental study may be required.
Resident Impacts
Similar to all new subdivisions being built, construction would potentially be the largest impact on
current residents and neighboring subdivisions. Most affected would be the Belmont Farms
Neighborhood to the north and unincorporated Weld County Residents to the east, west, and south.
Construction noise, dust, and trash is a common resident impact. Community Development
Inspector as well as Severance Police Department Code Enforcement would work together to keep
impacts minimal by doing routine site visits as well as inspections. Traffic studies during
developmental review will pinpoint exact improvements required, but any required road
improvements may cause delays in commutes to current residents as an initial impact but could also
improve commutes in the. During development review community outreach efforts may be required
to determine specific resident impacts.
Economic Impact
A short-term economic impact of a proposed neighborhood of 31 residential lots would be the
plowing/maintenance of new streets. New streets would need to be maintained by the Town
following construction warranties (two years from acceptance). This impact would continue to need
maintenance transitioning into a long-term economic impact which would be the continued upkeep
of additional roads.
Speaking with Town Administrator Nicholas Wharton its estimated that slurry seal operation will
need to take place on average every 5-10 years, and roughly every 15 years the roads would need to
be rebuilt.
Minimal use tax will be generated from the 31 proposed lots.

PETITION FOR ANNEXATION TO THE TOWN OF SEVERANCE, COLORADO
The undersigned, in accordance with Title 31, Article 12, Chapters 101 et. Seq., Colorado Revised
Statutes, hereby petition the Mayor and Trustees of the Town of Severance, Colorado, for annexation to
the Town of Severance the unincorporated territory described herein and described and shown on the
map designated as "Mullin Estates Annexation". Copies of said map are submitted herewith and by this
reference are incorporated herein. The description of the territory hereby petitioned for annexation into
the Town is set forth in Exhibit "A" attached hereto and incorporated herein by reference.
In support of this petition, the petitioner(s) allege(s) that:
1) It is desirable and necessary that the above described territory be annexed to the Town of
Severance, Colorado.
2) The requirements of Section 31-12-104 and 31-12-105 of the Colorado Revised Statutes
exist or havebeen met in that:
a) FOR ANNEXATION OF THE MULLIN ESTATES SUBDIVISION, THREE
ANNEXATION PLATS WERE PREPARED, ALL MEETING THE 1/6TH
CONTIGUITY AS REQUIRED;
b) A community of interest exists between the territory proposed to be annexed and the
Town of Severance;
c) The territory proposed to be annexed is urban or will be urbanized in the near future;
d) The territory proposed to be annexed is integrated or is capable of being integrated with
the Town of Severance, Colorado.
3) The signatures of the Petition comprise more than fifty percent (50%) of the landowners in
the area and own more than fifty percent (50%) of the area proposed to be annexed,
excluding public streets and alleys and any land owned by the annexing municipality.
4) No land held in identical ownership, whether consisting of one tract or parcel of real estate
or two or more contiguous tracts or parcels or real estate:
(a) Is divided into separate parts or parcel without the written consent of the landowner or
landowners thereof, except and unless such tracts or parcels are separated by a
dedicated street, road or other public way;
(b) Comprising twenty (20) acres or more and which, together with the buildings and
improvements situated thereon has an assessed value in excess of Two Hundred
Thousand Dollars ($200,000.00) for ad valorem tax purposes for the year preceding
the annexation, is included within the territory proposed to be annexed without the
written consent of the landowner orlandowners.
5) Except as otherwise provided, no part of the area proposed to be annexed is more than three
miles from a point on the municipal boundary, as such was established more than one year
before this annexation will become effective.
6) The territory proposed to be annexed does not include any area included in another
annexation proceeding involving a town other than the Town of Severance.
7) The territory to be annexed is not presently a part of any incorporated municipality, town
and county, or town.
8) Petitioner represents that no part of the property to be annexed is included within any
site -specific development plan approved by Weld County, Colorado.
9) The territory proposed to be annexed does not include any area that is the same or
substantially the same area in which an election for an annexation to the Town of
Severance was held within the twelve months preceding the filing of this petition.
10)The area proposed to be annexed comprises more than ten acres and an impact report
as provided for in Section 31.12.10s.s, CRS will be required.
11)The area to be annexed is located within Weld County and the following districts:
• Aims Junior College
• Clearview Library
• North Weld County Water (NWC)
• Northern Colorado Water (NC W)
• School District RE4-Windsor
• Weld County
• West Greeley Conservation
• Windsor -Severance Fire

RESOLUTION NO. 2020-21R
THE BOARD OF TRUSTEES OF THE TOWN OF SEVERANCE SETTING FORTH FINDINGS
OF FACT AND DETERMINATIONS REGARDING THE ELIGIBILITY FOR ANNEXATION
OF THE MULLIN ESTATES SUBDIVISION ANNEXATION
WHEREAS a written petition was filed with the Town Clerk requesting the annexation of certain
property to be known as Mullin Estates Subdivision Annexation; and
WHEREAS the Board of Trustees for the Town of Severance desires to initiate annexation
proceedings in accordance with law;
IT IS THEREFORE RESOLVED by the Board of Trustees of the Town of Severance
Colorado, this 6th day of October, 2020, as follows:
1. That the Board hereby accepts the annexation petition for the Mullin Estates Subdivision
Annexation, more particularly described in Exhibit A, B, and C. See legal description in Exhibits A, B, and
C, attached hereto and incorporated herein by this reference. The property described and shown in Exhibits
A, B, and C are referred to herein as "the territory proposed to be annexed" and/or "the annexed Mullin
Estates Subdivision."
2. That the Board hereby finds and determines that the annexation petition and accompanying
map contains all allegations required for such a petition under the Municipal Annexation Act of 1965, which
is referred to herein as the "Act", and that if such allegations are determined to be well founded, such
property would be eligible for annexation to the Town of Severance.
3. That the Notice attached as Exhibit D be adopted as a part of this Resolution. Said Notice
establishes the date, time, and place when a public hearing will be held to determine if the proposed
annexation complies with Section 30 of article II of the Colorado Constitution and Sections 31-12-104 and
31-12-105 of the Colorado Revised Statutes or such provisions thereof as may be required to establish
eligibility under the terms of the Act. The Town Clerk is directed to publish a copy of this Resolution and
said Notice as provided in the Act
