HomeMy WebLinkAbout20203279.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING SHOW CAUSE HEARING, PCSC20-0002, TO SHOW WHETHER CAUSE EXISTS TO CONSIDER REVOCATION OF USE BY SPECIAL REVIEW PERMIT, USR-983 - MAREK FARMS, LTD., C/O JOHN PIPE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on November 9, 2020, a Hearing was conducted to show whether cause exists to consider revocation of a Use by Special Review Permit, USR-983, for expansion of a nonconforming use (vehicle sales establishment and salvage yard) in the A (Agricultural) Zone District, issued to Marek Farms, Ltd., c/o John Pipe, 12152 CR 46, Milliken, Colorado 80543, and WHEREAS, John Pipe is the owner of the facility located on property described as follows: Part of the NW1/4 of Section 18, Township 4 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing of November 9, 2020, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the permit holder, and the recommendation of Planning staff, and having been fully informed, finds that the site is now in compliance, and, therefore, deemed it advisable to dismiss said matter. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Hearing to show whether cause exists to consider the revocation of Use by Special Review, USR-983, issued to Marek Farms, Ltd., c/o John Pipe, be, and hereby is, dismissed. Y. �'•r 1�1 r `�Y.Pn..� �a'11•"a.� i t '•: .rr.� y• 't'-p .C' _ yy 1{'ar-, �•d•�4 ��' d�r1 - - -- - �•+'.t. sue_ ..2.. :��+}+.. .L am*- :u __:ell ._ 1...J#=t Me- RESOLUTION RE : APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR EXPANSION OF A NONCONFORMING USE (VEHICLE SALES ESTABLISHMENT AND SALVAGE YARD ) IN THE A (AGRICULTURAL) ZONE DISTRICT -, LEROY BERNHARDT WHEREAS , the Board of County Commissioners of Weld County , Colorado , pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County , Colorado , and WHEREAS , the Board of County Comsnission.ers held a public hearing on the 7th day of October , 1992 , at the hour of 10 : 00 a . m . in the Chambers of the Board for the purpose of hearing the application of LeRoy Bernhardt , 2700 C Street ,, # 154 , Greeley , Colorado 80631 , for a Site Specific Development Plan and Special Review Permit for expansion of a nonconforming use (vehicle sales establishment and salvage yard) in the A ( Agricultural ) Zone District on the following described real estate , to-wit : Fart of the NW! , Section 18 , Township 4 North , Range 68 West of the 6th P . M . , Weld County , Colorado WHEREAS , LeRoy Bernhardt , said applicant , was not present or represented , and WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit , and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present , has studied the request of the applicant and the recommendations of the Weld County Planning commission aad all of the exhibits and evidence presented in this matter and , having been fully informed, finds that this request shall be approved for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance . 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 .. 2 of the Weld County Zoning Ordinance as follows ; a . The proposal is consistent with the Urban Growth Boundary Area Goals and Policies as set forth in the Weld County Comprehensive Plan , The Town of Milliken has reviewed this request and has no objections . h , The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review . 920976 PL08B2 C . The uses which would be permitted will be compatible with the existing surrounding land uses which include agricultural production , one residence, a railroad right--of-way , and County roads , and with the future development of the surrounding area as projected by the Town of Mil l iken ' s comprehensive plan . d . The applicant has demonstrated a diligent effort to conserve productive agricultural land in the locational decision for the proposed use . Most of the site is an abandoned gravel pit . e . No overlay districts affect the site . f . Special Review Pewit Development Standards will provide adequate protection of the health , safety , and welfare of the neighborhood and County . NOW, THEREFORE , BE IT RESOLVED by the Board of County Commissioners o f Weld County , Colorado , that the application for a Site Specific Development Plan and Special Review Permit for expansion of a nonconforming use (vehicle sales establishment and salvage yard) in the A ( Agricultural ) Zone District on the hereinabove ove described parcel of land be , and hereby i s , granted subject to the following conditions : 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat . The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder ' s Office within 15 days of approval by the Board of County Commissioners . 2 . Building or electrical permits shall not be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder . 3 . Prior to scheduling before the Board of County Commissioners , the applicant shall submit a screening plan for the vehicle salvage area to the Department of Planning Services ' staff . The screening plan shall demonstrate that the salvage area is screened from adjacent properties and public rights -of-way . The screening plan must be approved by the Department of Planning Services ' s staff prior to a hearing being scheduled for the Board of County Commissioners . Prior to recording the Special Review permit plat , the applicant shall submit an estimate of costs for the approved screening . The estimated amount shall be reviewed and approved by the Board of County Commissioners . Sufficient performance guarantees to ensure installation and completion of the screening shall be provided to 920976 SPECIAL REVIEW PERMIT -- BERNHARDT PAGE 3 the Board of County Commissioners for the approved amount as allowed by Section 2414 . 3 of the Weld County Zoning Ordinance . The performance guarantee shall be in a form acceptable to the Board of County Commissioners . The guarantee shall be returned to the applicant or released after the improvements have been satisfactorily completed . If the improvements have not been completed by May 15 , 1993 , the County shall take corrective action to ensure compliance with theapproved plan and the guarantee shall be forfeited . 4 . Prior to the issuance of building permits : a . The existing septic system shall be reviewed by a Colorado Registered Professional Engineer, and a copy of that review shall be submitted to the Weld County Health Department , Environmental Protection Services Division , before the required I . S . I . S . evaluation is performed . b . The applicant shall submit evidence to the Department of Planning Services that all requirements of the Office of Emergency Management have been met . The Site Specific Development Plan and Special Review 1 e mit is an expansion of a nonconforming use (vehicle sales establishment and salvage yard ) in the A (Agricultural ) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein . 2 . Approval of this plan may create a vested property right pursuant to Sact i on gn o f the wi d county zoning Ordinance . Y� Y V� Y M S . All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination , 4 . No permanent disposal of wastes shall be permitted at this site . S . Wood shavings , sawdust , and waste materials shall be handled . stored, and disposed of in a manner that controls fugitive dust , blowing debris , and other potential nuisance conditions . 6 . Fugitive dust shall be controlled on this site , 7 . Adequate toilet facilities shall be provided for the public . B . The approved screening shall be maintained on the site . 9 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance . 10 . (C . R.S . 30-28- 124 .5) * It is an action for the imposition of Civil Penalties. * The initial penalty to be assessed is not to exceed $ 1000.00. • The daily penalty to be assessed is not to exceed $100.00 per day, and is assessed by Court Order for each day the violation continues. * The penalties, if not paid are to be certified by the County Attorney to the County, Treasurer for collection with property taxes . II . The Complaint and Summons and Answer form are served on the Defendants . * There is a specified format for the filing of Civil Actions in County Court. it is a simpler format. * An actual copy of an Answer form is served on the Defendant and the Defendant uses that form to file an Answer. * The fee to file an Answer is $92 .00 * No right to a jury trial Iii . * County Court Rules require the Plaintiff and the Respondent to file one set of Disclosures/Exhibits and Witness list prior to a hearing.. IV . Hearing Process if Defendant/Respondent Files an Answer If Defendant files an Answer or appears on the appearance date, the Court can set the matter for a hearing to allow the Defendant an opportunity to defend the Defendant' s position/situation. Following a hearing, the Court could impose a one-time penalty (not to exceed S1000.00) and a daily penalty (not to exceed $ 100.00 per day) if the violation is not corrected. * Alternatively, the County can offer the Defendant an opportunity to enter into a Stipulation to remedy the situation, which Stipulation would become an Order of the Court. If the terms of the Stipulation are met, the penalties may be reduced or eliminated. * Following the filing of a Motion by the County Attorney, the Court may impose a daily penalty it believes is appropriate, (not to exceed $100.00 per day). V . Judicial Process if No Answer is Filed : County appears at the pre-scheduled hearing and requests the Court to enter an Order of Default . * The Order could impose a onetime penalty (not to exceed $ 1000.00) and would specify the date for payment. Each day after the issuance of the order during which the violation continues is deemed a separate violation and is subject to a continuing penalty in an amount not to exceed S100.90 upon which daily penalties begin to accrue. The Order may also set the amount of the daily penalty, and the date(s ) for payment. * The Order is sent to the Defendant. * No further action is required by the County if the violation is corrected and the one-time penalty is paid. * If the Defendant fails to correct the violation and pay the penalty within the time set for payment, the County Attorney will file a Motion with the Court informing the Court that the violation has not been corrected, and the Court will impose the additional daily penalty. * The action continues until the County Attorney files a receipt from the treasurer stating that the amount has been paid, and an affidavit of the planning dept or building inspector stating that the violation corrected . * Any penalties which have not been paid within the time set by the Court are recorded with the Weld County Clerk and Recorder. Upon recording, the amount shall become a lien on the property. Timeline 8/30/2017 - PCSC17-0015 original complaint of expansion beyond USR boundaries and presence of non -commercial junkyard . ( Ryder/ Michelle ) 2/ 13/2018 — BCV18-00010 initiated for the unpermitted hoop structures . 