HomeMy WebLinkAbout730523.tiff A RESOLUTION WHEREAS, the Board of County Commissioners of the County of Weld has heard the application of Patrick Collins for permission to ex- pand a dog kennel operation on the following described property, to-wit: A tract of land located in the SE* of Section 12, Township 2 North, Range 68 West of the 6th P. M. , Weld County, Colorado and more particularly described as follows: Beginning at the Southeast Corner of said Section 12, thence North along the East line of said Southeast Quarter a distance of 494. 0 feet to the true point of beginning, thence continuing North along the East line of said Southeast Quarter a distance of 330 feet to a point; thence South 89°15'30" West and parallel to the South line of said Southeast Quarter a distance of 1329. 42 feet; thence South 00°0'33" West and parallel to the East line of said Southeast Quarter a distance of 330 feet; thence North 89°15'30" East and parallel to the South line of said Southeast Quarter a distance of 1330. 27 feet to the true point of beginning, containing 10. 07 acres more or less, and WHEREAS, the said requested dog kennel operation expansion is in an agricultural zone as set forth by the Weld County Zoning Resolution, and 7 WHEREAS, according to Section 3. 3 (3) of the Zoning Resolution cf Weld County, said dog kennel operation expansion may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, said Board has made its findings upon the evidence and testimony submitted to it, which findings precede this resolution and by reference are incorporated herein and made a part hereof, and WHEREAS, the said Board has carefully considered the petition, evidence and testimony and the recommendation of the Weld County Planning Commission, and has given the same such weight as it in its discretion deems proper, and is now fully advised in the premises; NOW, THEREFORE, BE IT RESOLVED, that the petition of Patrick Collins, Route 4, Box 115 G, Longmont, Colorado 80501, for permission to expand a dog kennel operation on the land indicated above be, and it hereby is denied upon each of the grounds set forth in the Board's findings therein. M. in the office of .the County Commissioners , Court House . Roll call was as follows : Glenn Anderson , Chairman Present Bill Elliott Present Ronald Heitman Present J . Ohi read the staff recommendations that it be approved for the following reasons : it agrees with the land use ,policy , it is compatible with surrounding land use and zoning . The design is judged adequate by the Extension service and is approved by the Health Dept. If approved it should be subject to a sealed hold pond of at least 1 . 6 acre ft . as suggested by the .Extension service and the Health Dept . Construction to begin within one year of approval by the Board of County Commissioners and limited to the pen size shown on the submitted plan . Mr. Nix quest- ioned the time to begin construction . Mr . Anderson stated he thought it was to put a time limit on the project rather than when to start , in other words , . if construction hadn ' t begun at the end of the year , the permit would be re- voked . Mr . Nix stated he felt performance should be in less time . Mr. Connell stated the only reason it is in there is not to initiate performance , it is simply to give the Com- missioners a tool and a position time limit , if necessary , to cancel the permit. Mr. Miller stated he could comply with the requests . Mr. Ohi stated there are several quest- ions posed by the Health Dept . that should be answered . Ohi presented the staff' s comments recommending approval as it agrees with the land use policy , is compatible with surrounding land use and zoning . The design is judged very good by the Extension service and approved by the Health Department with some reservations . Should be subject to ade- quate protection of Lone Tree Creek & Greeley #2 Canal and construction to being within one year of approval by the Board of County Commissioners and limited to the pen sizes as shown on the submitted plan . Melvin Dinner reviewed the past history of the feeding operation and presented the plans for the proposed expansion . A petition sig,ned , by surround- ing property owners approving the project was presented . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the approval of the Health Department and the Planning staff' s recommendations . Motion by Mr. Elliott , second by Mr. Weigand . Question : Mr. Brig Watt stated his mother-in-law owns property across the road from the project and is concerned regarding the County road running north and south to the west of the pro- ject and the dust problem that would be created by the con- struction . Asked if any one could enlighten him on when this would be paved . Mr. Glenn Billings stated they are having a study done on it at this time but could not give any specified time when it would be paved. Mr. Freemyer stated very little grading will be necessary on the site , mainly to stabalize . Mr . Dinner stated the construction will involve very little traffic on the road. A vote of "Aye" by Anderson , Elliott , Heitman , Nix , Rothe , Watson , and Weigand . Motion carried . APPLICANT : J . J . The Soil Conservation District has