RE: SHOW CAUSE HEARING, PCSC20-0002, TO SHOW WHETHER GOOD CAUSE EXISTS
FOR REVOCATION OF USE BY SPECIAL REVIEW PERMIT, USR-983, FOR
EXPANSION OF A NONCONFORMING USE (VEHICLE SALES ESTABLISHMENT AND
SALVAGE YARD) IN THE A (AGRICULTURAL) ZONE DISTRICT - MAREK FARMS,
LTD., C/O JOHN PIPE
A public hearing was conducted on November 9, 2020, at 9:00 a.m., with the following present:
Commissioner Mike Freeman, Chair
Commissioner Steve Moreno, Chair Pro -Tern

Commissioner Kevin D. Ross
Also present:

Planning Services Department representative, Angela Snyder
The following business was transacted:
e I hereby certify that pursuant to a notice dated October 23, 2020, and duly published
October 28, 2020, in the Greeley Tribune, a Show Cause hearing, PCSC20-0002, was conducted
to show whether good cause exists for the revocation of Use by Special Review Permit, USR-983,
for expansion of a nonconforming use (vehicle sales establishment and salvage yard) in the
A (Agricultural) Zone District, held by Marek Farms, Ltd., c/o John Pipe.
e Angela Snyder, Department of Planning Services, explained PCSC20-0002 was initiated as
the result of expanding a salvage yard outside of Milliken without the necessary permits.
Ms. Snyder reviewed the evidence of non-compliance, described her findings from the site visit
of November 6th, and reported the permit holder's progress to bring the site into compliance.
e Tonya Johnson, Building Code Compliance, stated Mr. Pipe does have an agricultural exempt
building permit submitted but it is not yet issued. Ms. Johnson stated staff is was waiting for a plot
plan, designating which specific structure was being permitted, and an additional request for an
itemized list of agriculture equipment stored in the remaining structure. She relayed the equipment
list is not a normal request, possibly due to the permit being for commercial purposes. Ms. Snyder
requested the Board dismiss the planning violation, since the building permit is the only portion
left to complete. Ms. Johnson acknowledged the remaining building is for personal agricultural
use, not commercial
e John Pipe, Marek Farms, stated he previously submitted permits but had not received any
response from the prior case planner. Mr. Pipe relayed an itemized request was submitted to him,
stating although he is willing to open his buildings for inspection at any time, he does not want to
be held to a higher standard.

El No public testimony was offered concerning this matter.
El Commissioner Kirkmeyer made a motion to dismiss Show Cause hearing, PCSC20-0002,
based on the testimony provided by staff that the site is now in compliance with USR-983 The
motion was seconded by Commissioner Ross and it carried unanimously. There being no further
discussion, the hearing was completed at 9:56 a.m.
This Certification was approved on the 16th day of November, 2020.