10/4/2018 — Ag-exempt building permits received for four hoop structures . Staff concerned that commercial salvage was being stored 3/7/2018 — Ag - exempt permits for the hoop structures administratively withdrawn . 3/ 14/2018 — Determined could 2 fabric buildings for commercial storage without amending the USR ( others could be used for ag/personal only) 4/30/2019 —Building and Planning tracked down what happened with the case. Case Reassigned to Angela Snyder. Property owner, John Pipe, proceeded to clean up the site . 6/ 11/2019 — Office visit with Mr. Pipe to discuss progress 10/ 14/2019 — PC C17-0015 closed "Non -commercial junkyard was screened . Commercial salvage yard is within the boundaries of USR-983 ." Commercial salvage was removed from the unpermitted hoop structures, and so determined to be agricultural , and therefore, unrelated to the USR . 12/12/2019 — BCV1S-00010 Notice to proceed was sent to Mr. Pipe as staff was still not in receipt of building permits for the four unpermitted hoop structures . 2/ 13/2020 — Staff opens PCSC20-0002 and informed Mr. Pipe via email to submit the ag-exempt building permits with regard to DS 9 . 8/25/2020 — Notice of Probable Cause Hearing sent to Mr. Pipe via certified mail . 9/17/2020 — Phone conversation and email with Building Compliance . There is Probable Cause that the USR is out of compliance with Development Standard #9, "All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance." There is an unpermitted agricultural hoop structure. Timeline 8/30/2017-PCSC17-0015 original complaint of expansion beyond USR boundaries and presence of non- commercial junkyard. Discovered four unpermitted hoop structures. Planner-Ryder Reddick 2/13/2018- BCV18-00010 initiated for the unpermitted hoop structures. 10/4/2018—Ag-exempt building permits received for four hoop structures. Staff was concerned that commercial salvage was being stored in the structures and that they would need commercial permits. 3/7/2018—Ag-exempt permits for the hoop structures withdrawn. Notes on file: "USR ON PROPERTY FOR SALVAGE YARD - PER JOSE NEED TO CONSULT WITH PLANNING TO DETERMINE IF CAN BE PERMITTED AG-EXEMPT OR IF NEEDS TO BE COMMERCIAL/ PERSONAL USE (RYDER) - 03/14/18 ALLOWED TO HAVE 2 FABRIC COVERED BLDGS TO BE USED FOR COMMERICAL USE W/OUT AMENDING THE USR (RYDER)" 4/30/2019 — Email correspondence between Building and Planning tracking down what happened with the case. Case Reassigned to Angela Snyder. Property owner,John Pipe, proceeded to clean up the site. 6/11/2019—Office visit with Mr. Pipe to discuss progress 9/19/2019 —Staff site visit to property confirming the cleaning up of the property. 10/14/2019- PCSC17-0015 closed "Non-commercial junkyard was screened. Commercial salvage yard is within the boundaries of USR-983." Commercial salvage was removed from the unpermitted hoop structures, and so determined to be agricultural, and therefore, unrelated to the USR. Staff decided close the PCSC and to process only the building violation. Mr. Pipe informed that he could resubmit the ag- exempt permits that were previously withdrawn, however would need to file new applications, as so much time had passed. Mr, Pipe was disinclined to submit new applications. 12/12/2019 - BCV18-00010 Notice to proceed was sent to Mr. Pipe as staff was still not in receipt of building permits for the four unpermitted hoop structures. 1/23/2020—Still no building permits for ag-exempt hoop structures, so in an email correspondence, staff discussed the possibility of reopening the USR violation for failure to comply with Development Standard #9 "All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance." 2/13/2020—Staff opens PCSC20-0002 and informed Mr. Pipe via email to submit the ag-exempt building perm its. 8/25/2020— Notice of Probable Cause Hearing sent to Mr. Pipe via certified mail. 8/27/2020 — Postcard signed and returned to the Department of Planning Services. It was assumed the property owner was aware of the letter. 9/17/2020--Phone conversation and email with Building Compliance. Mr. Pipe informs Building that there is only one hoop structure remaining onsite and was not aware of the certified Notice of Probable Cause Hearing. 9/18/2020—Applicant encouraged via email to submit ag exempt application for the remaining structure by Monday. 9/21/2020—Planning staff received the certified letter "not deliverable at this address" and returned to the sender. Staff will visit the site prior to September 28, 2020 and confirm the existence of one remaining hoop structure. Staff recommends that a Show Cause hearing be scheduled to discuss the noncompliance with USR-938 Development Standards. Hello