evaluated the application and • has found that 21 acres of contributory off-side drainage has not been taken into account in the drainage plan . The West Greeley Soil Con- servation District has requested that the developer propose a wind and water erosion control plan because of soil topo- graphy and drainage conditions . The West Greeley Soil Con- servation District feels that existing small dam is in the high. hazard classification and should be redesigned . Mr . Ohi submitted letters to the members from these various agencies . Mr. Bigbee presented an exhibit showing the prop- erty and the adjoining property that has been previously plat- ted . Three of these lots have been recorded but are being replatted . The dam was built according to engineering spec- ifications . Mr. Ohi stated the concern is no emergen.u _spill - way. There are---21 acres that was not included in the drainage report . There was discussion regarding the erosion . Mr. Ohi thought there should also be a grading plan . It has been approved by - the State and County Health Departments . Approval of this system should not imply ap- proval of expansion of the area for housing . Mr. McLain stated the system would be an aerobic digestion system. The criteria that - has been • set ' up by the EPA for the 1975 and 1978 • criteria on sewage treatment plants have been met and sur- passed by the plant that is proposed for this area . The water that is treated will go to Farmer ' s Reservoir and Irrigation • Company. They plan to install sewer and mains throughout the Space City area . Mr. Meyers explained the operation of the plant. It will be very much over designed for the first few years . The design is set up to accomodate a future popula- tion of 7000 people . Mr . The building inspectors would like authorization to use the new edition . RESOLUTION : Be it therefore resolved to recommend that the County Commissioners adopt the 1973 Uniform Building Code . Gary Fortner presented a progress report on programs being funded through the Larimer-Weld Regional Planning Commission. Housing Study ,- The study is a more detailed survey of housing needs and housing economies than the one prepared by A. M. Vorhees and Associates, which was primarily a comoil'ation of 1970,U.S: .Census: data. A questionaire has been prepared and field interviews will begin soon in the Greeley area. Those to be interviewed were selected by a random numbering process. Mr. Telep: Let the record show that this cause came on for a hearing this day, February 13, 1973, on the application of Patrick Collins, of Route 4 Box 115 B, Longmont, Colorado, for an expansion of an existing dog kennel to be located upon a tract of land in the Southeast Quarter of Section 12, Township 2 North, Range 68 West of the 6th P. M.; Weld County, Colorado, and more particularly described in metes and bounds and was duly published as required by law in the Greeley Booster on ,knuary 12th and February 2, 1973 respectively. Said tract contains 10.07 acres more or less. Let the record also show there are several receipts in the file indicating that adjacent landowners were notified by certified • mail of this hearing today, thus affording them the opportunity to be present at this hearing and to testify either in favor or against the granting of this site approval for the expansion of an existing kennel operation. _ . w�--l.�[�'�. - i • Let the record also show that there is in the file a resolution of the Weld County Planning Commission recommending favorably as to this -expansion of the dog kennel operation. The reasons therefore can be gone into further detail by our Director Mr. Burman Lorensen. Let the record also show that the applicant, Patrick Collins,is present in; person and is represented by:.counsel, Mr. Richard Right. I believe we are ready to proceed Mr. Chairman. • Mr. Billings: Mr. Right, at this time if you will explain to the Board what is proposed on-'_this site. Mr. Right: .Yes. The, as it was stated this is a request for an increase -in the kennel itself — baby dogs The kennel is existing at this time and the files,I believe .muldcreflebt t&e'proposed changes in the adding of additional kennels for the dogs and a couple of additional runs. The request is based primarily on the fact that there are existing kennels in the area and Mr. Collins,and also another one is owned right :riext - ,,the land right adjacent to Mr. Collins and' I believe that the Planning Commission approval -there was a :stipulation there to that the owners, Mr. and Mrs. Collins would .provide for the Commission a proof of water in this area. At this time if the Commission would please I would tender to the Commission the proposed water that Mr. and Mrs Collins have obtained from the Colorado Division of Water Resources. It is a permit to dig an additional well. This - well would be for domestic use only which Mr. This has been approved and I believe that it states that there is two years to provide the drilling and so forth and the establishment of that well. From that they have allowed ' Mr. Collins to continue the other well that he has which provides for 20. feet per second, is that correct and this well would be used just • strictly for the dogs