Executive Director NOTICE OF PUBLIC HEARING BEFORE THE COLORADO WATER QUALITY CONTROL COMMISSION Pursuant to the provisions of Sections 3-16-2, 66-28-202, 66-28-204, and 66-28-205, C.R.S. , 1963, as amended NOTICE is hereby given that public hearings will be held under the author- • ity of the COLORADO WATER QUALITY CONTROL COMMISSION on the following pro- posed regulations: 1 . A control regulation prohibiting the discharge. of certain wastewaters to storm sewers and prohibiting certain con- nections to storm sewers. 2. A control regulation prohibiting the operation of a sew- age treatment works for which a site approval has not been obtained. 3. A control regulation for the prevention of water pollu- tion from piled material . 4. Amendments to a control regulation establishing effluent limitations on wastewater discharges, which was adopted August 20, 1974. 5. Amendment to Colorado Water Quality Standards. (This concerns the conditions under which exceptions to standards may be made. ) The purpose of the hearings is to provide opportunity for interested per- sons to submit written and oral data, views, and arguments on these pro- posals. Written data may be submitted prior to as well as at the hearing. The Colorado Water Quality Control Commission encourages public partici- pation so that it may have the benefit of the views and experience of the people of the state as to the effects of the proposals and as to any modi- fications thought desirable by interested persons. (Any person desiring to take a part in the hearings more extensive than submitting written and oral data, views, and arguments , is advised to consult 66-28-402, C.R.S. 1963, as amended. ) The views and data so submitted will be taken into consideration by the Commission prior to final adoption of the above items. Pugsley, Technicak/secretaryJ/ Colorado Water Quality (Control C2 „mission WATER QUALITY CONTROL COMMISSLON Adopted: October 15, 1974 PROPOSED REGULATIONS PROHIBITING THE DISCHARGE OF CERTAIN WASTEWATERS TO STORM SEWERS AND PROHIBITING CERTAIN CONNECTIONS TO STORM SEWERS 100. AUTHORITY. Section 66-28-205, C.R.S.. , as amended. 200. REGULATIONS. (1 ) No person shall discharge waste from industrial , commercial , or sanitary sources to a storm sewer unless a discharge permit has been obtained therefor. (2) No person shall connect a waste drainage system for wastewater other than storm water runoff to a storm sewer. (3) All such connections between industrial , commercial , or sanitary waste sewers and storm sewers which are not the subject of a discharge permit shall be disconnected on or before January 1 , 1976, even though the connection is unused. WATER QUALITY CONTROL COMMT°SION Adopted: October 15, 1974 PROPOSED REGULATIONS PROHIBITING THE OPERATION OF A SEWAGE TREATMENT WORKS FOR WHICH A SITE APPROVAL HAS NOT BEEN OBTAINED 100. AUTHORITY: Sections 66-28-202(2) ; 66-28-207(1) ; 66-28-704, C.R.S. , as amended. 200. DEFINITIONS. (1 ) "Sewage treatment works" means a system or facility for treating, neutralizing, stabilizing, or disposing of sewage, which system or facility has a designed capacity to receive more than 2,000 gallons of sewage per day. The term sewage treatment works includes ap- purtenances such as outfall and outlet sewers, pumping stations,. interceptors, collection lines and related equipment. 300. REGULATIONS. No person shall operate a sewage treatment works which has been constructed or expanded in violation of 66-28-704, C.R.S. , as amended (quoted below) , unless and until a site approval from the Water Quality Control Commission and any necessary discharge permits have been obtained and plans have been reviewed by the Commission. 66-28-704: "(1 ) No person shall commence the construction or expansion of any sewage treatment works intended to serve more than twenty persons unless: (a) Site location and the construction or expansion has been approved and designs therefor reviewed by the Com- mission; and (b) A permit for the discharge therefrom has been issued pursuant to Section 66-28-501 (6) . "(2) In determining the suitability of a site location for any sewage treat- ment works, the Commission shall consider the long-range comprehensive planning for the area and the consolidation of sewage treatment works to avoid proliferation of small sewage treatment works." WATER QUALITY CONTROL COMMISSION Adopted: October 15, 1974 PROPOSED REGULATIONS FOR THE PREVENTION OF WATER POLLUTION FROM PILED MATERIAL 100. AUTHORITY. Section 66-28-205, C.R.S. , as amended. 200. DEFINITIONS. (1 ) "Piled material" means any material of any nature assembled in a pile. 300. REGULATIONS. (1 ) No owner, lessee or other person having the right of possession of real estate shall allow any piled material capable of polluting waters of the state to be placed or to remain on that real estate unprotected in such a loca- tion that flood water, rain water, or snow melt can cause said material to pollute the waters of the state. COLORADO DEPARTMENT OF HEAL Water Quality Control Commission Approved: November 19, 1974 The Water Quality Control Commission proposes to make the following amendment to Water Quality Standards for Colorado: Page 2, item Flow Criteria and Exceptions: delete last sentence "Exceptions on specific parameters may be allowed through discharge permits" and insert "Exceptions to speci- fic criteria in the standards may be granted if: (1 ) Present technology cannot restore the water quality to these levels; (2) the cost of meeting these standards is eco- nomically prohibitive compared with the ex- pected benefits; or (3) the natural qualities of the water are less than the recommended criteria. COLORADO DEPARTMENT OF HEALTH-... Water Quality Control Commis n • Adopted: November 19, 1974 • EFFLUENT LIMITATIONS 100. AUTHORITY. The Water Quality Control Commission is directed by C.R.S . 66-28-205, as amended, to promulgate control regulations , to describe prohi- bitions, standards, concentrations, and effluent limitations on the extent of specifically identified pollutants that any person may discharge into any specified class of state waters. 