RESOLUTION RE: APPROVE REVISIONS TO SECTION 2.000 CHILD WELFARE OF THE DEPARTMENT OF HUMAN SERVICES POLICIES AND GUIDELINES MANUAL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with revisions to Section 2.000 Child Welfare of the Department of Human Services Policies and Guidelines Manual, and WHEREAS, after review, the Board deems it advisable to approve said revisions, copies of which are attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the revisions to Section 2.000 Child Welfare of the Department of Human Services Policies and Guidelines Manual, be, and hereby are, approved. Purpose The Weld County Department of Human Services (WCDHS) Denial of Application/Revocation of License Policy is intended to ensure that foster/kinship families abide by all State rules and regulations regarding the certification process and allowances within Volume 7 to become a certified foster/kinship home. B. Denial of Application An applicant who is seeking certification for the purposes of becoming a WCDHS Certified Foster/Kinship Home shall be denied the opportunity to pursue certification on the evaluation of Foster Care staff in consultation with the Resource Manager as follows: 1. An applicant does not qualify to be certified per Volume 7.500.312 D and E; or 2. Other occurrences which reflect negatively on the character or fitness of the applicant to provide care for foster children; or 3. A conflict of interest exists that would impact the confidentiality of the children and families or the fidelity of the foster care program; or 4. If is determined that an applicant knowingly or willfully made a false statement of any material fact or thing in the application which is perjury in the second degree as define in Section 18-8-503, C.R.S., and, upon conviction thereof, shall be punished accordingly C. Revocation of the Certificate for WCDHS Certified Foster/Kinship Home A WCDHS Certified Foster/Kinship Home shall have their certificate revoked and the children immediately removed from their home if the any of the following occur: 1. The foster/kinship parent(s) are convicted of a crime and/or exhibit any of the behaviors listed in Volume 7.500.312 E; or 2. The foster parent(s) own children have been placed in out of home placement under circumstances which demonstrate that the foster parent or another resident of the home was abusive, neglectful or a danger to the health, safety or well-being of their own children or the foster children; or 3. There is a compliant of abuse or neglect against the foster children, the complaint is investigated in accordance with Volume 7.500.317 A and the complaint is founded. Introduction Authorized certificates will be issued to the Weld County Department of Human Services (WCDHS) Certified Foster/Kinship Home that meets the standards provided in Section 2.3.240. and Colorado Department of Human Services (CDHS), Volume VII rules. WCDHS Certified Foster/Kinship care facility's agreement is revised only if there are significant changes or the foster parents move to a new facility. 1. Foster Care Certification Specialists or Coordinators shall visit each WCDHS Certified Foster Care/Kinship Home annually and complete the continuation notice according to CDHS. Volume VII rules. 2. During the annual visit, the Foster Care Coordinators will inspect the facility, and complete any other required forms necessary to continue the permanent certificate. B. Corrective Actions Regarding WCDHS Certified Foster Care Certificates 1. Foster Care Certification Specialists or Coordinators will identify actions of WCDHS Certified Foster/Kinship Care Home that: a) Violates rules, policy, or procedures, of a significant nature, which requires corrective action; or b) Results in a critical incident; or c) Violates the rights of a foster child, as stated in 7.708.33, CDHS, Staff Manual, Volume VII. 2. Foster Care Certification Specialists or Coordinators will identify conduct that is flagrant or serious, as described in Section 2.3.240., that warrants immediate action to the Resource Manager. The Foster Care Coordinators will follow the steps outlined in Section 2.3.240. of the WCDHS Operations Manual. 3. If the actions of WCDHS Certified Foster/Kinship Home requires a corrective action, the Foster Care Coordinator will issue a corrective action plan. The corrective action plan is a systematic series, or plan of affirmative events, intended to correct WCDHS Certified Foster/Kinship Home's performance or behavior. 4. The Foster Care Coordinator will develop the corrective action plan, in writing, including: a) Identification of the problem; and b) WCDHS Certified Foster/Kinship Home corrective action plan and deadline; and c) Consequences, if the corrective action plan is not successful. 5. The Foster Care Coordinator will monitor the corrective action plan. Revised January 2020 Department of Human Services Policies 6. If WCDHS Certified Foster/Kinship Home corrects the problem, and meets the expectation of the corrective action plan, the Foster Care Coordinator will issue and send a written acknowledgement of the completion of the corrective action plan to the foster/parent, the Foster Care Supervisor and the Resource Manager. 7. If WCDHS Certified Foster/Kinship Home's problem(s) is not corrected, and the expectations of the corrective action plan are not met, the Foster Care Coordinator will meet with the Foster Care Supervisor and the Resource Manager to discuss options and next steps.
