FINDINGS AND RESOLUTION
CONCERNING CHANGE OF ZONE
PETITION OF RUSSELL A. WADE
The petition of Russell A. Wade, Route 1, Box 112A, Erie, Colorado,
requesting a change of zone from "A" Agricultural District to "C" Commercial
District of a parcel 9f land more particularly described as follows, to-wit:
The South 200' of the West Half of the East Half of the
Southeast Quarter of the Southwest Quarter (WZEzSE4SW4)
of Section Twenty-three (23), Township One (1) North,
Range Sixty—eight (68) West of the Sixth P. M. , Weld
County, Colorado,
c-ame on for hearing on December 18, 1972, and the Board of County
Commissioners of the County of Weld, State of Colorado, having heard the
testimony and evidence adduced upon said hearing and having considered
the testimony, evidence and recommendations of the Weld County Planning
Commission filed with said Board, and having carefully weighed the same,
now makes the following findings:
1. Theevidence discloses that the applicant failed to sustain the
burden of proof as to the need for a change of-zone or that thepresent
zone is erroneous -or that circumstances warrant a change of zone at that
time.
2. The-evidence discloses that the-present zoning is complementary
to the surroundingarea.
3. The evidence discloses that-the proposal would constitute spot
zoning and that if a commercial activity was allowed, it would encourage
strip commercial development along County Road No. 6 and that this would
not be in the interest of good planning.
4. The evidence and investigation shows that there is a need for a
study and development of a comprehensive plan for Weld County, which
would include the area sought to be rezoned, and therefore, any rezoning
of subject property at this time would be premature and not in the interest
of good planning.
5. That each of the preceding findings in and of themselves and
independent of each other constitutes a separate and individual ground for
denial of the change of zone.
RESOLUTION
WHEREAS, the Board of County Commissioners of the County -of Weld,
State of Colorado, has heard the application of_Rus-sell A. Wade, Route 1,
Box 112A, Erie, Colorado, for a change of zone from "A" Agricultural District
to "C" Commercial District of a_parcel of land as hereinabove recited and
made a part hereof by reference, and
WHEREAS, the Board has made its findings on the evidence and
testimony submitted to it, which findings pre-cede this Resolution and by
reference are incorporated herein and made a part hereof, and

evidence -and testimony and the recommendations of the Weld County
Planning Commissi-onand has givmthe same such weight -as it in its
discretion deems proper, and is now fully advised in the premisos;
NOW, THEREFORE, BE IT RESOLVED, that the petition 9f
Russell A. Wade, Route 1, Box 112A, Erie, Colorado requesting a -change
of zone from "A" Agricultural District to "C" CommercialEistrict of a
par_cel of land indicated above be, and it hereby is denied on each of the
ground-s set forth in the Board's findings th-erein.
