HomeMy WebLinkAbout720360.tiff 1Y0 a• i r}- � ley RESOLUTION WHEREAS, a public hearing was held on October 30, 1972 in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Jess Kohler, Route 2, Box 199, Greeley, Colorado, requesting permission to locate a cattle feed lot operation on the following described property, to-wit: The South 358 feet of the West 640 feet of the West Half of the Southeast Quarter (WzSE4) of Section Twenty-one (21), Township Six (6) North, Range Sixty-six (66) West of the 6th P. M. , Weld County, Colorado. WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for the location of said cattle feed lot operation, and WHEREAS, the said requested cattle feed lot operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and • WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said cattle feed lot operation may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner; and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Jess Kohler, Route 2, Box 199, Greeley, Colorado, for location of a cattle feed lot operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2, That petitioner shall proceed with due diligence to effect said cattle feed lot operation and shall have up to one year from date hereof to begin construction of same. 3. That petitioner shall construct sealed lagoon or lagoons as proposed, 4. All applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. 5, That when said cattle feed lot operation is completed, same shall not contain more than 100 head at any one time. SUBJECT: Minutes MOTION: By Mr. Clark to approve the minutes of the last regular meeting as mailed. Second by Mr. Rothe . A unanimous vote of "Aye" . Motion carried. Mr. Anderson welcomed Mr. Elliott to the Planning Commission as an associate member. Mr. Lorenson stated he recommended the application be approved . The operation is now in existance . It is not con- sidered a hazard to the surrounding land use . It has had no action on it in the past which would legally recognize it as a special use permit so this action would allow that and grant the use without any questions of it' s being a non-conforming use . It should be subject to all requirements of the American Trap Association and the National Skeet Shooting Association . Mr. Wall stated he is president of the club and it has been in exist- ance for 50 years . They have had no accidents of any type . The nearest residence is a mile and a half. Mr. Wall was informed building permits are necessary for any structures when the operation is approved by the Commissioners . Lorenson stated he recommends approval . It in- creases the lot size and orients lots away from 16th St . , which ' is a proposed collector in Greeley ' s road plan . Alto approval of a request for a variance on lot size. Tract B does not meet the regulations of a 3 to 1 ratio on lot size. It should be subject to a statement on the plat that there will , be no access onto 16th. St . These lots have not been developed . Three lots are being replatted into 2 lots . Area will be served by North Weld water. If approved , it should be subject to construction limited to the pen size (37 ,000 sq . ft. ) as indicated on the plans and construction to begin within one year of approval by the Board of County Commissioners . APPLICANT : Planning Commission CASE NUMBER : Z-210 tape 457 SUBJECT : Zone change MH to A LOCATION : N'r1a Sec T3 R68 APPEARANCE : Mr. Kanemoto , Gil Olsen DISCUSSION : Mr. Lorenson stated he initiated this action through the planning staff. The area was originally platted as Fairways Living Ranchettes for large residential lots and recorded in 1963 . In 1967 MH zoning was applied for and recommended for approval to the County Commissions as temporary for 6 months . However, when the Resolution was written it didn ' t state temporary 6 months zoning unless development occurred . Mr. Kanemoto has purchased the property and wishes to develop the subdivision as platted for conventional homes . Some of the streets and utilities have been installed . MH zoning would allow approximately 300 units where services are not available. Mr . Olsen stated he represents the surrounding property owners and they are very much in favor of this action . Mr. Paul stated he would like to have 7 perco- lation tests made. Mr . Lorenson stated it should be subject to 830 a utility plat and approval of the Utility Board . RESOLUTION: _ Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the requirements of the Health Dept . and approval by the Utility Board . Lorenson stated he would like to call their attention to the previous zone requests on this property , three being denied , one approved. and one in process recommended for denial . He rec- ommended this application be denied as it is not consistant with land use policy , the contract for sale of land may not be legal under the subdivision regulations . The entire area needs develop- ment plan which piece-meal zoning will not accomplish . A service type operation requires large septic system which may endanger well water sources . The area continues to develop in a substandard manner with respect to water and sewer and planning in general . The occupants of surrounding existing sites have not kept promises made before the Planning Commission or have violated the regula- tions . Mr. Adams , zoning inspector reviewed the actions of the Board of Adjustment with respect to the mobile homes and violations in the area . Mr . Deisch presented the application and stated the area would be used to operate a service station for the applicant ' s vehicles . The applicant is a trucker who hauls frozen foods essentially from Idaho. Trucks would be refueled at this station . They would average 3 to 5 trucks per day.. They would also make minor repairs . Their plans are to refurbish the exist- ing scale house and to erect a larger building contiguous to it . There would be no storage of trucks on the property, no retail wholesale distribution. There was discussion regarding the mining carried on in the area previously . It was determined that Mr. Althen and Mr. Boyer , owners of the property , are in violation of the subdivision regulations under the previous law because 5 parcels have been sold . MOTION: By Mr. Watson to table the application indefinitely until certain legal problems are resolved. Second by Mr. Clark. A vote of "Aye" by Anderson , Clark, Elliott , Nix , Rothe , Watson and Weigand . Motion carried . APPLICANT: Russell Wade SUBJECT: Fee for building permit tape 458 LOCATION : SW4 Sec 23 T1 R68 DISCUSSION : Mr. Lorenson stated Mr . Wade has requested a change of zone to repair mobile homes on approximately 10 acres . Mr. Wade applied for a building permit for a shed but refused to pay the fee because it is an agricultural zone. It was determined if agricultural land is not used for that purpose, a building permit fee is required . 831 MOTION: By Mr. Nix that the waiver of fees for a building permit be denied . Second by Mr. Clark. A vote of "Aye" by Anderson , Clark , Elliott , Nix , Rothe , Watson and Weigand. • Motion carried . APPLICANT : Ernest Kollar SUBJECT: Building permit tape 458 -459 LOCATION : NE4 Sec 19 T3 R68 APPEARANCE : Mr. and Mrs . Kollar , Daniel F. Bernard , Attorney DISCUSSION : Mr. Bernard explained the sequence of events in the area , on property sold by Harvey Weber , regarding building permits issued. Mr. Kollar applied for a second building permit on a second parcel he has purchased in the area . The building permit was refused because of no frontage on a dedicated ROW. Other building permits had been issued with a 30' recorded easement to their parcels : Miss Telep discussed the definition of "access " . Mr. Lorenson requested a written legal opinion regarding this . Miss Telep suggested this problem of subdividing by Mr. Weber be taken up with the Colorado Real Estate Commission . MOTION: By Mr . SUBJECT : Airport Zoning FILE NUMBER : A-8 tape 459 APPEARANCES : Barton Buss , Don Carlisle , Tom Clark , Tom Carter DISCUSSION : Mr. Carter presented an airport map stating this had been presented to the Planning Commission in April . The Air- port Board is requesting an amendment to the Zoning Resolution to create an Airport Zone District. This is necessary before they can request FAA participation . Mr. Lorenson stated the only problem is the definition of the term "structure" which needs to be clarified . Mr. Carlisle stated this zoning is nec- essary to obtain federal funds for land acquisition . RESOLUTION : Be it therefore resolved to recommend to the Board of County Commissioners to amend the Zoning Resolution to create an Airport Zone and incorporate the regulation in the Revised Zoning Resolution when it is completed . SUBJECT : Regulations on Land Dedication DISCUSSION: Mr. Lorenson presented a chart showing how land dedication is determined where subdividing occurs . The zoning , the size of the lots and the population projected for the area will determine the amount. The County Com- missioners would have the option of accepting the land or fee equal to the amount of property. In a rural area the fee could be applied to a regional park or flood plain , etc . SUBJECT : Planning contract with Windsor for Planning Services DISCUSSION : Mr. Lorenson read a letter from Jim Ohi to the Town of Windsor regarding extending the contract for planning ser- vices for a year on the same basis of $200.00 they have been paying for the last 6 months . RESOLUTION : Be it therefore resolved to recommend to the Board of County Commissioners to renew to planning services with Windsor for another year at $200 . 