themselves and we would submit that that would be the fullfillment of the requirements of the Planning Commission in addition to the recommendation. Rather than, I don't know if you - have had a chance to examine any of the records, or rather than just to continue I would_ask if there any specifics that youwould like me -2- • • to go into concerning this. Mr. Lorensen:. .Mr. Chairman, I would like to break in at I haven't seen it this point because I feel that the - what they may have/would not necessarily meet the Planning Commissions requirements. I feel if - that if we did take it at that face value - we want a letter from the State Engineer Office that a letter is usable as such as stated. ' Because we did get specific information from them which indicated • that the existing well would not be useable ,for`-.thb”purposesiof the kennel and until I get .a letter saying otherwise I don't feel I have ,sufficient proof Mr. Right: . also in addition to that a also we indicate -that I have here letter from the Central Weld County Water District which is an additional water source for the Collins should they need. it, and it is a letter indicating that the water district would provide the water to the Collins property and this also, I believe, I would like to submit this also. This would mean additional backup should that not be enough. We would try to go through the well first, we felt that would be the most expedient for everyone, but we felt should that not be enough:: that this would cover it from the Weld County Water District. Mr. Telep: Mr. Chairman, let. the record show that we, have here exhibit "A" being introduced as additional evidence by the . petitioner to the effect that additional water service is at hand • or will be supplied to the premises Mr. Ashley: Whets that objection to that water, Burman? Mr. Lorensen: Sir? Mr. Ashley: What is the objection to that water, Burman? . ' What is wrong with the water? The Health Department? Mr. Lorensen: No there was an existing well and we checked with the State Engineer's Office and the State Engineer's Office sent • p . _a_ ( us a letter saying that the well could not be used for the purpose • of supplying water for the kennel. This came up before the Planning Commission. Mr. Ashley: Why? Mr. Lorensen: I will read you what, ram not familiar enough : with the water laws to tell you. This is from the Division of Water Resources, Department. of Natural Resources, State of Colorado, tc Gentlemen: After considerable discussion of your question concerning Patrick Collins) it is our opinion that the well permit that was issued— to Mr. Collins would not allow him to use the water from that well for an 80 dog kennel. The subject well is covered by the provision or - _ Section 148-21-45 Colorado Revised Statutes 1963 as amended and that - the statute. does not allow they type of water or the type of use 1) - for which Mr. Collins is applying. And this is under the signature of . ' Harlan W. Erker, Supervising Engineer, Ground Water Section. Mr. Ashley: They are referring to this new permit? Mr. Lorensen: No they were referring to the existing permit and the new permit is for a domestic water - again - I don't • whether falls know / the new permit / under the new statutes or not, I don't know what effect it will have on it. What I am saying is that before I would accept, in light of the Planning Commission's recommendation . of this new well application as a new water source, that I would like to have a letter from the same people that sent this one saying . that this did now-allow them to supply water to the kennel. Mr. Right: Mr. Chairman, concerning the site, the first well to be-was on the Collins property - was a 20 foot per second - e 20 foot well and then this one - the additional well ' would be 15 and would only be used for the household purposes and so forth so that the second well would be available for the domestic use of the animals. And we would of course have no objection to providing any additional information that the Planning Commission • ' would like concerning that. I think that the other letter tells us that we have from the Weld County Water District indicating that - - — --- — - — -4- • • • • they would provide water does indicate that the water will be either from the Weld County Water District or from the this well • I think that this if we might stipulatethat if the well is going to be put into use that an additional letter be submitted to show • • that otherwise •. if the •crater district is going to provide it then it would be profitable just to use the water district's • pipeline. • Mr. Billings: Any other questions of the-of the-Board? Mrs. DeVries: Well we moved out into the country more or less to be with animals and things like that and we enjoy having the animals around. Mr. Billings: Do you live right next door to this location? Mrs. DeVries: No, down the road and just up a little way. • ' Mr. Billings: Are there any questions of this lady by the Board ? Mr. Ashley: You live on that east-west road? Mrs. Motz: Anna Motz - M- o-t - z. And I live adjacent to the property of the Collins' and we also have a dog kennel and I don't find that `their dogs bother us in any way. And when we