200. REGULATIONS . (1) These effluent limitations for the discharge of wastewaters shall pertain to all wastewater d. scharges , except storm runoff waters and agricultural return flows, ;nto any state waters . "State waters" means any and all surface or subsurface waters which are contained in or flow in or through this state, except waters in sewage systems, water in treatment works of disposal systems, waters in potable water distribu- tion systems, and all water withdrawn for use until use and treatment have been completed. (2) No person (except as provided in subparagraph (3) below) shall dis- charge any wastewaters into any state waters if such wastewaters violate any of the specific limitations contained in paragraph 300, below, appli- cable to such wastewaters, unless the discharge is covered by a discharge permit containing a compliance schedule which will bring the discharge in- to compliance with the effluent limitations, according to a planned sched- ule. Until December 31 , 1974, if proper application for a discharge per- mit has been made, and administrative action on the application has not been completed, the application will serve in lieu of a permit for the above purpose. (3) At such time as effluent limitation guidelines are promulgated by the Commission for an industry pursuant to Section 66-28-205(2) (d) , C.R.S. , as amended, such industry shall be subject to those guidelines and shall not be subject to effluent limitations set forth below in paragraph 300. If the Commission has not so promulgated effluent limitation guidelines for any particular industry but that industry is subject to effluent limita- tion guidelines promulgated by the United States Environmental Protection Agency pursuant to the Federal Water Pollution Control Act of 1972, an effluent from these industries shall be subject to the applicable EPA guidelines and shall not be subject to the effluent limitations of para- graph 300 below. (4) The effluent limitations set forth below, or promulgated according to subparagraph (3) above, are also subject to being superseded or augmented when it is found that stricter limitations are required in order to main- tain water quality or to bring a receiving water up to its prescribed water quality standards. (5) If treated effluent from a municipal sewage treatment works is dis- posed of on land, the design for such disposition must be approved by the Water Quality Control Commission. -1- 300. In all other plants, samples shall be a composite sample, with a minimum of four grab samples taken approximately two hours apart. (b) 7-Day Average: The arithmetic mean of a minimum of three samples taken on separate days in a 7-day period. (c) 30-Day Average: The arithmetic mean of three or more samples col- ` lected in separate calendar weeks during a 30-consecutive day period with a minimum of 20 days occurring between the first and last sample days. (d) In addition to the above effluent limitations, the arithmetic mean of the values for effluent samples collected in a period of 30 consecu- tive days shall not exceed 15 percent of the arithmetic mean of the values for influent samples collected at approximately the same time during the same period (85 percent removal). Influent samples shall be a minimum of four grab samples taken approximately two hours apart. (e) These numerical limits and sampling requirements have been set with the inherent variability of the analytical procedures taken in- to consideration. ** The geometric mean of the values for a minimum of three grab samples collected during seven (7) consecutive days. *** The geometric mean of the values for a minimum of three grab samples collected during 30 consecutive days. , **** A single grab sample shall be used for residual chlorine, pH, and oil and grease. _2_ • • EFFLUENT LIMITATIONS Adopted: November 19, 1974 400. TECHNICAL DATA. (1) Analytical and sampling methods utilized by the discharger shall conform to those designated in one of the following references or equi- valent methods approved by the Director, Water Quality Control Division, Colorado Department of Health. (a) Standard Methods for the Examination of Water and Waste. Latest edition, American Public Health Association (New York, New York 10019) . (b) A.S.T.M. Standards, part 23, water: Atmospheric Analysis, American Society for Testing and Materials (Philadelphia, Pennsylvania 19103) , 1970 (c) W.Q.O. Methods for Chemical Analysis of Water and Wastes. Environmental Protection Agency, Water Quality Office, Analytical Quality Control Laboratory (1014 Broadway, Cincinnati , Ohio 45302) , April , 1971 The permittee must be able to show proof at the request of the Director, Water Quality Control Division, Colorado Department of Health, of the accuracy of any flow-measuring device L -ed in obtaining data submitted in the monitoring report. The flow-measuring device must indicate values within ten percent of the actual flow being measured. (2) In no case will wastewaters be held to be in compliance with any of the limitations set forth in paragraph 300, above, where those wastewaters are diluted with other waters , unless such compliance would exist without such dilution. (3) For the purposes of enforcement of the effluent limitations for the discharge wastes, set forth in paragraph 300, above, sampling of waste discharges shall be made prior to any admixture o; waste discharges with receiving water. All new discharges, constructed after the effective date of this regulation, shall be so designed or modified that a sample of the effluent can be obtained at a point after the final treatment process and before discharge to state waters . All existing discharges shall be similar- ly designed or modified by July 1 , 1975. (4) If wastewater is returned to the source from which it was obtained, :he parameter limitations specified in paragraph 300, above, are in addition to the measured values of the same parameters in the incoming water. (5) Any person discharging wastewater into any waters of the state shall have the option of establishing to the continuing satisfaction of the Com- mission, a BOD/COD (chemical oxygen demand) , BOD/TOC (total organic carbon) , BOD/TOD (total oxygen demand) relationship with respect to such effluent, and the COD, TOC, or TOD values so established shall govern that person's effluent under this limitation.