00 per month. Motion by Mr . Nix, second by Mr. Weigand . A vote of "Aye" by Clark , Elliott , Nix, Rothe , Watson and Weigand : Motion carried. APPLICANT: Bill Cates CASE NUMBER: Z-209 con ' t tape459 DISCUSSION : After further discussion , it was the consensus of opinion that the entire 80 acres should be platted as a unit- development industrial park with limitations on the type of development that would occur according to the water and sewer services available . This should be done by the owners of the property. RESOLUTION : Be it therefore resolved to recommend denial to the Board of County Commissioners on the recommendation of the planning staff. The size of this operation with respect to Greele would pose no odor problems . If approved , it should be subject to : a maximum of 100 head , a lagoon as proposed on the plans and con- struction to begin within one year of approval by the Board of County Commissioners . Mr . Kohler stated there would not be a dairy operation at this location . It complies with the Land Development Policy , has been recommended for approval by the Health Department, 817 County Agent judges the design to be sound . There is an approved dog kennel on the adjacent property to the past. The proposed agricultural use will tendto retard further unwanted residential development out side of Aristocrat Ranchettes . If anoroved ,should be subject to a maximum of 70,000 bird capacity at any one time , a well permit issued by the State , construction to begin within one year of approval by the Board of County Commissioners and a set-back of 600' from the front property line and vertical screen- ing at perimeter of property, such as Russian olive , for example . The developers stated they would be able to meet the recommendations . RESOLUTION : Be it therefore resolved to recommend the approval to, the Board of County Commissioners subject to the recommendations of the . staff. Motion by Mr. Nix , second by Mr. Rothe . SUBJECT: Aristocrat Ranchettes application for federal funds DISCUSSION : Mr. Glen Paul . reported the application has been turned down by F. H.A , because 5217 ,000 was requested according to the feasibility report and it figured about $18 ,500 per family. It has now gone to the Governor and he has promised some from the state ' s fund and it has now gone back to the engineers to cut it down , APPLICANT : Jerry Bigbee CASE NUMBER : S-54 tape 450 SUBJECT : JB Acres , Fifth Filing LOCATION : SZ SWq Sec 33 T6 R66 APPEARANCE: Mr. Bigbee DISCUSSION : Mr. Lorenson presented the plat stating it has been rec- ommended for approval subject to guy easements as requested by the Utility Board , add street name on plat (71st Ave. ) , an additional 20 ' of ROW on 71st Ave . , correct the County Clerk & Recorder ' s certificate . There is no road to be constructed at this location. There was discussion regarding whose responsibility it will be to maintain the additional 20' of ROW. It was agreed a fence can be built in the easement and the 20 ' can be utilifed by the property owner until such tine as the highway is widened . RESOLUTION: Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the staff' s recommendations . Motion by Mr . Weigand , second by Mr. Watson . APPLICANT : Jerry Bigbee CASE NUMBER : Z-205 and S-103 tape 450 SUBJECT: Zone change A - MH-UD and preliminary plat of Cimarron Hills LOCATION : NEa Sec 8 T5 R67 APPEARANCE : Jerry Bigbee DISCUSSION: Mr. Lorenson read the staff' s recommendations for denial : It is not compatible with surrounding land use as there is a dairy within 800 ' south of proposed site, a feedlot expansion was approved by the County Commission 8/30/72 making the operation 1500 head , this would constitute spot zoning and not consistent with Land Use Policy. The applicant has not demonstrated that "either the on inal zoning was faulty or that changing conditions in the areado not 'ustify a new classification. The area does not have "unioue 818 � u ' characteristics which distinguish it from surrounding land . (which) makes its rezoning essential " . Existing mobile home courts and zoning nearby (Windsor Meadows , Arapahoe Village , West Hill ' N Park) have not been utilized . Inadequate provision for use and maintenance of common area as required by the Sub- division Regulations . The contributory area has not been considered in the drainage plan . Percolation test holes except one were not taken in the area of septic tank leach fields , all of which are to be ill the common area . Leach fields for sites in the north will be in soils with severe limitation for such use , according to the Soils Conservation Service . Mr. Bigbee stated there is a dairy nearby, a beet dump to the north , the railroad cuts. through , and there is a wrecking yard within z mile , the ground is dry- land and is not suitable for farm use. They have Little Thompson Valley water , a six inch line is extended in there. Mr. Bigbee stated he didn ' t know of a mobile home park where the residents could keep a horse or animal of some kind . Mr. Watson stated he felt people living in a. mobile home park deserved a better location than this proposed site. MOTION : By Mr . Watson to take the matter under advisement. Second by Mr. Nix. The Town of Kersey has recom- mended that the 2" water line be left. This also net with the approval of the Platte Valley Fire Protection District. The plat had previously been approved subject to a 6" water line. Mr . Freese explained the street through the subdivision has been paved. Water will be served by Central Weld Water District. Mr. Lorenson stated the plat does not meet the proposed standards . MOTION : By Mr. Weigand to take the matter under advisement. Second by Mr. Rothe. SUBJECT : Budget DISCUSSION : Mr. Lorenson explained that the budget officer indicated that a new catagory be used for Regional Planning expenses . The only way the over-all operation can be compared with last year' s budget is to add the two together. Last years total for the two was $135 ,000 approximately. The revenue estimate for 1972 was • $62 ,000, our revenue estimate for 1972 is $99,900, more than had been estimated . Mt. Lorenson reviewed the balance of the budget and all of the expenditures . MOTION : By Mr. Nix that the proposed budget for 1973 be recommended to the Board. of County Commissioners . Seconded by Mr. Watson . A unanimous vote . of "Aye" . Motion carried . SUBJECT: Air photos DISCUSSION : There was discussion regarding the air photos and who % has possession of them. • . MOTION: By Mr. Nix that all air photos be made a mattter of the perm- anent County inventory. Second by Mr. Watson . A. uanimous vote of "Aye" . Motion carried . SUBJECT,; Regional budget DISCUSSION : It was suggested each member take a copy with them to study. Mr. M. Anderson stated the County Commissioners of the two Counties will have to go over the proposed budget. This could be presented again at the next meeting . MOTION : By Mr. Weigand that the t ounty personnel under the County jurisdiction doing Regional work be included in the Regional Planning budget . Second by Mr. Rothe. A unanimous vote of"Aye" . Motion carried . SUBJECT: Subdivision Regulations DISCUSSION : There was discussioh regarding the fee for the Subdivision Regulations . Mr. Lorenson stated Jefferson County has put their regulations in a loose leaf binder and they charge an .initial fee of $10. 00 and keep a list. Any changes that occur are mailed to the purchaser and instructed which pages to remove and where to insert the new ones . Mr. Lorenson suggested charging $15.00 for this service . MOTION : By Mr. Weigand that a charge of $2 . 50 be made for copies of the Subdivision Regulations . Second by Mr. Nix . A unanimous vote of "Aye" . Motion carried . Mr. Kohler intends to build a home with septic tank filter field for on-site sewage disposal, and a cattle feeding operation in the southwest corner of the area in question. The area is mapped (see attached sketch) as X53-B, Kim loam, 1-3% slope and 55-B, Ascalon sandy loam, 1-3% slope. These are deep, well drained, medium textured soils and have only slight limitations for homesites and septic tank filter fields. The area is not subject to flooding and I would anticipate no pollution hazard from a feedlot. The soil is suitable for a holding or retention pond if one is needed. The soil survey is made on the basis of 40 inch borings, although in most cases the borings are made to depths of 50 to 60 inches.