bought the ground out there we understood that we could raise dogs out there and we have all put in for land permits for having dogs and it was accepted by the Planning Commission. And the place is kept sanitary ` and the water is supplied I don't understand why they can't use it for more dogs. Mr. Billings: Would you show us on the map here where you live - your propery isn't designated on here. Mrs. Matz: North of theirs adjacent at the same length well its this Best and Harsh - we bought from .these people. Its 10 clear acres the same as they've got running the same length/to this line here. Now Mr, and Mrs. Robert Koke indicated to me that they never received a notice. In other words they never received a mailed of the hearing notice/- I do not know whether our record reflects that. If the Commission will examine the Protestors Exhibit you'll see that Mr. and Mrs Koke's property is at the — is within the distance of approximately 20 feet from the property line of the Collins. The Collins property is above theirs to the north. I am talking about the boundary. Mr. Telep: Yes this is good to acertain where their • property is to the subject property. • -7- ;:. . . , Mr. Na;man: Now what we really have here is that the Collins property is on the end of - short end of a horn - and the Kokes are receiving all the noise that comes from the existing dog kennel. I understand that there are 12 dogs that are housed in the kennel and of course I fail to understand how, if this is an agricultural district, how a dog kennel could be permit could be granted in the first place of course: I was not present when this was granted. Just because - as I understand the dogs are there for a commercial purpose but in any event they have 12 dogs now and Mr. and Mrs Koke have stated to me that these dogs begin houling at anytime of the day or the night. I understand that in this part of the country you have quite a bit of wind, we have quite a bit of wind in Denver but, you are unprotected out in.this part of the country and when that wind picks up well that noise carries right into their home. Now they have invested in their home for living purposes and they have invested a considerable amount of money in think it is in the excess of $18,000.00. Adjoining them is Mr. Staley thats building a home there for living purposes and he too will offer Urn comments to the Commission indicating the problem. Now this - it seems to me that from the position of the Koke's property that they are on the ampliflier end of all this noise. I understand that Mr. and Mrs. Koke indicate that thecCollins., sometimes use rabbits in the runs there, these dogs are being raised for the .purpose of racing and when those dogs take after those rabbits - and tear those rabbits up you've got a pretty good amount of noise there. Can you imagine if you have 12 dogs and theyie complaing only about 12 dogs, what are you going to have when you have 80 dogs in that property. Now obviously Mr. and"Mrs. Motz can not object, they are in the business of raising dogs too' but they are back up to the north behind the Coliins property. So if you grant an extension of the existing permit to Mr. and Mrs. Collins and why can't you do;the and Mrs. same thing for Mr./Motz and pretty soon you've got all this noise funneling down. Now I understand one of the people that favors Kstnzizsatimaltacuase -- - - -8- i • _ the granting of this permit is Mrs. DeVries, is that your name, DeVries, now Mrs. DeVries lives perhaps a quarter of a mile what is it from the proposed expansion area and tray off/to-.,the west is it Mrs. DeVries? Mr. Naiman: To the west, a quarter of a mile, well you are talking about something that perhaps isn't audible to'her but these people, the Kokes are right up against the back door of the property. Now those kennels as I understand, on, the Collins property, point right toward the Kokes property. • Mr. Telep: Counsel, may I ask aquestion, I am trying to ascertain why we missed your clients in thelegal descriptions around certified the area so that they could have been notified by/mail. Naiman: They live there, Counsel as a matter of fact I believe they were at the first hearing when the permit for a dog kennel was granted to Mr. and Mrs. Collins. Mr. Lorensen: Well you see the only way we make notification is by .checking who the legal owner technically is and if there is a sales contract and it is not recorded anyplace we have no way of Mr. Naiman: I do not know about this situation.' Mr. Telep: The only thing I am trying to establish is that most certainly we like to have the adjacent landowners to be .notified so that we could give them an opportunity to testify either in favor or against -y- ...r.a� • • Well quite obviously when you say they weren't notified something comes to counsels mind and it is this - that perhaps someone else is the fee owner and could be purchasing on contract On some 'such • basis. This is the area I am know of • Mr. Naiman: Thank you counsel: Basically this is the problem now I understand that at the first hearing that Mr. and Mrs. Collins said that they would go out and quiet down the dogs if they started to act up and - but this was just an empty promise on their - • .part because these people Mr. and Mrs. Koke and Mr. and Mrs. Staley will tell you that this noise is something that is really'bad. And • so to grant an expansion for 80 dogs there is going to drive these • residences out of the area there and I think this is what we are getting at. • Mr. Koke would you stand up and briefly in your own words tell the Commission how you feel about this. Mr. Koke: Well I am Robert Koke and I the next day • Mr. Billings: You will have to speak up a little bit so these mikes will pick you up - please. Mr. Koke: We get the blunt of all the noise and • the noise is anytime - just whenever they feel like it. I don't know for some reason or another when the wind blows- its 20 mile an hour or better - well they start howling. The rest of the time - they bark. • Mr. Naiman: How far is your house from the dog kennels • Mr. Koke. Mr. Koke: Three hundred and sixty-five feet. • Mr. Neiman: And the opening to these kennels what direction do they point toward? Mr. Koke: The openings are right toward our us - right .. toward our place. For a long time they never had doors on these , kennels and now they have doors on the top half but on the bottom • half there is, I don't know, rubber and there are some slits -10- . • where they can run all the time. Mr. Naiman: Can you tell the Commissioners what has happened when the dogs are put out in the runs and how many dogs • are there in each run? Mr. Koke: Well they are out in the runs all the time , they can - - they can get in there anytime. And there is two to three in each run. • Mr. Naiman: Do the dogs ever fight? • Mr. Koke: Oh yes Mr. Naiman: Constantly? Mr. Koke: No, it ain't all the time, but its enough to • drive you batty. Mr. Naiman: What happens when they fight? What does • it sound like? Mr. Koke: It sounds like a mess. Mr. Naiman: Now do they fight in the kennels as well as in the dog runs? • Mr. Koke:.. Mostly- in the kennels - ya - in the --- runs. Mr. Naiman: Now are some of the dogs female dogs? : Mr. Koke: Oh ya. • Mr. Neiman: And are there puppies that --- • Mr. Koke: Ya, especially when the dogs are in heat then they really go to it. • Mr. Right: Mr. Chairman, I just ask that perhaps we • could have a little foundation to his knowledge of this. Is this a commonly known thing. Does he have his own dogs so that he knows , . that this happens? For my own clarification I don't know how he • knows these things. - - -: - .- --- -11- / . / . When they are bakking like the dickens like that why how can you keep from it? Now we have storm doors and windows on - we keep them closed winter and summer. There are quite a few times they have woke me up then - I work on second shift and I don't get to bed very early --- Mr. Naiman: How much•.have you invested in your home in terms of dollars Mr. Koke? • Mr. Koke: I've got.:up to this'aime $18,644.09. Mr. Naiman: And that isiin actual -outlay of money. Mr. Koke: Thats right. Thats money out of my pocket. ' We doneiall the work ourselves - my wife and I. • Mr. Naiman: Are you renting this'property out or are you using it to live on? Mr. Koke: We've been living on it since - we bought it in January of 1969 and on June 7th of 1969 we moved outtthere. Mr. Neiman: Now did you buy this on' a purchase of sale contract ? Mr. Koke: Ya • Mr. Neiman: You do not have the legal title in your name. • Mr. Koke: Not yet no. Mr. Neiman: Is thereanything else: you would like to add to help the Commissioners in making their determination? Mr. Koke: Well if this is approved why then the whole' north side of the property will be into, of my;-property, will be into kennel. And they will all be facing right toward us. Billings: ' You lived on that property for 9 years in a trailer you say. .. " • • Mr. Koke: We lived in a trailer court for 9 years and we just decided with the dang noise and ruckus that goes along with it so we looked around and we found this - in fact - we came up to the dog Planning Commission to find out•if there could be a/kennel or feedlot put on this property and they showed us a map showing that this was zoned agriculture. So that was good enough for us::sso we went ahead and bought the property and all we wanted was peace and quiet. Mr. Billings: Were there any dog kennels there when you . purchased the property? • • • ' Mr. Koke: No sir, in fact the ground`,behind, us wasn't even sold. There were 3 lots sold there - the one five acres to the west of us, five acres to the east of us and ours. Mr. Mosert% When were the first kennels put in to your knowledge? • Mr. Koke: The first kennel? • Mr. Mosert:-. Yes. Mr. Koke: Right after the Commission okayed it and - -I believe it was 1971. •_ Mr. Moser: In the year of 1971. • Mr. Koke: Now we've tried to call the sherifff for this for the noise and he was out there - he went up to talk to Collins' " but they weren't home and they both work- so they are not home- - they don't know what their dogs are doing. Were you aware that Mr. Collins- was - it was brought at,the Planning Commission hearing was not planning on being employeed anymore and that he would be there for supervision at all times. He was not going to be employed out of the home anymore and was going to stay home strictly for the dogs. Mr. Naiman: Are you talking about Nrs. Collins? Mr. Right: Mr. Collins. Mr. Koke: No this was - you mean at the last hearing. Mr. Right: Yes. Mr. Koke: No what we understood then was .that she was going to quit Audience: To be home with the little girl. - Mr. Right: What I am wondering is - you indicated the noise and so forth has been bothering you. Do you think that an additional 60 dogs will make more noise than say 55 dogs that are there already. Pair. Koke: Fifty-five - therls not that many there now Pair. Right: If there 35 next to Mr. Collins, theres 20 dogs for Mr. Collins---- Mr. Koke: There is not that many there now. Mr. Collins only has, as far as I know now - only 11 and thats enough to drive you batty right there. Mr. Right: And you think that - do you know how‘many dogs . his neighbor has? Per. Koke: No I don't - I am sure that they don't have rla- • the maximum yet. , Mr. Right: Do you think the noise level would be any . • higher because of the dogs - additional dogs. Mr. Koke: Oh definitely - no doubt.. • Mr. Right: Do you think that the fact that Mr. Collins would be home would change the situation? • Mr. Koke: There is no way to keep doge quiet - dogs will be dogs and they are going to bark. And they have always • had from 11 to 12 dogs and at that time, when the dogs were fighting, they were doing that for two days, ,all all day long, and we can't - it is such in the evenings - with the"dogs - that they drive me in the house. We can't work outdoors even when you go around on the south side of the house there is always that noise. My kids are to the age where they have to be in bed by nine o'clock for school and in order to sleep all the north storm windows and windows are closed. Now Mrs. Motz, . I know, i have told here that. .And last summer they chose to exercise their dogs for 3 days - out there a hammerin'pens and one • • thing and another and it just about drove me up the wall and I finally . had to give her a call. Now I think it is pretty poor that we have to live with our windows closed all through the warm season for these dogs in the _back that are free to run in the run all the time. They don't • wear muzzles and it is just getting to the point where we can't take it anymore. And that is all I've got to say. • Mr. Billings: Thank you for your testimony. I don't know what .goes on - but they turn a rabbit _ loose and the dogs go after that. rabbit and therefore that is: a race track as far as I am concerned and the noise goes with it. Now at time, I don't know if it is feeding time-or whatever but they seem to get wild and it stirs the dogs up up north- the kennel which is closest - up there - and its just like living in a dog kennel. A11 I can say right now is that I don't live there but I am planning on moving in this summer its just dishearting to look out your back. window and look right smack at the dog kennel and -the noise that goes with it. Mr. Stehle: Well so far I havenit got the exact: figures its somewhere in the neighborhood of $10,000 in the construction up alone but its not completed. -17- e' - -- Yes there was thing that there was a statement made about, they bought the ground with the understanding they could have dogs on it - well I bought this ground with the understanding there was no such thing as dog kennels going to be out there because of the way it was parcelled off. Now here it states commercial feed yards shall be located at least 660 feet - dog kennels - no more than 330 feet from my house. So therefore I was under the impression that I would not have to live next to a dog kennel. And also it has created it seems - novi I don't live there but I have talked to the people' - it has created in the atmosphere in that neighborhood and I understand that some dogs of Collins have gotten out and have been shot at and things like that which are very unhealthy. Mr. Neiman: Do you know this of your own knowledge Mr. Stehle? Mr. Stehle: This is - I have - this is heresay and if it is not so I wish someone would say so. Mr. Naiman: Thank you tvYr. Stehle. The Weld County Zoning Ordinance permits ordinary repairs and maintenance on a Use by Special Review so long as it .does not have the effect of expanding or enlarging the use. Johnson and Dorothy R. Johnson, owners of a tract of land in the vicinity of the applicant's property. On behalf of our clients we would like to render a strong protest to the granting of the Land Use Permit-Dog Kennel Expansion. Our reasons are numerous and are briefly as follows: 1. The area in question is and has been an agricultural and farming area and should 'remain so. 2. That the vicinity has been recently plagued with packs of dogs which present a threat and menace to the area. 3. That the presence of an expanded dog kennel operation would, in our opinion, magnify the problem of dog packs especially during the periods of time when female dogs might be in heat. 4. The proposed expanded kennel would be incompatible with the traditional agricultural usage of the property and would tend to diminish the value of surrounding land for agricultural purposes. 5. That the existence of an expanded dog kennel might create a dangerous precedent for future development and zoning in the area.
